Audit Trail II is a listing of recommendations made by the
Planning Commission as a result of Land Uses requests made at
the April Planning commission Public Hearings on the Draft
General Plan. These requests came from members of the
public, staff and council members. The applicant's name,
request, site, location and Planning Commission recom-
mendation are listed.
Audit Trail II is divided into 12 discussion areas as shown
on the attached map. since individual requests were numbered
according to order of presentation to the Planning Commis-
sion, they are not sequential within each discussion area.
The discussion area number is indicated at the top of the
page. The column labeled "Recommendation Planning
Commission" indicates the Planning Commission recommendation,
the action date, and the motion number. Motion number 132
was used for all requests where no other motion was made for
a specific change. It constitutes a denial of the requested
change, thereby leaving the existing designation as is.

The master pJ.an currently has us placed under R U zoning. We would lilte
to request the zoning contained in the zoning maps which establishes the
front of the parcel as Commercial and the rear as residential (RU). OUr
neighbors, the McGrewB, at 2358 Kendal.l would like to change their audit trail
of RU to HM , over to the same zoning we are requesting. ~8 audit ilrail
now encompasses the entire 300 feet frontage of the interseotion node of
Kendall Drive and Pepper L1n4en Drive, next to the nood control channel. A
depth of 120 feet from the property line would include the activities of the
:reed Store at present. Shoulcl the Ma,yor and Council decide that this line be
moved in either direction, then so be it. It shoul4 be noted that said
properties have approximately 200 feet up the side of the foothill.
Dllring the planning commi88ion hearings a condi tionel. use permit was
established for all the 00-3 in the foothills below us. ~s was iza, order
to maintain unlversi ty and residential conformance to the developement there.
Should the Mayor and Council deoide a CUP is warranted here to assure
University and residential. conformance, then so be it. We have no problem
wi th this. AllY RD developemant that could take pJ.ace is already standardized
in the Verdemont Guide.
In s'tudying the IIlaBter plan map, 1 t appears to be the policy to have I
commercial in corridors end intersection nodes throughout the oi ty. I would
lilte to suggest that our audit trail is in conf01'lllance with this policy.
Between University ParkwaY end the Feed store there are two apartment com-
plexes. These are separated by three lots, one vacant and two with houses.
Under RD these apartment compl..es are existing non-conf01'lllities. As such
this BM developemant would have to be brought 1I1to conformance if they were
sold, destroyed or what have you. !his is not the case, however. We cannot
find anywhere 111 the text where au zoning versus BM 4evelopement in con-
formance. ~s being the case, spot zoning is what the RD has done to this
section of J:endall Drive. You are 111 five transition zones from Uni versi ty
ParkwaY, before you even get to the :reed Store. 00-3, RD, BM' RD and lUt\again.
fb1s explains why the owners of the RM properties have not filed an audit
trail against RD end for HM. Again, we belleve thais audit trail is in
conformance with the policies of the Master plan. Spot zoning is a proble
for down the street.

NINTH AND "F" STREET INTERSECTION FACT. SHEET

The traff~c count, as measured by the City Traffic Engineers'
office on April 6, 1988 (Wednesday) was 20,291 cars passing
through this intersection daily. Averaged over 24 hours= 14 cars/min.
,
The block bounded by Ninth, "E" Street, "F" Street, and
Union street was subdivided before 1890 into lots ranging
in size from 3760 sq. ft. to 11,250 sq. ft, with most lots
either 7125 sq. ft or 10687.5 sq. ft.
This area was designated for Commercial use on 'the General'
Plan in effect during the 1970's, when San Bernardino was
awarded "All-American City" recognition. This recognition
was partly based upon the General Plan and growth projections
in effect at that time.
The Residential zoning in eftect between the 1940's and
the transitional zoning of the 1950's allowed tor densities
of at least 28 du/acre.
The RM designation propo.ed for this area, combined with the
minimum lot~sizes required for this density, would result in
the necessity for combining two SOx142.5 lots to b~ able to
build four dwelling units. This minimum size requirement
would not allow a duplex on the average single lot.
A member of the San Bernardino Board ot Realtors was unable
to find any evidence of market interest or movement for vacant
residential property in this area as of May 9, 1989.
Planning Director Brad L. Kilger was quoted in the Sun on
May 10, 1989, as saying that "Studies show the city ---nas an
abundance of low-and moderate-income housing."
The General Plan Draft Proposal, in '11.7.13, lists Ninth Street
as a recognized "commercial district."

