11-19-79 Planning Conunission's reconunendation for denial of Tent-
ative Tract No. 11118 rejected.
Final Map for Tract No. 11118 approved.
Finding made that the encroachment of private facilities
in street right-of-way is in violation of City standards
and property owners directed to remove said encroachments.
-- Hearing to reconsider order to remove all encroachments
closed; directed that encroachments be reviewed to deter-
mine if they constitute either a hazard or hindrance, and
continued to 12-19-88.
-- Report on encroachments received and filed, and matter
referred to Legislative Review Conunittee for a reconunenda-
tion.

STAFF REPORT
At their meeting on 3-23-89, the Legislative Review Com-
mittee considered the matter of unauthorized encroachments
within the street right-Of-way for Meyers Road and Meyers Court,
within Tract No. llll8. Letters from the City Attorney and
Director of Public Works/City Engineer were reviewed.
Consideration was given to vacating the right-of-way to
the curb line. This was rejected due to potential problems with
pedestrians access, controlling the height of other encroach-
ments in the future, and interferences with utility companies'
operations.
After carefully considering all available options, the
Committee adopted a motion, or a 2 to I vote, that the unauth-
orized encroachments be removed from the street right-of-ways.
At the Legislative Review Committee Meeting of 5-4-89, a
recommendation was adopted on a 2 to 0 vote that the parkways be
vacated, with utility easements reserved as appropriate.
Adoption of the form motion will authorize this process to be
started.
