REOUEST
The NAACP is appealing the

BACKGROUND
The applicant, Victor/Chaparral Treatment, requests approval
of a Conditional Use Permit to operate a day treatment center
and private school for emotionally disturbed adolescents in
the Public Enterprise Center, operated by the Redevelopment
Agency, at the southwest corner of Highland and Western
Avenues.
The project is categorically exempt from the review under the
California Environmental Quality Act (CEQA). The project
proposal is consistent with the Interim Policy Document's
land use designation of MU-7A Mixed Use. The proposal is to
lease about 5,000 square feet of the total 28,070 square foot
Public Enterprise building or about 18% of the structure. The
proposal would consist of three classrooms and counseling and
administrative areas. The purpose of the facility would be
to provide educational curriculum and psychological
counseling for adolescents who are emotionally disturbed
(i.e., abused, addicted to drugs, seriously depressed, etc.),
but not mentally retarded.
The facility would provide services for about 36 persons,
have a maximum staff of 21, and be operated between the hours
of 8:00 a.m. and 6:00 p.m., Monday through Friday. The site
design criteria of the zoning Code are in compliance.
The surrounding land uses consist of commercial uses to the
north and east, a vocational school to the west, and single-
family homes to the south. The neighbors to the south have
expressed opposition to the project. In addition to the
NAACP protesting this conditional Use Permit, the Chamber of
Commerce and San Bernardino Unified School District have sent
in protests (see attachments). These entities do not feel
that the proposed use is compatible with the existing or
planned uses in the center and neighborhood. The County's
Department of Mental Health, however, supports the project at
this site and would monitor the program to ensure proper
functioning and effectiveness.
One of the conditions of approval was that an annual review
of the conditional Use Permit would be made upon receipt of a

written complaint from an adjacent tenant or property owner.
At the Planning commission meeting held on December 6, 1988,
the Commission, by a 5 to 3 vote, voted to approve the
Conditional Use Permit after a recommendation of conditional
approval by staff and receiving public testimony.

FINDINGS OF FACT
1. The proposed use is consistent with the Interim Policy
Document adopted by the Mayor and Common Council on May
26, 1988, amended on June 6, 1988 and approved by the
State Office of Planning and Research on June 9, 1988
in that the proposed use is in an area designated MU-7A
on the Preferred Land Use Alternative Map which allows
the proposed use with the approval of a Conditional Use
Permit.
2. The proposed use will not adversely affect adjoining
land uses and the growth and development of the area in
which it is proposed to be located in that it is com-
patible with the existing uses in the vicinity.
3. The size and shape of the site proposed for the use is
adequate to allow full development of the proposed use
in a manner not detrimental to the particular area nor
to the peace, health, safety and general welfare in that
the site will accommodate the proposed facility and will
satisfy all requirements for screening, setbacks, land-
scaping, parking and access.
4. The traffic generated by the proposed project will not
impose an undue burden upon the streets and highways
designed and improved to carry the traffic in the area
in that the project will not intensify the traffic situ-
ation. Parking provided for the proposed use meets Code
requirements and will be adequate for the use.
5. The granting of this Conditional Use Permit under the
conditions imposed will not be detrimental to the peace,
health, safety and general welfare of the citizens of San
Bernardino.

To Whom It May Concern:
Recently on a 4-3 vote the planning commission approved a Conditional
Use Application 88-44 for the use of the Public Enterprise Building,
1505 West Highland Avenue, by Victor Chaparral Treatment Centers. The
reported use by the organization will be to treat youth with serious
adjustment problems. As you know, the San Bernardino City Unified
School District just recently acquired the Advanced Training Institute
at 1535 West Highland Avenue, which is adjacent to the Public
Enterprise Building. We specifically acquired the piece of property
not only for our use but as a community center for the west side. The
use of the building for the stated reasons seems contradictory to
promoting the image and activities at that location.
We hereby officially protest under the rules and regulations of the
City of San Bernardino the granting of that conditional use permit and
urge the city council's rejection of the planning commission's
recommendation.
Please.inform us when any public hearings will be held regarding this
issue. We appreciate your continued interest and assistance.

Dear Mayor Wilcox & Members of the Common Council:
On the evening of December 6th the San Bernardino City Planning
Commission approved a conditional use permit, allowing 5,000 sq., feet
of space in the Public Enterprise Center, to be used by the Mental
Health Treatment Center. This use is inconsistent with the original
intent of the facility as specified by the Economic Development
Administration. However, this use can be approved since one of the
buildings has just been sold to the school district for administrative
purposes, also an inconsistent use.
Currently, there are two compatible proposals, in terms of use and
joint tenancy, being reviewed by the Redevelopment Agency. One is a
youth (esp. minority) achievement building program (relocation of the
PAL Center), the other is a Business Incubator project developed by
the Chamber's Westside Task Force under the direction of Jim King and
Brian Townsend. Both of these proposals would be a tremendous plus
for the Westside and the City as a whole.
The San Bernardino Area Chamber of Commerce is asking that the Council
delay a decision in the Mental Health proposal until the PAL Center's
and Westside Task Force's proposals can be evaluated. Perhaps a final
recol1ll1endation could be agreed upon at a future "Roundtable" meeting.