I purchased this property in 1968 from the Grace Baptist Church
that operates a private primary school and school playground
adjacent to this property. This property has been improved with
curb and gutters and has a substantial frontage on a twenty-five
foot (25') alley along the San Bernardino City limit line. This
parcel has 180' frontage on Ferndale and a depth of 247' with
approximately 44,460 sq. ft.
The preliminary general plan land use category as RS (single-family
residential units-4.5 DU/NET ACRE) is not compatible or economical
to the land costs and utilization to the adjacent properties.
1. The configuration of the land parcel would only allow 4 or 5
single-family homes that would require at least two of those
units to front on the alley with 180' lot depth.
2. The current price of land the land cost recovery would require
that a $145,000.00 home be built on this property. As land
costs increase the economic feasibility cannot support the land
use recommendation.
3. The present developed land on the west and south are multi-family
units and the adjacent school playground and its noise would not
lend itself to single-family dwelling units as a compatible land
use.
4. I have been involved for over 35 years in the design, development
of construction of many real estate projects. Primarily in the
residential housing market. Based on my experience I am
thoroughly convinced that the land use designation of RS single-
family detached owner occupied housing is wrong for this parcel.
None of the lenders I have worked with in the past would even con-
s1der funding detached housing on this site. Even if financing
could be secured, who would buy a home literally surrounded by
rental apartments? Would you?
I am aware of the concern in this community about multi-family
dwelling units, however, an upscale multi-family dwelling units
;L~(~ DU/NET ACRE} is not inconsistent with the surrounding developments,
the general area and the adjacent private school activity. The proposed
RS designation would ensure that this land is undeveloped and remain
vacant for years to come.
I urge you to designate this property as RH so that the land could
be made productive in the near future and contribute to the future
growth of San Bernardino in a positive manner.

In regards to our telephone conversation in February 1989, I
contacted Mrs. Margerite Evans concerning our property located on
"H" Street. In my conversation with Margerite, she informed me she
would like to have a RMH-18 DulAc, the same zoning the property has
carried for years!
A little over one year ago, my property located on the northeast
and southeast corners of Magnolia and "H" street was approved for a
four unit and twelve unit apartment complex. After spending approx.
$10,000.00 on plans, soil test and etc" Building and Satety told
me the IPD was in place and my property no longer conformed to plan.
As per your advise, I attended the Commission and Staff meetings
held on Monday 10th, Thursday 13th and Saturday 15th, April, 1989.
On Saturday I spoke to the Commission requesting they change my property
trom RM to RMH-18 DulAC. On Monday April 17th 1989, I attended another
meeting and the vote was 3 to 3, so it remained as per Draft General
Plan, RM.
Having already spent approx. $10,000.00 and to take a 4~ land
use decrease, it would make it impossible tor me to develope my
property. Anything you can do to help me would be appreciatedl

Since I am ninety one years old, it is impossible for me to
attend your meetings on land use. I have some property in your ward
and the city of San Bernardino. Between myself and. Mr. Robertson of
San Bernardino, we own all the vacant land between Magnolia and 16th
St. on the east and west sides of the street.
I know Mr. Robertson has tried to develope his property within
the last two years, but was told the property no longer conformed to
the new draft General Plan.
Since my property has carried a zone of R-) 1200, I would like
the new zoning to give me the same density as R-) 1200. Since the
Planning Commission approved a zoning of RMH 15 DulAc on Monday night,
I would like my property zoned the same.
Anything you and the other council members can do to preserve
my property value will be appreciatedl

