STAFF REPORT
Omnitrans has submitted plans in application for a
permi t to expand their complex, on the northwest corner of
Medical Center Drive and 5th Street, by construction of a new
administration building and appurtenant facilities. Their site
extends to 6th Street, as shown on the attached plan.
There are existing overhead utility lines along 5th
Street and 6th Street. One of the conditions of approval,
established by the Developmental Review Committee, was that all
existing overhead utilities adjacent to or traversing the site
be undergrounded. This condition was imposed pursuant to Reso-
lution No. 88-65.
The Omnitrans parcel extends to 6th Street. However,
there will be no access to 6th Street. The dimensions of this
site are 586' along Medical Center Drive, and 700' along 5th
Street and 6th Street.
The letter of 4-5-89, from Mr. Robert E. Chafin,
requests a waiver for the requirement to underground the utili-
ties along 6th Street. This appeal is based upon the fact that
they will not be taking any service from this line and it is
difficult to secure the necessary funds from 13 cities and the
County. A reference is made to the Subdivision Ordinance, Title
18 of the Municipal Code. This code section does not apply,
since there is no application for subdividing the parcel.
The site meets the criteria set forth in Resolution No.
88-65 for undergrounding utilities. The voltage of the line
along 6th Street is under the limit prescribed in the resolu-
tion. Therefore, there is no basis for granting a waiver from
the requirement to underground utilities.
In view of the absence of authorization to grant a
waiver, we recommend that the request be denied.

Re: OMNITRANS Metro Facility - RP 88-120
Dear Mr. Hardgrave:
We have been advised by the City's Planning Review Commit-
tee that OMNITRANS will be required to place all existing over-
head utility lines underground, when constructing the above
referenced facility.
This letter is written to request a waiver of this require-
ment, with respect to the overhead utility lines, along our nor-
thern property line boundary at Sixth Street.
Our architects, Ruhnau, McGavin, Ruhnau/Associates, have
designed the proposed project to be located immediately north of
Fifth Street, at the approximate center of our existing parcel.
Accordingly, all power will be taken from the Fifth Street side
0f our property. Based upon this design criterion, we do not
f0resee a problem with securing the necessary funding for under-
ground utilities along Fifth Street.
We do see a serious problem in obtaining funding for the
placement of underground utilities along Sixth Street. The
utilities along this street serve single facility dwellings
across Sixth Street, and to the north. As such, these utilities
are outside of the project area, and do not provide any direct
benefit or value to the project.
As a public agency, OMNITRANS has been required to generate
Board based support from 13 cities, the County of San Bernardino,
and the Federal government, to construct the proposed facility in
the City of San Bernardino. The approximately $3,500,000 cost of
construction, will be shared on the basis of 80% Federal, and 20%
local funding. Since all Federal funds have been programmed for
the next five years, we would be required to request the addi-
tional funds, for placement of underground utilities along Sixth

Street, from all of our local agencies, including the City of San
Bernardino. We do not feel that a request of this nature is ap-
propriate, particularly in view of the many benefits this facil-
ity will add ,to the immediate area and to the Westside of the
City of San Bernardino.
Although Resolution No. 88-65 requires that all existing
overhead utility lines be placed underground, the City of San
Bernardino's Subdivision Ordinance, Title 18, Subsection 18.44.
070 states that.
"This subsection shall not apply to telephone trans-
mission lines or electric transmission lines, or other
lines which do not provide service to the area being
subdivided; ..
We request that our project be considered in the same
manner as a subdivision, and that a waiver of this requirement
be granted, particularly in view of the fact that, like the sub-
division, the utility lines in question, will not provide ser-
vice to the project.
