On September 11, 2000, Southern California Edison (SCE) announced that it is offering an Light
Emitting Diode (LED) Traffic Signal Rebate Program to cities throughout Southern California on
a "first come-first served" basis. The program encourages the retrofit of incandescent traffic signal
lamps with the more energy efficient LED lamps to significantly reduce traffic signal utility
demands and costs to the City.
On September 28, 2000, Public Works staff was successful in obtaining an approved LED Traffic
Signal Rebate Reservation Request for $918,720.00 to retrofit approximately 8,000 bulbs with
LED units at 258 traffic signals and pedestrian flashers throughout the City. This is the 2nd largest
grant of all applicants within the SCE service region.
The estimated installation (labor) costs and sales tax totaling $408,200 will be the responsibility
(local match) of the City. In addition, the LED lamp retrofit project must be completed by June
1, 2001 to receive the full rebate entitlement. Should the project not be completed by June 1, the
material costs will only be 50% reimbursed through this program thereby increasing the payback
period from 1.5 years to 3-4 years using current utility rates. Staff also estimates that 15% of the
traffic signal heads and pedestrian heads are obsolete and need to be replaced to accommodate the
new LED units. Time is of the essence, if we are to meet the deadline for full funding since
certain contractors and suppliers may be overwhelmed by the heavy regional demand associated
with this program.
The conditions associated with the LED Rebate Program stipulate that SCE will provide incentive
rebates per installed unit (lamp) based on the actual cost of the materials only. The incentive
amount paid will be the invoiced amount for the LED lamps, not to exceed the posted incentive
amount. The lamps purchased must adhere to the specified power demand range. The annual
energy cost savings is estimated to be about $270,000 based on current utility rates. The actual
savings could be higher if electrical rates are increased (Exhibit B). The payback period for the
local match requirements realized by the cost savings of the program would be about 1.5 years
based on current utility rates.

Once bids are received, staff will bring forward a recommendation to Council for award of
contract and establish the budget necessary to provide for the pass-through of contract payments as
well as the local match and additional staff costs.
It should also be noted that although this evolution to LED traffic signal bulbs is beginning to
occur everywhere, there will be a difference in the brightness level people are accustomed to with
existing bulbs (somewhat brighter when directly in front of the signals and less bright when
viewed from an angle).
Financial Impact:
Staff has estimated the total project cost to be $1,326,920. Of this amount, $918,720 will be
funded through the Southern California Edison "LED Traffic Signal Rebate Program," leaving
approximately $408,200 for the City to fund. Once bids are received and analyzed, staff will
recommend a budget amendment reflecting the total project cost of approximately $1,326,920, the
rebate revenue of $918,720 and the short-term financing of the $408,200 through either a
California Energy Commission loan or through an internal loan from the Sewer Construction
Fund. Payback of the loan over a period of 1.5 years will be funded from the estimated $270,000
annually in energy savings expected to be achieved as a result of this project (based on current
utility rates). Since this project is related to utility functions, it will be charged to the Utility Fund,
account number 631-332-5504-7218.
Recommendation:
Adopt Resolution: 1) authorizing the submittal of an LED Traffic Signal Rebate Program
application with SCE for $918,720.00; 2) authorizing advertisement for Bids for the LED
retrofit project.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the City Administrator is hereby authorized and directed on behalf
of said city, to submit an application to Southern California Edison, for an LED Traffic Signal
Rebate in the amount of $918,720.00, a copy of which is attached hereto as Exhibit "A", and
made a part hereof.
SECTION 2. That the City Engineer is hereby authorized to advertise for construction

Repayment Terms
The repayment schedule is based

extended up to II years.
Applicants will be billed twice a
year after the projects are
completed.
How Will Funds Be
Disbursed?
The funds are available on a
reimbursement basis. Receipts or
invoices for expenses incurred
must be submitted with each
reimbursement request. In some
cases, purchase orders for
equipment or sevices may be
accepted in lieu of actual receipts.
The final 10 percent of the funds
will be retained until the project is
completed. Interest is charged on
the unpaid principal computed
from the date of each
disbursement to the borrower.