This letter is sent in response to a request by the City Council to prepare a
written summary of the testimony given by David Schulze before the Council in
session, un May 10, 1989, San Bernardino City Hall, California.
The San Bernardi no Va 11 ey Board of Realtors, through the Chai rman, Local
Governmental Relations Committee, made comments, recommendations and sugges-
tions relative to the General Plan being considered for adoption as follows:
II The Board of Realtors was delighted and excited to learn of the use added
in Paragraph 1.25.10 for "commuter rail and parking facility." We
reguest that the members of the City Council, as our duly elected repre-
sentatives, encourage and support efforts to establish and promote
commuter rail travel as an alternative to the use of private automobiles
for travel to and from jobs in communities west of the City of San
Bernardino.
2l The Board of Realtors recommends that the language of Paragraph 1.30.10,
page 106, be changed to read:
"Accommodate retail, service and office commercial uses, new and used
automobile and truck sales and repair facilities, lumberyards and related
building materials and hardware sales, plant nurseries, light industrial
manufacturing and storage facilities, and similar uses which require
extensive outdoor or indoor space for their sales, service and or
storage, excludin~ neighborhood commercial, in areas designated
o Commerc i a 1 Heavy ."
This suggestion is to clarify the intent of the many attempts to modify
the language of this paragraph taken from prior public testimony before
both the Planning Commission and the City Council.
3l The Beard of Realtors is concerned that the proposed Zoning Designation
"IL" for the areas bounded by Mill Street to the North, Inland Center
Drive to the South, and 1-215 to the West (a trianglel will not accommo-
date the current uses and could not allow future expansion of those
existing uses which prove successful.

This area would benefi t fl'om the CH Designation, however, due to the pro-
visions of the South City Study Area Ordinance passed some years ago, it
is not possible to simply change the design&tion in the General Plan
under consideratiun.

We recommend that the City Council direct staff to study this concern .and
make a proposal which could designate the area "CH" usage while rescuin9
a majority of the effort and expense already committed to the ordinance
now in place.
4) It is our understanding that Section 65850.2 of Title 7 of the Government
Code, State of California makes it incumbent on a local jurisdiction to
accept and process an application for a second dwelling unit, made by an
owner of a parcel of land zoned residential or multi-family residential,
and to issue a permit to construct such a unit with certain limitations.
OUT Draft General Plan is now silent in this provision of State Law. The
consensus of the Realtors in San Bernardino County appears to favor inclusion
of provisions for development of "Granny Flats" within any Community General
Plan created now that the law exists. Failure to provide for this special
ty~e of housing will cause confusion among the members of the public and
among planning staffers, which could lead to the frustration of efforts to
create "Granny Flats."
Recent exp;lr.j ence wi th a program ca 11 ed "DUO" (Double Un i t Opportuni ty) i ni-
tiated by Marin County, in Northern California, developed some interesting
statistics. Forty-two percent of those making application to build such hous-
ing were single female households and a survey of rents charged for those
units rented showed rental rates to be $150 per month below Section 8 rates for
equivalent housing. What resulted is affordable housing with a significantly
greater quality of living than that offered by a similar unit (size) in a
conventional apartment complex.
We appreciate the opportunity to participate in the development of the new General
Plan for the City of San Bernardino. We hope our efforts contribute construc-
tively to the process and will help to form the final draft of this important
document.

SUGGESTED REVISIONS TO
CITY OF SAN BERNARDINO GENERAL PLAN

from CHAMBER OF COMMERCE
Since the time of the Citizens Advisory Committee hearings the
San Bernardino Area Chamber of Commerce has actively participated in
the General Plan process. Representative of the Chamber have
repeatedly conveyed the attitudes and concerns of the business
community at C.A.C., Planning Commission and City Council meetings.
We are pleased to acknowledge that some of our suggestions have
been incorporated into the Draft General Plan. We are equally
concerned that there are parts of the proposed plan which continue
to create problems for our
members.
We have prepared a list of further recommendations for change
to the Draft General Plan now being reviewed for adoption. We hope
the City Council will give careful consideration to each of our
suggestions. Our members, the independent business people of this
City, believe the Plan needs to be modified as recommended to
provide a healthy environment for local business and improve the
quality of life for all residents of our community.
Issue 1
page 69 - 1.13.13 Provide 100 percent density bonus for
senior citizen housing.
Provides a greater incentive to build senior housing
for our ageing population. Density bonus should be
consistent throughout the City. Senior units are smaller
and therefore little increase in building size will be
distinguishable.
page 69 - 1.13.30 Delete reference to minimum lot size for
RM District density.
There is a need for small-scale rental housing and
single lot projects should enjoy the same density
of development as large projects.
page 69 - 1.13.31 Delete reference to minimum lot size for
RMH District density.
Incentives must be created for individual property
owners to rebuild older neighborhoods throughout the
city by providing the opportunity through zoning to
create small-scale income producing property.

