Recommended motion:
That the Mayor and Common Council close the public hearing and
affirm action of the Board of Building Commissioners Resolution
1:0. 1257 directing repair within sixty (60) days or demolition and
placing a lien on the property for $3,077.90 costs incurred.

STAFF REPORT
At the January 6, 1989, meeting of the Board of Building
Commissioners (BBC) a hearing was conducted on abatement of
the nuisance for property located at 528 North "H" street.
The property is owned by Dr. Hank S. Lee of Haleyville,
Alabama, who has submitted an appeal to the Mayor and Common
Council by letter dated January 9, 1989. The property was
boarded up by the City, as it was open and vacant and had
been utilized by transients. Additionally, the property had
incurred fire damage, had inadequate foundation and floors
for kitchen and bedroom, broken or missing exterior siding,
junk and debris throughout the facility and problems with the
heating system. The cost incurred by the City for board up
and other expenses are $3,077.90. to be levied against the
property owner with approval of BBC Resolution No. 1257. The
action of the BBC was that the owner abate the nuisance and
commence repair within 60 days or the city would initiate
action to demolish the residence. The owner asked for time
to improve and repair the property, but no specific date was
requested.
Considering the fact that the property owner is out of state,
staff recommends that the BBC action in Resolution No. 1257
stand and that at the end of 60 days, if repairs have not
been initiated to rehab the property, the city proceeds with
demolition of the structure.

Dear Mayor and Common Council;
This is a lettle to appeal the decision of the
Board of Building Commissioners on Jan. 6, 1989.
I ask the Mayor and Common Council to wave the
fee against the property, located at 528 North H Street.
I am willing to work with the Board of BU1lding Comis-
sioners, and the city of San Bernardino to improve this
lot, but I also need help from the Mayor and Council.
I bought the property on 10/05/88, from Mrs. Garcia.
The first inspected date was on 9/2/88, with the second
on the date of 11/30/88.
The first notice I received was a Certified letter,
with the date of hearing before the Board of Building
Commissioners. My understanding was the first two
letters were sent to the address of Teresa Silva Garcia.

I request the waiver on the property, and ask the
Mayor and Common Council to appeal this decision.
Again I had never received any letter or warn-
ing from the Deparment of Board of Building Comis-
sioners, until I received the letter of hearing.
I would like to thank the Mayor and members of
the Common Council, and ask you to accept my apology
for my absence.

CITY OP SAN BERNARDINO AUTHORIZING THE ABATEMENT OF A PUBLIC
NUISANCE

WHEREAS, pursuant to San Bernardino Municipal Code,
Title 15, Chapter 15.28, the Buildinq Official has posted a
buildinq(s) or premises located at 528 North H Street ,
San Bernardino, CalifQrnia, with a "Notice to Abate Nuisance"
and has notified the person or persons havinq an interest in
said property that the said buildinq(s) or premises constitute
a public nuisance, and has prepared a declaration of postinq
and mailinq of the notice, a copy of which is on file in
these proceedinqs: and
WHEREAS, pursuant to said San Bernardino Municipal Code,
the Buildinq Official has served a "Notice of Hearinq Before
the Board o~ Buildinq Commissioners of the City of San
Bernardino", relatinq to abatement of said nuisance, to the
person or persons havinq an interest in said property, and
has prepared a declaration of mailinq of the notice, a copy
of which is on file in these proceedinqs; and
WHEREAS, a hear~nq was held to receive and consider
relevant evidence, objections or protests on January 6
19~; and
WHEREAS, the Board of Buildinq Commissioners heard the
testimony and examined the evidence offered by the parties
relative to such alleqed public nuisance,
all

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF BUILDING
COMMISSIONERS OF. THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Based upon the evidence submitted, it is
found and determined that the buildinq(s) or premises
located at 528 North H Street , San Bernardino,
California, constitute a public nuisance for the reasons
set forth in Exhibit nAn, attached hereto and incorporated
herein by reference as thouqh fully set forth at lenqth as
the findinqs of fact of the Board.
SECTION 2. The owner(s) is hereby directed to commence
the abatement of the public nuisance by obtaininq the
necessary demolition and/or buildinq permits within ten (10)
days after the date of postinq of a copy of this resolution
in a conspicuous place on said buildinq(s) or premises. The
abatement must be completed within sixty (60) days
thereafter.
SECTION 3. In the event the public nuisance is not
abated within the prescribed period of time, the buildinq(s)
or premises shall be razed, demolished, removed, repaired or
rehabilitated by the city of San Bernardino, or by a person
or persons authorized by the Buildinq Official, and the

expense thereof made a lien on the lot or parcel of land upon
which the public nuisance is located. Such expense may be
made a personal obliqation of the property owner and subject
to immediate recovery by the commencement of court proceedinq
aqainst the party.
SECTION 4. Any person aqqrieved by this order may,
within fifteen (15) days after Januarv 17. 1989 , appeal
to the Common Council by filinq with the City Clerk a
written statement of the order appealed from, the specific
qrounds of appeal and the relief or action souqht from the
Common council.