Subj: Victor/Chaparral Request for Use of the Public
Enterprises Building
I am writing in support of the Victor/Chaparral Treatment
Center's request to secure the Public Enterprises Building
in San Bernardino in order to provide mental health ser-
vices to children and adolescents. The San Bernardino
County Department of Mental Health has contracted with
Victor/Chaparral for children's residential mental health
services since September, 1987. Our department invited
this organization to develop services in our area based
upon its 25 years of experience in the field, as well as
its excellent service reputation.
Currently, Victor/Chaparral Treatment Center provides
residential services to children and adolescents in each
of five 6-bed homes. Each home is located in a San Ber-
nardino area residential community and provides 24-hour
treatment and care. There have been no significant diffi-
culties resulting from the operation of the homes in these
neighborhoods. The comprehensive and consistent services
provided to residents have helped to fill a long-standing
gap in resources for youth in our county.
Planned for the Public Enterprises Building is a mental
health treatment program and a non-public school to serve
Victor/Chaparral residents, as well as children living in
the community. The Department of Mental Health would con-
tinue to provide weekly professional case management
services for the youth served by the program. In addition,
as part of our contract arrangement, the department would
continue its regular monitoring efforts to ensure proper
program functioning and effectiveness.

The planning Commission, at the last Commission meeting,
approved a conditional use permit that would allow a facility
that deals with emotionally disturbed minors at the Public
Enterprise Center, 1505 W. Highland Ave.
This Office has a concern over this type of use at this
location. The Center presently houses the Postal and Utility
payment Center, the westside Drop-In Center, the Inghram
Branch Library, the PAC Office and the CATV Studio. These
are all City operations designed to provide service and
assistance to the public. Frankly I find the use the CUP was
issued for not compatible with the other operations at the
Center.
Another concern is safety and exposure to liability. While
assurances have been given that there will be proper
supervision, what are the possibilities of someone wandering
away and maybe hurting a public patron. Even the perception
that this could happen may cause some people to stop coming
to the Center. Frankly, a greater concern for safety was one
of the reasons that certain operations were moved to the
Center. Would the City or the Agency Ultimately be held
responsible if someone did get hurt since City Planning
Commission did give approval and the Agency would be leasing
the space to this group.

1. REQUEST
The applicant requests approval of a Conditional Use
Permit under authority of Code section 19.78.020(10,17)
to operate a day treatment center and a non-public
school for emotionally disturbed adolescents.
2. SITE LOCATION
The subject property is a 3.14 acre parcel located at
the southwest corner of Highland Avenue and Western
Avenue in the Public Enterprise Center. (See Attachment
"F", Location Map.)
3. MUNICIPAL CODE & INTERIM POLICY DOCUMENT CONFORMANCE
The proposed use is consistent with the Municipal Code
and in conformity with the Interim Policy Document
adopted by the Mayor and Common Council on May 26, 1988
and approved by the Office of Planning and Research on
June 9, 1988. (See Attachment "A".) .

5. ANALYSIS
Details of Business Operation
The proposed facility will occupy approximately 5,000
square feet of the total 28,070 square foot building.
The facility, located on the west side of the building,
will consist of three classrooms with the remainder of
the space utilized for counseling and administrative
purposes. The facility will provide an educational
curriculum and psychological counseling for adolescents
who are emotionally disturbed (i.e., abused, addicted to
drugs, seriously depressed, etc.) but not mentally
retarded.
The facility will provide services for approximately 36
adolescents with an anticipated maximum staff of 21.
Hours of operation will be f~om 8:00 a.~. to 6:00 p.m.,

Monday through Friday. The students will be transporteq
to and from the facility in vans and will not otherwise
be allowed to leave the facility without direct
supervision.
Compatibility with surrounding Land Uses
The surrounding land uses consist of commercial uses to
the north and east, a vocational school to the west, and
single-family homes to the south. The proposed use is
compatible with the surrounding land uses in that it
will not detract from or interfere with the existing
uses.
Traffic, circulation and Parking
The existing site has access from Highland Avenue and
Western Avenue. The 166 total parking spaces shown on
the site plan will accommodate the proposed use and
remaining uses on the site. The parking requirements for
this use were calculated as a day care center, as
specified in Code Section 19.56.090, "one space for each
staff member plus one space for each six students." The
proposed use will require 27 parking spaces. circulation
on the site is adequate.
6. COMMENTS RECEIVED
No comments have been received.
7. CONCLUSION
The size and shape of the parcel is adequate to
accommodate the proposed facility. The proposal also
meets Municipal Code requirements for parking and
circulation and is in conformance with the Interim
Policy Document. The proposal is permitted with the
approval of a Conditional Use Permit.
8. RECOMMENDATION
Staff recommends that the Planning Commission approve
Conditional Use Permit No. 88-44 subject to the
following Findings of Fact (Attachment "B"), Conditions
of Approval (Attachment "C") and Standard Requirements
(Attachment "0").

