At the December 12,1988 meeting of the Environmental Review Committee,
the Committee voted to recommend approval of Negative Declaration for
Amendment to Interim Policy Document No. 88-1.
Recommended motion:
That the Mayor and Council approve Amendment to Interim policy
Document No. 88-1, which changes the land use designation from RL
Low Residential to RS Suburban Residential for the land contained
in Phase II of Tentative Tract No. 12872; and to adopt the Negative
Declaration.

Subject: Amendment to the Interim Policy Document No. 88-1

REOUEST
The applicants request a change of the land use designation
of the Interim Policy Document from RL Residential-Low (1-3
du/net acre) to RS Residential-Suburban (3.1-4.5 du/net acre)
on the undeveloped Phase II section of Tract No. 12872. The
site consists of 9.6 acres and is located on the north side
of the proposed extension of Morgan Road, west of Little
Mountain Drive. The total combined area of Phase I and Phase
II of Tract No. 12872 is 38.9 acres. The change is being
requested to permit the recordation of the 9.6 acre Phase II
section with 42, R-1-7200 Single-Family Residential lots for
future development.
BACKGROUND
In February, 1985 the Planning Commission approved Tentative
Tract No. 12872 and a Negative Declaration for a 12 lot,
single-family subdivision in the R-1-7200zone. On June 11,
1987 the State Office of Planning and Research imposed a
moratorium on single-family development north of the
Saldecke-Sky line. On February 5, 1988 the moratorium
restrictions were relaxed to allow single-family subdivisions
north of that line with minimum lot sizes of 10,800 square
feet.
In an effort to meet the 10,800 minimum lot size requirement,
the applicant submitted a revised tract map that split the
subdivis~on into two phases: Phase I, containing 57 lots
with R-1-10,800 lot sizes and Phase II, containing 42 lots
with R-1-7200 lot sizes. On May 3, 1988 the Planning Commis-
sion unanimously approved Phase I based on previous environ-
mental clearance, Findings of Fact, and Conditions and
Standard Requirements.
The Planning commission's approval was appealed on May 9,
1988 by Barbara Sky and by Joy Kolstad on May 11, 1988. On
June 10, 1988 the Mayor and Council denied the appeals and
approved Phase I of Tentative Tract No. 12872 (Revised),
subject to Findings of Fact and Conditions, and adopted a
Negative Declaration.
Phase I was later recorded with R-1-10,800 lots and is
currently under construction.
CEOA STATUS
On January 17, 1985, Tract No. 12872 received a recommended
Negative Declaration during the regularly scheduled meeting

of the Environmental Review Committee and it was determined
that the tract would not have any detrimental effect on the
environment. Based on this, the Initial Study for Amendment
to the Interim Policy Document No. 88-1 was focused only on
the potential impacts of the requested change in the site's
land use designation (see Attachment A).
ANALYSIS
General Vicinity
The surrounding land uses include single-family residences on
7,200 square foot lots to the north and to the southwest of
the 9.6 acre Phase II subject area. The 29.3 acre Phase I
section of Tract No. 12872 is currently under construction
and has R-1-l0,800 square foot residential lots. The
property directly to the west is a park.
Land Use
Under the current RL Residential-Low Interim Policy Document
designation, the subject 9.6 acre Phase II site could have a
maximum of 28 R-l-10,800 lots (3 dujacre). Under the pro-
posed RS Residential Suburban designation, 42 R-1-7200 lots
could be created. This would represent a 14 lot increase.
PROPOSED LAND USE ALTERNATIVES
A review of the various land use alternative maps considered
by the Mayor and Common Council shows that the subject site
was designated RL Residential-Low. The minutes indicate that
the RL Residential-Low designation was never discussed as
being appropriate or inappropriate for the site.

A request to change the Interim Policy Document Land Use
Designation on the Phase II section of Tract No. 12872 from
RL, Residential Low (1-3 du/net ac.) to RS, Residential
.Suburban (3.1 - 4.5 du./net ac.). The site consists of 9.6
acres and is located on the north side of the proposed
extension of Morgan Road west of Little Mountain Drive. The
total combined area of Phase I and Phase II is 38.9 acres.
Phase I is recorded and is under construction with 57, R-1-
10,800 Single-Family Residential lots as required under the
Interim Policy Document, RL, Residential Low land Use
Designation. The change is being requested to permit the
recordation of 42, R-1-7200 lots and ,to subsequently develop
the lots with single family homes.
The site is not located within an Alquist-Priolo Special
Study zone nor is it located within an area subject to
liquefaction. A geologic report was included with the 1985
application for Tract No. 12872 (formally Tract No. 12206).
Soils were reviewed to determine slope stability for grading
purposes. The tract received a Negative Declaration during
the January 17, 1985 meeting of the Environmental Review
committee which determined that the project would have no
detrimental effect on the environment. Because the tract
received environmental review, this Initial Study will focus
on potential impacts of the requested Land Use Designation
change.

2.c. Air Resources
The site is located in a high wind hazard area. There
would be no specific impact relating to the proposed
Land Use Designation Change; however, mitigations are
automatically required by Ordinance through the Building
and Safety Department's plan check process to limit
potential impacts to a level of insignificance and to
ensure compliance of building design prior to issuance
of building permits.
3.a. Water Resources
There may be a change in absorption rates and amount of
surface water runoff because fourteen more houses could
be developed under the proposed RS designation. It was
determined by the Engineering Department that the
addition of fourteen houses would not create substantial
increase in surface water runoff in that there is
adequate capacity to carry the runoff in the streets to
the storm drains. No mitigation is required.
6.a Land Use
Under the current RL, Residential Low, Interim Policy
Document designation, the subject 9.6 acre Phase II site
could have a maximum of 28 lots (3 du/ac. The submitted
plans show that under the proposed RS, Residential
Suburban designation, 42 lots could be created. This
represents a 14 lot increase. In review of the various
Alternative Land Use Maps developed for consideration,
each designated the site for RL, Residential Low. The
minutes indicate that the RL designation of the site was
never discussed as appropriate or inappropriate. The
surrounding land uses include single family residences
on 7,200 square foot lots to the north and to the
southwest of the 9.6 acre Phase II subject area. As
noted previously, the 29.3 acre Phase I portion of the
tract to the southeast and currently under construction,
has R-l-10,800 Single Family Residential lots. The
property directly to the west is a park. The
development of the site with R-1-7200 Single Family
Residential uses would be appropriate since the site is
adjacent to existing 7,200 square foot single family
lots to the north and to the southwest. Development of
the site with residential uses is consistent with the
intent and purpose of the Interim Policy Document.

9. TransDortation/Circu1ation
The Engineering Department has reviewed the request and
has determined the 14 additional single family homes
would generate 140 additional trip ends, for the tract
each dav. The additional ~raffic is insignificant and
will not impact the capacities of either existing or
proposed streets within the area. The local streets in
the area are designed to carry approximately 3,000 to
4,000 trips per day. The additional 14 trips during