In our continuing efforts to maintain our competi-
tiveness in the healthcare industry, we completed a
lighting system retrofit project last year. The project
helped reduce our electrical expenditures, improved
lighting levels, lowered air conditioning load and
kept us abreast of modern lighting technologies. The
California Energy Commission:S funding enabled
us to install these timely and cost-effective measures.
This project reduced our annual operating costs by
$40,000 while providing a brighter and more pleas-
ant environment for out patients, visitors and staff.

The Energy Commission loan gave us the funding
we needed to expand our Supervisory Control and
Data Acquisition (SCADA) system. We are commit-
ted to proactively managing and conserving our
water and energy resources for the benefit of the
growers we serve. This expansion will not only help
us in that endeavor, but will also ultimately provide
the basis for achieving greater on-farm efficiencies.

We were interested in replacing our red traffic sig-
nallamps with those using light emitting diodes
(LEDs). However, we needed a funding source that
was quick and easy in order for us to take advan-
tage of the utility rebates. The Energy Commission
loan met these requirements and we were able to
get a loan in place quickly and get the projects in-
stalled in a very short time. Our LEDs are now in-
stalled and we are saving an estimated $24.000
annually on electricity. We will have the entire
project paid back in iess than four years.

We first received an Energy Commission loan to
install energy-saving lighting and controls for our
heating and air conditioning system at the high
school. After the projects were installed and we saw
the drop in our utility bills, we decided to get addi-
tionalloans to install similar projects in our remain-
ing schools. These projects have eliminated wasted
energy and provided a better learning environment
for our students and teachers.

over $100,000 to install efficient lighting and heating and cooling systems at our two schools.
These projects have benefited the district in several ways. First the district has saved an esti-
mated $38.000 per year in reduced energy costs. Second. the installations have resulted in the
creation of a district-wide Energy Awareness Program which instills the energy efficiency
ethic to our students - our future energy consumers and decision-makers.

PENALTIES OR PREJUDICE TO ANY OF THE COMMISSION'S REMEDIES,

E. NO ALTERATION OR VARIATION OF THE TERMS OF THIS AGREEMENT
SHALL BE VALID UNLESS MADE IN WRITING AND SIGNED BY THE
PARTIES HERETO, AND NO ORAL UNDERSTANDING OR AGREEMENT NOT
INCORPORATED HEREIN, SHALL BE BINDING ON ANY OF THE PARTIES

3. PURPOSE
THE BORROWER AGREES TO EXPEND ALL FUNDS ADVANCED PURSUANT
TO THIS AGREEMENT ONLY FOR THE PURPOSES AND IN THE AMOUNTS SET
FORTH IN THE ATTACHED BUDGET DETAIL. IN THE EVENT THE
COMMISSION DETERMINES THAT FUNDS HAVE BEEN EXPENDED
WITHOUT PRIOR WRITTEN APPROVAL BY THE COMMISSION FOR
PURPOSES OTHER THAN THOSE SPECIFIED, THE FULL AMOUNT OF THE
LOAN, INCLUDING PRINCIPAL AND INTEREST, SHALL BE IMMEDIATELY DUE
AND PAYABLE.

