STAFF REPORT
The St. Bernardine Medical Center has applied for a
permit to construct an 82,272 square foot, four-story hospital
addition, and a 160,000 square foot three-level parking
structure.

One of the conditions of approval related to construc-
tion . of traffic signals, at 21st Street and Valencia Avenue.
Another required participation in the cost of a storm drain in
21st Street.
The traffic study determined that warrants for traffic
signals would be met at Highland Avenue and Crestview Avenue,
based upon their projected distribution of traffic upon
completion of the new development. This intersection is too
close to Valencia Avenue to allow optimum spacing for
interconnection to .provide progression. Also, the warrants are
based upon projected traffic distribution, which may be
different from actual.
For these reasons, we negotiated an arrangement under
which the Center would remit the amount of $120,000 to the City
to finance the cost of installing traffic signals at one of the
two above listed intersections. However, the Planning
Commission modified the recommended conditions of approval to
require traffic signals to be installed at the intersection of
Valencia Avenue and 21st Street in connection with the
development. This condition will preclude any flexibility, and
require the City to proceed with installation of signals at this
location.
A storm drain is planned in 21st Street, from Kenwood
Avenue to East Twin Creek Channel. The Center has estimated the
cost of the storm drain adjacent to their frontage, (from
Kenwood Avenue to Valencia Avenue) at $85,000. We have
negotiated an arrangement under which they would remit $92,500
to City upon request.
The proposed Development Agreement provides, in general,
the terms and conditions for participation by the Center in the
installation of these two items of infrastructure.
We recommend that the proposed Development Agreement be
approved.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A DEVELOPMENT AGREEMENT WITH ST. BERNARDINE MEDICAL
CENTER RELATING TO CERTAIN INFRASTRUCTURE ITEMS' REQUIRED BY
CONDITIONAL USE PERMIT NO. 88-57.
BE . IT RESOLVED BY THE MAYOR AND . COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized and directed
to execute on behalf of said City a DevE1lopment Agreement with

St. Bernardine Medical Center relating to ~nstallation of certain

infrastructure items required by Conditional Use Permit No. 88-
57, which agreement is attached hereto marked Exhibit "A," and
incorporated herein by reference as fully as though set forth at
length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof, held on the

DEVELOPMENT AGREEMENT
Expansion of St. Bernardine Medical Center
THIS AGREEMENT, entered into this ___day of
, 1989, by and between the CITY OF SAN BERNARDINO, a
Municipal Corporation of the State of California, hereinafter
referred to as "CITY," and the ST. BERNARDINE MEDICAL CENTER,
hereinafter referred to as "CENTER."
WITNESSETH
WHEREAS, CENTER is planning to expand their complex by
constructing an 82,272 square foot, four-story hospital addition
and 160,000 square foot, 3-level parking structure; and
WHEREAS, expansion of CENTER'S complex has been
authorized by adoption of Conditional Use Permit No. 88-57,
subject to certain conditions of approval; and
WHEREAS, certain infrastructure items are required by the
conditions of approval, namely a storm drain in 21st Street is
needed, and traffic signals at Valencia Avenue and 21st Street,
to properly serve the expansion; and
WHEREAS, conditions of approval for CENTER'S expansion
require construction or financial participation in the City's
construction of the storm drain in 21st Street, and payment of
$120,000 to finance the cost of installing traffic signals at
Valencia Avenue and 21st Street; and
WHEREAS, CITY and CENTER do mutually desire to stipulate
the conditions under which these infrastructure items will be
constructed and how the conditions of approval will be satisfied.

NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
1. CITY shall -
a. Finance CITY'S share and construct the storm
drain in 21st Street, between San Gabriel Avenue and Kenwood
Avenue, in accordance with CITY'S Capital Improvement Program.
b. Accomplish installation of traffic signals at.
Valencia Avenue and 21st Street.

c. Submit a bill to CENTER when these projects are
advertised for bids, for CENTER'S stipulated participation.
2. CENTER shall -
a. Reimburse CITY within 30 days of receipt of a
bill for CENTER'S proportionate share of the storm drain in 21st
Street. CENTER'S share shall be $92,500.00, plus annual
increases in accordance with the cost index published each July
by Engineering News Record.
b. Remit the amount of $120,000, plus annual
increases in accordance with the cost index published by
Engineering News Record, to CITY to finance the costs that will
be incurred for installation of traffic signals at Valencia
Avenue and 21st Street. This amount shall be paid by CENTER
within 30 days after receipt of a notice from CITY. Any balance
remaining after payment of all costs incurred for installation of
the traffic signals shall be refunded to CENTER.