Self-storage was previously permitted in the General
Commercial zone. Self-storage should be convenient to
the places where people live and to where they operate
offices and businesses rather than limited to industrial
areas. Proper design criterion can insure a good blending
with other commercial uses.

Hotels are private enterprise businesses differing from

General Plan. Do not include single - family homes
as "sensitive facilities" subject to a 100 ft. fault
set-back.
The 50 ft. set-back has been the standard in the
State of California since the creation of the
State Law. No geologist has provided a convincing
argument for a greater set-back on all structures.
Special site-specific conditions have always been
addressed by individual engineering recommendations
and should remain so.

Dear Mr. Minor:
We wish .to formally object to the application of the hi Ilside
zoning overlay restrictions to our property. The subject
property was approved 46 unit subdivision by the city in 1979
as a part of the development of the golf course area. The
application of the hillside zoning to this parcel at this time
will be a down zoning which will result in not only an economic
hardship to ourselves, but a considerable loss of tax base to
the Redevelopment Agency.
This property is contiguous to the Shandin Hills Golf Course
which is a source of revenue to the city. As owner and operator
of the golf course, ! am especially concerned that any develop-
ment should be complimentary to that facility. Furthermore,
this development would provide for a substantial increased tax
base for the redevelopment project area.
We have attended numerous meetings regarding the general plan
update and were told by the staff as late as January 1989 that
the staff had no problem with the original zoning and development
of the subject property.
We purchased the above referenced property on March 24, 1987 for
the following reasons.
1) The property's relationship to the golf course.
2) The proposed development which was approved for 46 units
would not only enhance this area, but would also provide
additional golfers to Shandin Hills.
3) The proposed project and product which would be contained
within a gated and secured environment would be the highest and
best use for the subject property and furthermore, would be a
complimentary planning element to the existing subdivision on
Bond Street.

appeared before the Council on April 26 at which time the
Planning staff recommended an RS des~gnation and the
Council adopted it. On Apr~l 28, 1988, he went to the
Moratorium Exemption Comm~ttee and found to his surprise
that a group of homeowners was present to appeal the
project. Several issues were raised by surrounding
property owners.
Mr. Carr addressed each of the issues and explained
how the tract met all the requirements of the City. Also,
he has received a letter from the school district stating
the distr~ct can support the proJect. He added that all
lots in the proJect are larger than the ZOO units to the
south and the lots are 7900 square feet. This is not a
custom home area. It is for econom~cally pr~ced housing.
Mr. Carr stated he made agreements with the City to
prOVide an oversized sewer line to service the area to the
north and he will be putting it in, but this is the fifth
time this proJect has been before che Planning Department
and City Counc~l. It has been approved and reapproved for
R-1-7200 and meets and exceeds the des~gn s~andards for
the City. He stated he does not buy the argument that
single family houses are not compatible with single family
houses, especially s~nce his project has larger lots.
John Musial, 15010 Avenue of Science, Su~te 105, San
Diego, was present to represent Henry Bickler and the
Hawley family who are the owners of property Just north of ,
Shandin Hills Golf Course.- He requested that a parcel of
vacant land, at .the 'northern end" of Bond Street be
redes~gna~ed with PRD standards which would permit the
clustering of units.' He requested,.that""a .46 unit
duplex-type proJect, 'approved C in 1980," be approved for
resubmi~tal. The prev~ous map expired because of