A. THE COMMISSION AGREES TO DISBURSE FUNDS TO THE BORROWER
UPON THE PROPER EXECUTION OF THE ATTACHED PROMISSORY
NOTE AND ANY APPROPRIATE SECURITY INSTRUMENTS, AND
REQUIRED SUPPLEMENTAL DOCUMENTS, INCLUDING INVOICES AS
REQUIRED IN PARAGRAPH C.
B. THIS PARAGRAPH APPLIES ONLY TO BORROWERS WHO HAVE
RECEIVED TECHNICAL ASSISTANCE OR A FEASIBILITY STUDY BY A
CONSULTANT UNDER CONTRACT TO THE COMMISSION AND ARE
FINANCING THE TECHNICAL ASSISTANCE OR STUDY REIMBURSEMENT
THROUGH THIS LOAN. THE COMMISSION WILL REIMBURSE ITSELF
FROM THE BORROWER'S LOAN PROCEEDS FOR THE TECHNICAL
ASSISTANCE OR FEASIBILITY STUDY COST WHICH WAS PROVIDED IN
ACCORDANCE WITH THE ENERGY PARTNERSHIP PROGRAM SERVICES
AGREEMENT, DATED . SUCH REIMBURSEMENT WILL
OCCUR ON THE DATE THE COMMISSION EXECUTES THIS LOAN
AGREEMENT AND WILL BE EQUAL TO $
C. EXCEPT FOR THE TECHNICAL ASSISTANCE OR FEASIBILITY STUDY

INDICATED IN B., LOAN FUNDS SHALL BE DISBURSED ON A
REIMBURSEMENT BASIS BASED ON INVOICES SUBMITTED BY BORROWER
IN A FORM APPROVED BY THE COMMISSION. BILLINGS MUST BE
PROVIDED TO SUBSTANTIATE THE REQUEST. COMMISSION STAFF WILL
APPROVE INVOICES ONLY AFTER VERIFYING REQUESTED AMOUNTS
AGAINST BACKUP BILLINGS AND DETERMINING EXPENSES ARE
APPROPRIATE AND USED FOR THE PURPOSE OF THE LOAN.
D. TEN PERCENT (10%) OF THE LOAN AMOUNT WILL BE WITHHELD AS
RETENTION UNTIL THE FINAL REPORT IS RECEIVED AND THE
COMMISSION'S PROJECT MANAGER DETERMINES THE PROJECT HAS
BEEN SATISFACTORILY COMPLETED.
E. AN ADVANCE OF UP TO TEN PERCENT (10%) OF THE LOAN BALANCE
(AFTER COMMISSION REIMBURSEMENT FOR THE TECHNICAL
ASSISTANCE OR FEASIBILITY STUDY COST, IF APPLICABLE) MAY BE
REQUESTED AT THE START OF THE PROJECT. SUBSEQUENT ADVANCES
MAYBE ALLOWED WHEN RECEIPT OF FUNDS ON A REIMBURSEMENT
BASIS PRESENTS AN UNDUE HARDSHIP TO THE BORROWER.

THE LOAN HEREIN SHALL BEAR SIMPLE INTEREST AT THE ANNUAL RATE
SET FORTH IN THE ATTACHED PROMISSORY NOTE ON THE PRINCIPAL
BALANCE OF LOAN FUNDS DISBURSED TO THE BORROWER. PAYMENT OF
SAID INTEREST SHALL BE DUE AT THE TIME OF REPAYMENT OF THE
LOAN TO THE COMMISSION, AND INTEREST SHALL ACCRUE FROM THE
TIME OF DISBURSAL OF FUNDS TO THE BORROWER UNTIL RECEIPT OF
FULL REPAYMENT BY THE COMMISSION. INTEREST ON COMMISSION
REIMBURSEMENT FOR TECHNICAL ASSISTANCE OR THE
FEASIBILITY STUDY, IF APPLICABLE, SHALL ACCRUE FROM THE DATE
THE
COMMISSION EXECUTES THIS LOAN AGREEMENT UNTIL RECEIPT OF
FULL REPAYMENT BY THE COMMISSION.
6. TERM
A. THE EFFECTIVE DATE OF THIS AGREEMENT SHALL BE THE LAST DATE
OF EXECUTION.
B. THE BORROWER AGREES TO COMPLETE PERFORMANCE OF ITS
OBLIGATIONS UNDER THIS AGREEMENT WITHIN THE PERIOD STATED IN
THIS AGREEMENT.
7. REPAYMENT

