STAFF REPORT
~
This is to request that the Commission authorize execution of a $48,300
contract with Charlie Ray Gann Demolition for demolition services at 240 South
"E" Street.
BACKGROUND
On March 13, 1989, the Commission authorized staff to issue an Invitation for
Bids for demolition services at 240 South "E" Street in order to eliminate a
number of health and safety problems which have created substantial liability
risks for the Agency. An Invitation for Bids was issued on March 16, 1989 and
advertised in The Sun from March 21 through March 30, 1989. In addition to
The Sun, ads were also placed in the Allied Construction Industry (ACI) and
F.W. Dodge Construction papers. Ten bid packages were requested from
potential bidders, and a total of four bids were received prior to the filing
deadline of 10:00 a.m. on April 3, 1989.
The four bids received were as follows:

~ Based upon the four bids received, it is recommended that the Agency accept
the lowest bid of $48,300 from Charlie Ray Gann Demolition, which is $41,700
or 46% less than the initial estimated demolition cost of $90,000. A
background check has been conducted by staff and indicates that the firm is
qualified and has performed similar demolition work in a satisfactory manner.
The attached contract for demolition services has been approved as to form and
legal content by Agency Counsel, and signed by the contractor.
The Redevelopment Committee reviewed this matter at its April 6, 1989 meeting
and recommended approval. To implement the demolition services, it is,
therefore, requested that the Commission authorize the execution of the
attached $48,300 contract with Charlie Ray Gann Demolition.

CONTRACT AGREEMENT
This Contract agreement Is made and entered Into for the project
described herein this ____ day of , 19___, by and between
the REDEVELOPMENT AGENCY FOR THE CITY OF SAN BERNARDINO (Agency> and
CHARLIE RAY GANN DEMOLITION (Contractor>. WITNESSETH that Agency and
Contractor have mutually agreed as follows:
ARTICLE I
This Contract Agreement for the aforesaid project shall consist of this
Agreement and the Notice Inviting Sealed Bids, Instructions to Bidders,
Proposal, General Specifications, Standard Specifications, Special
Provisions, plans, and all referenced specifications, Insurance
requirements, details, standard drawings, and appendices and all
required bonds and insurance certification, hereinafter referred to as
"contract documents." This Contract Agreement may be amended in writing
in accordance with the provisions in the Specifications.
ARTICLE II

For and In consideration of the payments and agreements to be made and
performed by Agency. Contractor agrees to furnish all materials and
perform all work required for the above-stated project, and to fulfill
all other obligations as set forth in the aforesaid contract documents,
for the agreed amount of FOURTY EIGHT THOUSAND THREE HUNDRED Dollars
($48,300.00> .

ARTICLE I II
Contractor agrees to receive and accept the prices set forth In the
Proposal as full compensation for furnishing all materials, performing
all work, and fulfilling all obligations hereunder. Said compensation
shall cover all expenses, losses. damages, and consequences arising out
of the nature of the work during its progress or prior to its acceptance
and any applicable warranty period including those for well and
faithfully completing the work and the whole thereof in the manner and
time specified In the aforesaid contract documents; also Including those
arising from the actions of the elements, unforeseen difficulties or
obstructions encountered in the prosecution of the work, and all other
unknowns or risks of any description connected with the work.
ARTICLE IV
Agency hereby promises and agrees to employ, and does hereby employ,
Contractor to provide the materials, do the work and fulfill the
obligations according to the terms and conditions herein contained and
referred to, for the prices aforesaid, and hereby contracts to pay the
same at the time, in the manner, and upon the conditions set forth In
the contract documents.

ARTICLE V
Contractor acknowledges the provisions of the State Labor Code requlrlng
every employer to be Insured against liability for worker's compensation,
or to undertake self-insurance in accordance with the provisions of that
~ code, and certifies compliance with such provisions.
ARTICLE VI
Contractor agrees to indemnify, defend and hold harmless Agency and City
of San Bernardino and all of their officers and agents from any claims,
demands, or causes of action, Including related expenses, attorneys fees,
and costs, based on, arising out of, or In any way related to the work
undertaken by Contractor hereunder.
ARTICLE VII
Contractor affirms and warrants that the signatures, titles, and seals
set forth hereinafter In execution of the contract Agreement represent
and bind all entities, individuals, firm members, partners, joint
venturers, and/or corporate officers having a principal Interest herein.
IN WITNESS WHEREOF, the parties for themselves, their heirs,
executors, administrators, successors, and assigns do hereby agree to the
full performance of the covenants herein contained and have caused this
Contract Agreement to be executed In quadruplicate by setting hereunto
their names, titles, hands, and seals.
