RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO SUPPORTING
LEGISLATION TO DIRECT THE DIRECTOR OF THE STATE OFFICE OF
3 PLANNING AND RESEARCH TO GRANT AN ADDITIONAL TIME EXTENSION TO
COMPLETE THE GENERAL PLAN.

BE IT RESOLVED THAT the City of San Bernardino requests
6
legislation to direct the Director of the State Office of
7
Planning and Research to grant a further extension of time
8
9
despite the provisions of Government Code Section 65361, to
update the following mandatory elements: Land Use, Circulation,
10
Conservation, Open Space, Noise, and Safety.

The period of time requested is for one year from the date
12
the previous extension of time was granted by the Director of the
13
State Office of Planning and Research.
THIS REQUEST IS BASED UPON THE FOLLOWING FACTS:

1. The City requested an extension of time by Resolution
16
No. 87-135 which request was granted by letter from the State
17
Office of Planning and Research dated June 11, 1987.
2. The City, in conformance with the June 11 letter
completed an interim policy document including a preliminary land
use designation map for the City after numerous public hearings
by the Citizens Advisory Committee, the Planning Commission, and
the City Council.
3. The City requested a further extension of time by
Resolution No. 88-162 which request was granted by letter from
the State Office of Planning and Research dated June 9, 1988.
4. The City has made substantial progress toward the
completion of an adequate general plan by appropriating
sufficient local funds, hiring staff and exhausting the remedies

1 provided by Section 65361 of the Government Code.

5. A further general plan extension would assist the City
3 in preparing and adopting a complete and adequate general plan by
4 allowing additional community input and development of common
5
support.
Threatened or actual litigation would result in undue
6 pressure to quickly finalize the general plan and preclude
7 adequate public participation.

The necessity to prepare a thorough environmental
9 review due to the many environmentally sensi ti ve areas of the
10 Ci ty when combined with the required public review jeopardizes
11 the completion of the process in a timely fashion.

The City hereby incorporates the underlying facts and

13 findings of Resolutions Nos. 87-135 and 88-162.
8. Local review procedures including those mandated by the
15 Court in the case of Saldecke, et al. v. City of San Bernardino,
16 et al. (Case No. 236836), now require an extended public review
17 process which will result in delaying the decision by the Mayor
18 and Common Council on the adoption of a final general plan.

20 further extension, so that the timely preparation and adoption of
21 a general plan is promoted.
