Descri tion f'./ Finance: Council Notes: Agenda Item NO.~ 75-0262 , ~ 'CITY OF SAN BERNjQDINO - REQUEST Fa COUNCIL ACTION STAFF REPORT A request was received on November 14, 1988, to vacate a portion of Atlantic Avenue, West of Palm Avenue, from the State of California, Department of Transportation. This request represents 50% of those owners who adjoin the street. The State has indicated that they have been in contact with the adjacent property owner, who is in favor of the proposed vacation, however, as part of our proceedings, all adjacent property owners are notified by mail of the proposal. The State has requested this vacation in conjunction wi th the on-going development of the Crosstown Freeway. The portion of Atlantic Avenue, West of the area proposed for vacation, will be cut off with the extension of the Crosstown Freeway. Said proposed vacated area will be a remnant piece. This remnant piece does not appear to be needed for public right-of-way. HARDGRAVE, Director of Public Works/City Engineer SUBJECT: street Vacation DATE: February 3, 1989 COPIES: File No. 15.30 - 276 ------------------------------------------------------------- The process of vacating a street does not transfer title of any property. 99% of our streets were by grant of easement only. The vacation of a street eliminates the easement but does not change the under1~ing fee-title to the property. We do not concern ourselves w~th the ownership issue, and it is up to the adjacent property owners to determine whether the use of the vacated land reverts back to them or not. This can be done through a title report from any Title Company. In the event that the city also has title to the property vacated, the city still retains ownership and onl~ the easement, setting the property aside for street and h~ghway purposes, is eliminated. In the case of the proposed vacation of Atlantic Street, the City has only an easement, and, therefore, no transfer of title will take place as a result of the vacation. ROGER G .
