On Oclober 6, 1993, Governor Pete Wilson signed into law Assembly Bill (AB) 1290, also known as
the California Community Redevelopment Law RefoDll Act of 1993. AB-1290 was authored to
address pen:eived major abuses and problems in redevelopment pmctice, and to refocus the
redevelopment process on statewide concerns of alleviating blight, stimulating economic development,
and providing affordable housing. Another major objective of AB-1290 is the establishment of
financial limits and related issues relative to redevelopment plans.
Analvsis
For redevelopment projects which are adopted on or before December 31, 1993, AB 1290 added
limitations as to the time limit on: 1) establishing indebtedness; 2) effectiveness of the redevelopment
plan; 3) repayment of indebtedness; and 4) commencement of eminent domain proceedings. In
('_ accordance with the AB-1290 legislation, the Agency must anend its redevelopment plans in order to
\-..- address these issnes. The major effect of the AB-1290 Plan Limitations are as folIows:
Agencies will be restricted in the amount they can refinance, refund, or
restructure to the amount of outstanding indebtedness and cannot extend
the time to repay any refunding past the time limit to repay indebtedness.
111e main purpose of this amendment is to allow agencies to receive the
benefit of refinancing bonds when interest mtes decline significantly from
the interest mte in the original bond issue. Such an action would likely
benefit not only the agency, but also other affected taxing entities. This
would occur because agencies would require fewer total tax increment
dollars to retire a debt when the interest paid is reduced.
The attached ordinances address the necessary plan amendments for the following project areas:

It should be noted that the plan amendments are administrative modifications only, and do not affect
the scope or intent of the redevelopment plans. Staff anticipates submitting an agenda item early next
year which will call for plan amendments to bring the various redevelopment plans in confOlmance
with the City's General Plan.
As required by State law, a second reading of the attached ordinances will be scheduled for the
December 19, 1994 Mayor and Common Council meeting.

Based on our in-house information on you Agency's Redevelopment Project Areas, we have
outlined the limitations imposed by AB 1290. For existing, amended, and merged plans, AB
1290 imposes three (3) new statutory limitations: (1) a deadline for incurring debt; 12} a
deadline for carrying out redevelopment plan activities; and (3) a deadline for the receipt of
tax increment. Additionally, for redevelopment plans that have been merged or amended to
add territory (prior to December 31, 1993), time limits are applicable to each from the date
of adoption of the original plan and the date of adoption of the added territory.

8 approved the Redevelopment Plan for the Central City Project No.
9 1 Redevelopment Project (the "Redevelopment Plan"); and

11 WHEREAS, the Mayor and Common Council of the city
12 of San Bernardino (the "city Council"), approved and adopted the
13 Redevelopment Plan pursuant to a duly enacted Ordinance on

Community Redevelopment Law has established certain limitations
on the incurring and repaying of indebtedness and the duration of

WHEREAS, section 33333.6 further provides that
unless a redevelopment plan adopted prior to January 1, 1994,
already contains limitations which comply with that section, the
legislative body shall adopt an ordinance on or before December

do not exceed the provisions of that Section.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:
section 1. Notwithstanding any other provision of
the Redevelopment Plan (as amended), to the contrary the
Redevelopment Plan is hereby amended such that the provisions of
the Redevelopment Plan shall be effective until January 1, 2009.
Section 2. A new subparagraph is added to the
end of section C of the Redevelopment Plan entitled "Limitations"
which shall read: The Agency shall not pay indebtedness or
receive tax increment revenues pursuant to Health and Safety Code
33670 after ten (10) years from the termination of the effective
date of the Redevelopment Plan.
Section 3. The City Clerk is hereby directed
to send a certified copy of this Ordinance to the Agency.

Effective Date.

shall be in full force and effect thirty (30) days after its
passage.

6 section 1. Section IX of the Redevelopment Plan
7 which establishes the time limit on the effectiveness of the
8 Redevelopment Plan is hereby amended in its entirety to read as
9 follows: "Except for the non-discrimination and non-segregation
10 provisions, which shall run in perpetuity, the provisions of this
11 Plan shall be effective and the provisions of other documents
12 formulated pursuant to this Plan may be made effective for forty
13 (40) years from the date of adoption of this Plan by the Mayor
14 and Common Counsel of the City of San Bernardino.

ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
CENTRAL CITY SOUTH REDEVELOPMENT PROJECT
WHEREAS, the Redevelopment Agency of the City of San
Bernardino (the "Agency"), has formulated, prepared and approved
the Redevelopment Plan for the Central city South Redevelopment
Project (the "Redevelopment Plan"); and
WHEREAS, the Mayor and Common Council of the city of
San Bernardino (the "city Council"), approved and adopted the
Redevelopment Plan pursuant to a duly enacted Ordinance on May 3,
1976; and
WHEREAS, Section 33333.6 of the California community
Redevelopment Law has established certain limitations on the
incurring and repaying of indebtedness and the duration of
redevelopment plans,
which
limitations apply to every
redevelopment plan adopted on or before December 31, 1993; and
WHEREAS, section 33333.6 further provides that unless
a redevelopment plan adopted prior to January 1, 1994, already
contains limitations which comply with that section, the
legislative body shall adopt an ordinance on or before December
31, 1994, to amend the redevelopment plan either 1) to amend an
existing time limit that exceeds the applicable time limit

4 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN

7 section 1. The provisions of this Ordinance shall
8 supersede any prior amendments to the Redevelpment Plan.

10 section 2. section IX of the original Redevelopment
11 Plan which establishes the time limit on the effectiveness of the
12 Redevelopment Plan is hereby amended in its entirety to read as
13 follows: "Except for the non-discrimination and non-segregation
14 provision, which shall run in perpetuity, the provisions of this
15 Plan shall be effective and the provisions of other documents
16 formulated pursuant to this Plan may be made effective for forty
17 (40) years from the date of adoption of this Plan by the Mayor
18 and Common Counsel of the city of San Bernardino.

20 section 3. A new paragraph shall be added to
21 Subsection B of section VI of the Redevelopment Plan to read as
22 follows: "The Agency shall not pay indebtedness or receive
23 property taxes pursuant to section 33670 after ten (10) years
24 from the termination of the effective date of the Redevelopment
25 Plan" .
26 section 4. The city Clerk is hereby directed to
27 send a certified copy of this Ordinance to the Agency.

WHEREAS, the Redevelopment Agency of the City of
San Bernardino (the "Agency"), has formulated, prepared and
approved the Redevelopment Plan for the Southeast Industrial Park
Redevelopment project (the "Redevelopment Plan"); and

11 WHEREAS, the Mayor and Common Council of the city
12 of San Bernardino (the "city Council"), approved and adopted the
13 Redevelopment Plan pursuant to a duly enacted Ordinance on June
14 21, 1976; and

WHEREAS, section 33333.6 of the California
Community Redevelopment Law has established certain limitations
on the incurring and repaying of indebtedness and the duration of
which
limitations
redevelopment plans,
apply to every
redevelopment plan adopted on or before December 31, 1993; and

WHEREAS, section 33333.6 further provides that
unless a redevelopment plan adopted prior to January 1, 1994,
already contains limitations which comply with that section, the
legislative body shall adopt an ordinance on or before December
26 31, 1994, to amend the redevelopment plan either 1) to amend an

3 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
4 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

6 section 1. section IX of the Redevelopment Plan
7 which establishes the time limit on the effectiveness of the
8 Redevelopment Plan is hereby amended in its entirety to read as
9 follows: "Except for the non-discrimination and non-segregation
10 provisions, which shall run in perpetuity, the provisions of this
11 Plan shall be effective and the provisions of other documents
12 formulated pursuant to this Plan may be made effective for forty
13 (40) years from the date of adoption of this Plan by the Mayor
14 and Common council of the city of San Bernardino.

16 section 2. A new subparagraph "D" is added to
17 Section VI of the Redevelopment Plan entitled "Limitations" which
18 shall read: The Agency shall not pay indebtedness or receive
19 property taxes pursuant to section 33670 after ten (10) years
20 from the termination of the expiration date of the Redevelopment
21 Plan.

23 section 3. The City Clerk is hereby directed
24 to send a certified copy of this Ordinance to the Agency.

26 section 4. Effective Date. This Ordinance
27 shall be in full force and effect thirty (30) days after its
28 passage.

19 the Redevelopment Project shall be established or incurred after
20 January 1, 2004".

23 to last paragraph of section VI(B) of the Redevelopment Plan is
24 hereby amended to read: "The Agency shall not pay indebtedness