8. PREPAYMENT
BORROWER SHALL HAVE THE RIGHT TO PREPAY ALL OR ANY PART OF THE

9. PROMISSORY NOTE

BENEFICIARY. BORROWER SHALL ALSO OBTAIN AND DELIVER A
STANDARD CLTA TITLE INSURANCE POLICY FOR THE SECURED
PROPERTY, INSURING THE COMMISSION'S INTEREST AS LENDER. AND A
CURRENT MARKET VALUE APPRAISAL OF SAID PROPERTY WITH
VALUES SUPPORTED BY AVAILABLE MARKET DATA WHICH HAS BEEN
PREPARED BY A LICENSED APPRAISER.
B. FOR ALL NONGOVERNMENTAL LOANS SECURED BY A DEED OF TRUST,
THE BORROWER AGREES THAT IN THE EVENT IT SELLS, TRANSFERS,
MORTGAGES, DISPOSES OF, OR FURTHER ENCUMBERS THE SAID
PROPERTY, OR ANY PART THEREOF, WITHOUT THE PRIOR WRITTEN
CONSENT OF THE COMMISSION, THEN THE COMMISSION SHALL HAVE
THE RIGHT, AT ITS OPTION, TO DECLARE THE ENTIRE BALANCE OF
THE UNPAID PRINCIPAL WITH UNPAID INTEREST DUE THEREON,
IMMEDIA TEL Y DUE AND PAYABLE. CONSENT TO ONE SUCH
TRANSACTION SHALL NOT BE DEEMED TO BE A WAIVER OF THE
RIGHT TO REQUIRE CONSENT TO FUTURE OR SUCCESSIVE TRANSACTIONS.
11. ACCOUNTS
A. IF REQUESTED BY THE COMMISSION, THE BORROWER AGREES TO
DEPOSIT ALL FUNDS RECEIVED UNDER THIS AGREEMENT IN A
SEGREGATED ACCOUNT IN AN INSTITUTION WHOSE DEPOSITS ARE
INSURED BY THE FEDERAL OR THE STATE GOVERNMENT.
B. THE BORROWER FURTHER AGREES TO ESTABLISH ON ITS BOOKS A
SEPARATE ACCOUNT FOR THIS LOAN. THIS ACCOUNT SHALL BE
MAINTAINED AS LONG AS THE LOAN OBLIGATION REMAINS
UNSATISFIED.

C. THE BORROWER FURTHER AGREES TO MAINTAIN RECORDS THAT
ACCURATELY AND FULLY SHOW THE DATE, AMOUNT, PURPOSE, AND
PAYEE OF ALL EXPENDITURES DRAWN ON SAID ACCOUNT.
D. THE BORROWER FURTHER AGREES TO UTILIZE A VOUCHER SYSTEM BY
WHICH ALL EXPENDITURES FROM SAID ACCOUNT WILL BE
AUTHORIZED AND AUTHENTICATED.
E. THE BORROWER FURTHER AGREES TO ALLOW THE COMMISSION OR ANY
OTHER AGENCY OF THE STATE OR THE FEDERAL GOVERNMENT. ON
WRITTEN REQUEST. TO HAVE REASONABLE ACCESS TO, AND THE
RIGHT OF INSPECTION OF. ALL RECORDS THAT PERTAIN TO SAID
ACCOUNT. THE BORROWER ALSO AGREES TO SUBMIT TO AN
INDEPENDENT AUDIT, IF REQUESTED BY THE COMMISSION, AT THE
EXPENSE OF THE BORROWER.
F. THE BORROWER FURTHER AGREES TO MAINTAIN RECORDS FOR THREE
(3) YEARS FOLLOWING PROJECT COMPLETION SHOWING THE COST OF
THE ENERGY SAVED AS A RESULT OF IMPLEMENTING THE PROJECT
FUNDED IN WHOLE OR IN PART BY THIS LOAN. FOR EACH OF THE
THREE (3) YEARS FOLLOWING PROJECT COMPLETION, BORROWER
SHALL COMPUTE THE COST OF THE ENERGY SAVED BY IMPLEMENTING
THE PROJECT FUNDED IN WHOLE OR IN PART BY THIS LOAN AND
SHALL SUBMIT ANNUAL REPORTS TO THE COMMISSION.
G. ALL INVOICES MUST BE SUBMITTED WITHIN SIXTY (60) DAYS OF
PROJECT
COMPLETION.
12. BUDGET
A. SEMIANNUAL PAYMENTS DUE TO THE COMMISSION UNDER THIS
AGREEMENT SHALL BE MADE FROM SAVINGS IN ENERGY COSTS OR
OTHER AVAILABLE FUNDS AS THE BORROWER CHOOSES. IF BORROWER
IS A COUNTY, CITY, TOWN. TOWNSHIP, BOARD OF EDUCATION, OR
SCHOOL DISTRICT, BORROWER AGREES THAT THE AMOUNT OF THE
SEMIANNUAL LOAN REPAYMENT SHALL NOT BE RAISED BY THE LEVY OF
ADDITIONAL TAXES AND SHALL NOT BE A CHARGE AGAINST
BORROWER'S GENERAL FUND, BUT SHALL BE OBTAINED EITHER FROM
ACTUAL SAVINGS IN ENERGY COSTS RESULTING FROM THE SUBJECT
ENERGY CONSERVATION PROJECTS OR OTHER AVAILABLE FUNDS AS
THE BORROWER CHOOSES.