1. The proposed use is consistent with the Interim Policy
Document adopted by the Mayor and Common Council on May
26, 1988, amended on June 6, 1988 and approved by the
state Office of Planning and Research on June 9, 1988 in
that the proposed use is in an area designated MU-7A on
the Preferred Land Use Alternative Map which allows the
proposed use with the approval of a Conditional Use
Permit.
2. The proposed use will not adversely affect adjoining
land uses and the growth and development of the area in
which it. is proposed to be located in that it is
compatible with the existing uses in the vicinity.
3. The size and shape of the site proposed for the use is
adequate to allow full development of the proposed use
in a manner not detrimental to the particular area nor
to the peace, health, safety and general welfare in that
the site will accommodate the proposed facility and will
satisfy all requirements for screening, setbacks,
landscaping, parking and access.
4. The traffic generated by the proposed project will not
impose an undue burden upon the streets and highways
designed and improved to carry the traffic in the area
in that the project will not intensify the traffic
situation. Parking provided for the proposed use meets
Code requirements and will be adequate for the use.
5. The granting of this Conditional Use Permit under the
Conditions imposed will not be detrimental to the peace,
health, safety and general welfare of the citizens of
San Bernardino.

Conditional Use Permit No.,88-44 shall be in effect for a.
period of 12 months from the date of approval. However, if no
development has been initiated at the end of the 12 month
period, the application shall expire. Additional time may be
approved upon request of the applicant prior to expiration of
the l2-month period. Expiration Date: December 6, 1989.

PARKING:
a. This development shall be required to maintain a minimum of
27 standard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two
inches of AC over a suitable base or equivalent as approved
by the City Engineer. Parking spaces shall be striped and
have wheel stops installed at least three feet from any
building, wall, fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or
across an alley from property zoned residential, a solid
decorative wall six feet in height shall be erected and
maintained along the property line so as to separate the
parking area physically from the residentially zoned
property provided such wall shall be three feet in height
when located within the required front or street side yard
setback. Where no front or street side yard is requireG,'.
such wall shall be three feet in height when located within
ten feet of the street line.
d. Whenever an off-street parking area is located across the'
street from property zoned for residential uses, a solid
decorative wall or equivalent landscape berm not less than
three feet in height shall be erected and maintained along
the street side of the lot not closer to the street than
the required depth of the yard in the adjoining residential
area. No fence or wall located in the front setback shall
obscure the required front setback landscaping.

Whenever refuse bins are located within or adjacent to a parking
area used by the public, they shall be enclosed by a decorative
wall six feet in height along the rear and sides and screened

Within 75 feet of any single-family residential district, the
maximum height of any building shall not exceed one story or 20
feet unless the Commission determines that due to unusual
topographical or other features, such restrictive height is not
practical.

portion of the Council Agenda of January 17, 1989. If
approved at that time, the Agency may wish to reconsider
leasing the building to the county for that purpose.

It has recently' been brought to my attention that the San
Bernardino Planning commission has decided to place a school
for seriously disturbed teenagers in the Public Enterprise
center, which currently houses the City's KCSB TV-3 Produc-
tion Studio.
I have spoken with a key member of the school in question and
As I am sure you are aware, the Production Studio is open to
a great number of people, from members of the general public
to local, county, state and federal dignitaries. I was told
by a key member of the school in question that incidents of
exposure and verbal obscenities are common among these young
people, .~ we are concerned that such activity would seri-
ously damage the image we have attempted to build among those
who make use of the Studio facility.
Another issue is the adjacent courtyard area, which is
designed for multi-tenant use. If the school is approved as
a tenant, our staff and guests would obviously lose the use
of that space for any type of production. This. would
seriously impact the long-term production capabilities of
KCSB TV-3.
Because of the above mentioned concerns, I would like to
formally oppose the decision of the Planning Commission. I
hope you will express my opinion to the proper officials,
with the understanding that we hope to maintain activities to
the best interest of the City of San Bernardino and all its
residents.

