STAFF REPORT
A new office building is being developed on the
northwest corner of Lena Road and Tennis Court Lane. There is
an Edison pole line along Lena Road. Since the parcel is in
excess of 1 acre, the requirement to underground this utility
line, as set forth in Resolution 88-65, will apply.
Section l, B, (2), states that the Director of Public
Works/City Engineer may accept a cash payment from the
developer, in lieu of immediate undergrounding, for any
development with a frontage less than 300 feet. This parcel's
frontage along Lena Road is less than 300 feet. Edison has
provided an estimate of about $25,000 for this undergrounding.
There is only one utility pole adjacent to this parcel that
would be removed by undergrounding.
Other options are set forth in Sub-Sections (3) and (4).
Sub-Section (3) provides that any developer may elect to enter
into an agreement to defer the undergrounding by making semi-
annual payments over five years.
Another option outlined in Sub-Section (4) is for the
developer to petition the City to establish an assessment
district. The developer has selected this option by submitting
a letter of petition, dated 2-2-89. A copy of this letter is
attached for reference.
Establishment of an assessment district would allow the
City to initiate the undergrounding at any time. Thedistrict
would assess the property onwer of the actual costs incurred.
Since it would not be feasible to sell bonds for a district of
this size, the City would have to up-front the funds from the
Assessment District Reserve Fund.
The available options are:
1. Require the developer to underground.
2. Accept a cash deposit of estimated cost.
3. Enter into an Agreement.
4. Establish an assessment district.
We recommend that the assessment district option be
approved, since there is no limit on the cost which makes this
process inflation proof. The undergrounding could be done at
,) ny time the City chooses, but normally would be deferred until
a sufficient number of parcels were included to make a
reasonable size distri~t.

with this district. Otherwise, the development may not be able
to proceed and the City could miss the opportunity to underground

Dear Mr. Hardgrave,
We are under construction on a building at 250 South Lena Road,
San Bernardino and are informed that we must underground Edison
facilities, therefore, per City Resolution #88-65, we would
respectfully request that an improvement district be established
for the undergrounding of electrical utilities on South Lena Road
in San Bernardino. Reading the resolution we think that this
request fulfills the requirements, however, if we need to provide
you with additional information to effectuate this improvement
district please let us know.