B. ENERGY COST SAVINGS CALCULATIONS ARE BASED ON ENERGY USAGE
AND SERVING UTILITY RATES AT THE TIME OF THE ISSUANCE OF THIS
LOAN. CHANGES IN ENERGY USE AND RATE REDUCTIONS WHICH
OCCUR AFTER ISSUANCE OF THE LOAN WILL NOT AFFECT THE
CALCULATED ENERGY SAVINGS. THEREFORE, ALL FUNDS ADVANCED
HEREUNDER, TOGETHER WITH ALLINTEREST PAYABLE THEREON,
SHALL BE REPAID TO THE COMMISSION IN FULL AND SHALL NOT BE
FORGIVEN DUE TO A CHANGE IN BORROWER'S ENERGY USE OR A
REDUCTION IN BORROWER'S ENERGY UTILITY RATES.
13. DEFAULT
A. IN THE EVENT THE BORROWER, FOR ANY REASON, IS UNABLE TO
PROCEED WITH THE PURPOSE OF THIS AGREEMENT, THE COMMISSION
MAY DECLARE THIS AGREEMENT TO HAVE BEEN BREACHED AND BE
RELEASED FROM ANY FURTHER PERFORMANCE HEREUNDER.
B. IN THE EVENT OF ANY DEF AUL T OR BREACH OF THE AGREEMENT BY
THE BORROWER, THE COMMISSION, WITHOUT LIMITING ANY OF ITS
OTHER LEGAL RIGHTS OR REMEDIES, MAY DECLARE THE PROMISSORY
NOTE EVIDENCING THE LOAN TO BE IMMEDIATELY DUE AND PAYABLE.

14. REPORTING
A. PROGRESS REPORTS ARE DUE SEMIANNUALLY UNTIL PROJECT
COMPLETION. REPORTS ARE DUE JANUARY 31 (FOR THE JULY 1 -
DECEMBER 31 PERIOD) AND JULY 1 (FOR THE JANUARY 1 - JUNE 30
PERIOD).
B. A FINAL REPORT IS DUE NO LATER THAN 60 DAYS AFTER PROJECT
COMPLETION.
C. A PROGRESS REPORT MUST BE SUBMITTED WITH EACH REQUEST
(INVOICE) FOR LOAN FUNDS.
D. IF REQUESTED BY THE COMMISSION, BORROWER SHALL SUBMIT,
WITHIN TEN (10) DAYS OF THE COMMISSION'S WRITTEN REQUEST, A
STATUS REPORT ON ITS ACTIVITIES TO DATE, PURSUANT TO THIS
AGREEMENT.
E. REPORTS SHALL BE IN A FORMAT AS DETERMINED BY THE COMMISSION.
15. NONDISCRIMINATION
A. DURING THE PERFORMANCE OF THIS AGREEMENT, THE BORROWER
AND ITS CONTRACTORS AND SUBCONTRACTORS SHALL NOT DENY
THE AGREEMENT'S BENEFITS TO ANY PERSON ON THE BASIS OF
RELIGION, COLOR, ETHNIC GROUP IDENTIFICATION, SEX, AGE,
PHYSICAL OR MENTAL DISABILITY, NOR SHALL THEY DISCRIMINATE
UNLA WFULL Y AGAINST ANY EMPLOYEE OR APPLICANT FOR
EMPLOYMENT BECAUSE OF RACE, RELIGION, COLOR, NATIONAL
ORIGIN, ANCESTRY, PHYSICAL HANDICAP, MENTAL DISABILITY,
MEDICAL CONDITION, MARITAL STATUS, AGE, OR SEX. THE
BORROWER SHALL INSURE THAT THE EVALUATION AND TREATMENT
OF EMPLOYEES AND APPLICANTS FOR EMPLOYMENT ARE FREE OF
SUCH DISCRIMINATION.

