Dear Mayor and Common Council;
This is a lettle to appeal the decision of'the
Board of Building Commissioners on Jan. 6, 1989.
I ask the Mayor and Common Council to wave the
fee against the property, located at 528 North H Street.
I am willing to work with the Board of BU1lding Comis-
sioners, and the city of San Bernardino to improve this
lot, but I also need help from the Mayor and Council.
I bought the property on 10/05/88, from Mrs. Garcia.
The first inspected date was on 9/2/88, with the second
on the date of 11/30/88.
The first notice I received was a Certified letter,
with the date of hearing before the Board of Building
Commissioners. My understanding was the first two
letters were sent to the address of Teresa Silva Garcia.
I am willing to work with the ~itr fo San Ber-
nardino to improve and repair the preuises and help
to upgrade the property on 528 No:th tl Street. But
I request the waiver on the property, and ask the
Mayor and Common Council to appeal this decision.
Again I had never received any letter or warn-
ing from the Deparment of Board of Building Comis-
sioners, until I received the letter of hearing.
I would like to thank the Mayor and members of
the Common Council, and ask you to accept my apology
for my absence.

RESOLUTION OF THE BOARD OF BUILDING COMMISSIONERS OF THE
CITY OF SAN BERNARDINO AUTHORIZING THE ABATEMENT OF A PUBLIC
NUISANCE

WHEREAS, pursuant to San Bernardino Municipal Code,
Title 15, Chapter 15.28, the Building Official has posted a
building(s) or premises located at 528 North H Street ,
San Bernardino, CalifQrnia, with a "Notice to Abate Nuisance"
and has notified the person or persons having an interest in
said property that the said building(s) or premises constitute
a public nuisance, and has prepared a declaration of posting
and mailing of the notice, a copy of which is on file in
these proceedings: and
WHEREAS, pursuant to said San Bernardino Municipal Code,
the Building Official has served a "Notice of Hearing Before
the Board of Building commissioners of the City of San
Bernardino", relating to abatement of said nuisance, to the
person or persons having an interest in said property, and
has prepared a declaration of mailing of the notice, a copy
of which is on file in these proceedings; and
WHEREAS, a hear~ng was held to receive and consider all
relevant evidence, objections or protests on January 6
19~; and
WHEREAS, the Board of Building Commissioners heard the
testimony and examined the evidence offered by the parties
relative to such alleged public nuisance,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF BUILDING
COMMISSIONERS OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Based upon the evidence submitted, it is
found and determined that the building(s) or premises
located at 528 North H Street , San Bernardino,
California, constitute a public nuisance for the reasons
set forth in Exhibit "A", attached hereto and incorporated
herein by reference as though fully set forth at length as
the findings of fact of the Board.
SECTION 2. The owner(s) is hereby directed to commence
the abatement of the public nuisance by obtaining the
necessary demolition and/or building permits within ten (10)
days after the date of posting of a copy of this resolution
in a conspicuous place on said building(s) or premises. The
abatement must be completed within sixty (60) days
thereafter.
SECTION 3. In the event the public nuisance is not
abated within the prescribed period of time, the building(s)
or premises shall be razed, demolished, removed, repaired or
rehabilitated by the City of San Bernardino, or by a person
or persons authorized by the Building Official, and the

expense thereof made a lien on the lot or parcel of land upon
which the public nuisance is located. Such expense may be
made a personal obligation of the property owner and subject
to immediate recovery by the commencement of court proceeding
against the party.
SECTION 4. Any person aggrieved by this order may,
within fifteen (15) days after Januarv 17. 19Rq , appeal
to the Common council by filing with the City Clerk a
written statement of the order appealed from, the specific
grounds of appeal and the relief or action sought from the
Common Council.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Board of Building Commissioners at aregu1ar