Please reference the attached memo from Oscar Perrier, Senior Nutrition Program
Supervisor and your conversations with Tom Boggs, AcRinistrative Operations
Supervisor of this Department relative to the 'proposed use of space at the
Enterprise Building by a youth rehabilitative service organization.
Mr. Perrier's memo relates his concerns about a possible conflict of operation
between the current program and the proposed youth rehabilitation program proposed
to move into the Enterprise Building. Mr. Boggs has related his concern and that
of the staff at Westside Drop-in Center, also housed in the Enterprise Building,
that there will be a definite detrimental affect on the programs and services
being offered at the Center should the youth rehabilitative program be allowed
to operate at that location.
It is our opinion that the present programs and services located at the Enterprise
Building and those of the rehab program are incompatible. The Westside Drep-in
Center has a large number of services and programs which are offered to Senior
Citizens as well as other age groups. As the word has spread that such a program
would be ~Qused at the Enterprise Building, the individuals being served regularly
at the Center have voiced fear and concern for their safety and have indicated
they would not patronize our services under those circumstances.
The Westside Center moved to the Enterprise Building because of security and
safety problems in the previous location. With the inclusion of the proposed
program, it is believed that there are potentially new safety and security problems
which would overshadow those dealt with at the other location. Because of those
problems at the previous location, the number of persons using the services and
programs had dropped. At the Enterprise Building, the number of clients has increasec
and continues to do so. Any change in security and safety of the location could
again reduce the number of those serviced to a point that the center would not be
a cost efficient operation.
It is my understanding that there is concern among the other tenants in the
building, specifically the Library and the Post Office because their clientele
have voiced their fears about being in the area with potentially dangerous persons.
Based on this information and concern, I request that some type of action be
taken to reconsider allowing the operation of the youth rehabilitation program
at the Public Enterprise Building.

As you are aware, our Department has recently opened a Senior Nutrition Program
at the Public Enterprise facility. The opening on December 12, 1988 offered an
oppor~anity for the Senior Nutrition Program to increase participation of Westside
Senior residents in an atmosphere of safety and compatability of programs offered
by the Public Enterprise facility.
It has come to my attention that the County of San Bernardino's Mental Health
Department and a private agency are proposing to install a rehabilitative
services program at the Public Enterprise Center. It is my understanding that
the services will be geared to youth and young adults who are:
1.) Probation Department referrals.
2.) Offenders - (violent).
3.) Battered and abused individuals.
4.) Medicated individuals.
It has been my experience that these types of programs with their related clientele
are ~ot'co.patible with Senior services. .
Senior services, such as the Senior Nutrition Program cannot coexist with social
services that are directed at the above mentioned population groups.
Listed below are a few key senior considerations in regards to desirability of
programs and facility utilization.
1.) Safety-Security
2.) Program compatibility with other facility uses.
3.) Preconceived stereotypical attitudes abo~t the above outlined
client profiles of the program in question.
It is my best judgement that the interjection of a rehabilitation program at this
facility will sound a death note for the Senior Nutrition Program at Public
Enterprise.

At their last Board meeting on December 15, 1988. the Library Board of
Trustee&'discussed the proposed use of the Public Enterprise Building for
an ongoing program involving emotionally disturbed teenagers. The Board
felt that such a proposal was not appropriate for the kind of programs
that are now being housed in that facility.
In the past the Library has had problems with similar kinds of prograas.
mainly because of the lack of proper supervision of the students. With
the limited space and the growing use of our facility by our literacy patrons
we would be hard pressed to deal with any kind of discipline proble..
The Board suggests another location. preferably a separate facility for
their program.

RE: Public Enterprise Building Lease to
Victor Residential Services
I supervise the Children's Placement Division of the San
Bernardino County Department of Mental Health. We contract with
Victor Residential Services for exclusive use of the six group
homes they operate in San Bernardino County. The terms of our
contract specify that only San Bernardino County residents can be
placed in these facilities. All children and adolescents placed
there are screened and referred directly by our clinical staff.
Children placed in the Victor facilities are typically the
innocent victims of various forms of abuse or neglect. Their
typical diagnosis is severe clinical depression. Many have been
hospitalized following suicide attempts and are still not ready to
return to a regular school and social environment. They tend to
be withdrawn and scared, rather than violent or dangerous. Our
criteria for placement in community group homes preclude minors
with a histo~y of serious drug abuse, violent crimes, or
membership in gangs.
The day treatment and school program proposed by Victor for the
Public Enterprise Building would serve the residents of the Victor
Group Homes, but in addition, 20% of its enrollment would be open
to residents of the immediate community who need specialized
mental health services. We currently have referrals for such
services from Martin Luther King School. The Public Enterprise
location would be ideal for these children. .

From an economic and an affirmative action perspective, the Victor
program would generate entry-level jobs on the West Side. The
proposed day treatment program would allow high school graduates
and community college students to become directly involved in
meaningful human services jobs. Victor Residential Services has
proved to be an excellent affirmative action employer. At the
present time over 50% of their 100 employees are either Black or
Hispanic.
I urge you to give Victor Residential Services a chance to prove
themselves by allowing them to immediately lease a portion of the
Public Enterprise Building.