In November, 1988 I purchased 9 lots (93,000 sq. ft.) zoned
C-3A intending to build a full service car wash. Proposed zoning
changes would split my property into approximately North 1/4 CG-1
and South 3/4 RM. My plans for the car wash require a layout
that uses all my property, not just the north 1/4. To the West
of my property is a Church and its vacant land. To the South is
a Flood Control Channel.
To the East is " Mobil Gas Station.
To the North is a public Mini Storage. With these uses bordering
my property, I feel my plans are appropriate for this area and
splitting my property into CG-1 and RM is not. Since my proper-
ty encompasses 9 of the 15 lots on this block, was purchased
zoned C-3A with plans to build in conformity to C-3A, I see no
reason to now change it to RM.

I am sure a notice had been sent to E.J. and Raquel B. Fisher, owners of
the above property, and I want to apologize for not having the time to
answer this most serious problem sooner.
This property was purchased as commercial property in 1978, a business was
moved into this location owned by E.J. and Raquel Fischer. The name of
the business is THE BIG K-KEDCO CORPORATION.
A small business which employs 7 San Bernardino residents. Our future plans
for expansion and our dreams of becoming San Bernardino's largest company
is now in Jeopardy. Our ON THE JOB TRAINING program with the city of San
Bernardino is in jeopardy.
A business 38 years old, designed to continue to grow, is in jeopardy.
Our financial problems will only increase.
As a resident of San Bernardino for 25 years, and a property owner, I have
a serious concern about this new zone change.

STATEMENT TO THE SAN BERNARDINO CITY COUNCIL REGARDING THE
REVISED GENERAL PLAN. MAY 13, 1989
The League of Women Voters of San Bernardino commends the
Planning Staff and the Citizens Advisory Committee for the
work they have done on revising the city's general plan. The
dedication of the members of the Citizens Advisory Committee
is particularly worthy of mention and appreciation.
However, it appears that the CAC has not been consulted about
the many changes that have been made recently. Furthermore,
we wonder if the changes are counter to recommendations made
by the CAC, whose members are broadly reflective of community
views on the city's future. In addition, there are too many
changes to evaluate carefully, considering that the revised
portions are usually not available far enough ahead of the
hearings. We would hope that you will consider extending the
public comment period as the County did to avoid problems
caused by inadequate review of the plan.
We also question whether the plan adequately addressed
concerns we raised last year. One concern was that the plan
be based on consideration of not only economic impacts, but on
social and environmental impacts as well. We wonder if enough
attention has been paid to social and environmental impacts.
We wonder whether adequate consideration has been given to
funding expansion of public facilities and services and
improving the city's aging infrastructure.
The open space designations in the plan fall far short of
standards for a city of this size. A related issue is
housing, especially the effects of allowing higher densities
in some areas of the city. Has enough consideration been
given to where housing opportunities can be increased to
reduce impacts? Another League concern is housing for the
homeless. The plan seems to emphasize the private sector's
role in meeting this need. We believe there is a need for
more public sector involvement as well, especially in the
provision of emergency shelter.
The plan is too complex and too long to comment on every
aspect of it. Our overall concern is that the plan be a
blueprint for orderly growth which above all, considers the
quality of life of the people who live and work in San
Bernardino. It is critical that the City Council be committed
to adopting policies which will contribute to achieving this
goal.

WE at Moran Meat Company are a processor of ground beef. In
that process, we receive boneless beef with different levels of fat
to lean ratios, whereupon, we grind and mix these different ratios
to achieve various fat to lean ratios and package it in bulk or in
hamburger pattie form. We also distribute pre-sanufactured rest-
aurant supplies.
There is, nor will be, any live animals processed in this
facility.
It is because of USDA requirements that we have an enclosed
shipping dock in order to facilitate storage of such boneless beef
products, which is the project we are currently undertaking.
The other establishments that are included in this parcel of
land are Bell Industries, which is solely a Wholesale distributor
of air conditioning products and the other is Peppertree Foods,
associated with Baker's Drive-Ins, which is a wholesale distribution
and warehousing of foods and related products.