Southern California Edison is offering a LED Traffic Signal Rebate Program effective
September 11, 2000. The program has been established to encourage the retrofit of
Incandescent Traffic Signals with LED (Light Emitting Diode) Lamp replacements to
reduce demand and save energy, The details of the program are:

· The amount of the actual incentive is dependent on the quantity of lamps
replaced. If less equipment is installed than was specified in the program
application, the incentive paid will be less than indicated. In addition, if more
lamps are installed than specified in the program application, the additional lamps
will qualify if additional funding is available.
· Lamps purchased must adhere to the Power Demand ranges as specified in the
table below. Lamps above the maximum range are not eligible the LED incentive

The LED Traffic Signal Rebate program has been established to encourage retrofit of Incandescent Traffic Signals with LED
(Light Emitting Diode) Lamp replacements to save energy. The maximum incentive amount paid will be for the purchase amount of the
material only. Spare LEOs are not eligible for incentives. Lamps purchased must adhere to the Power Demand ranges as specified in
Column A below. Funds for this program are limited and will be reserved on a first-come, first-served basis. Applications will be sent to all
parties who have reserved funds. together with a leller of confirmation. For further information, contact Carol Jester at (626) 812-7329.
This program 1$ funded by California utility cuslomet3 and administered by the state's
investor~wned utilities, under the auspices of the California Public Utilities Commiuion.

to participate in the LED Traffic Signal Rebate Program. Your reservation
form has been accepted, and $918,720 has been reserved in the City of San
Bernardino's name.
I have already forwarded you the formal application. Please complete it
at your earliest convenience and return it to me. Please keep in mind that
all work must be complete and verified prior to 6/112001 to receive the
full incentive amount. Any work completed after 6/1/2001 and prior to
12/31/2001 will be reduced by 50%. Under this program, there is no
incentive for work completed after 12/31/2001.

The following addresses your question regarding the LED visibility and how they react to direct
sunlight:
· First of all, our City already has 136 red LED heads that were installed in the last few
years (with all newly installed signals). We have not experienced visibility problem with
them
· All LED, especially the newer ones, have met the rigorous testing, specifications and
approval of Caltrans, as well as the Institute of Transportation Engineers (ITE)
· During the past five years, I have personally observed many cities converting their
signals to red LED. Among those cities are: San Diego, Chula Vista, National City,
many of Orange County cities, Los Angeles, Caltrans ramps (including our freeways),
City of Fontana, etc.
· I have spoken with the traffic engineer of Fontana. He indicated that his city has been
using them for several years, and now they are planning to achieve a 100% retrofit. He
has seen no problems associated with their usage.
· Ron Blymiller has indicated to me recently that he observed the newly approved green
LED at the 1-10 ramps at Sierra Avenue (Fontana)
· Regarding the direct sunlight, I believe the LED heads should not be any different from
conventional heads. If anything, they should be more visible due to their superior
luminance and clarity.
