AB.1290 RRDEVELOPMENT PLAN AMENDMENTS
FOR VARIOUS REDEVELOPMENT PROJECT AREAS

On October 6. 1993, Governor Pete Wilson signed into law Assembly Bill (AB) 1290, also known as the
California Community Redevelopment Law Reform Acl of 1993. AB-129O was authored 10 address
perceived major abuses and problems in redevelopment practice, and to refocus the redevelopment process on
statewide concerns of alleviating blight, stimulating economic developmenl, and providing nffordable
housing. Another major objective of AB-1290 is the establishment of fmanciallimits and related issues
relative 10 redevelopment plans.
Analysis
For redevelopment projects which are adopted on or before December 31,1993, AB 1290 added limitations
as to the time limit on: I) establishing indebtedness; 2) effectiveness of the redevelopment plan; 3)
repayment of indebtedness; and 4) commencement of eminent domain proceedings. In accordllnce with the
AB-129O legislation, the Agency must amend its redevelopment plans in order to address these issues. The
mlljor effect of the AB-129O Plan Limitations are liS follows:
Agencies will be restricted in the amount they can refinance, refund, or
restructure to the amount of oulstanding indebtedness and cannot extend the
time to repay any refunding past the time limit to repay indebtedness. The
main purpose of this amendment is to allow agencies to receive the benefit of
refmancing bonds when interest rates decline significantly from the interest
mte in the original bond issue. Such an a<.1ion would likely benefit not only the
agency, but also other affected taxing entities. This would occur because
agencies would require fewer total tax increment dollars to retire a debt when
the interest paid is reduced.

scope or intent of the redevelopment plans. Staff anticipates submitting an agenda item early next year which
will call for plan amendments to bring the various redevelopment plans in conformance with the City's
General Plan.

ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
CENTRAL CITY PROJECT NO. 1 REDEVELOPMENT PROJECT
WHEREAS, the Redevelopment Agency of the City of
San Bernardino (the "Agency"), has formulated, prepared and
approved the Redevelopment Plan for the Central city Project No.
1 Redevelopment Project (the "Redevelopment Plan"); and
WHEREAS, the Mayor and Common Council of the City
of San Bernardino (the "City Council"), approved and adopted the
Redevelopment Plan pursuant to a duly enacted Ordinance on
February 23, 1965; and
WHEREAS, Section 33333.6 of the California
Community Redevelopment Law has established certain limitations
on the incurring and repaying of indebtedness and the duration of
limitations
apply to every
redevelopment plans,
which
redevelopment plan adopted on or before December 31, 1993; and
WHEREAS, section 33333.6 further provides that
unless a redevelopment plan adopted prior to January 1, 1994,
already contains limitations which comply with that section, the
legislative body shall adopt an ordinance on or before December
31, 1994, to amend the redevelopment plan either 1) to amend an

existing time limit that exceeds the applicable time limit
established by that Section, or 2) to establish time limits that
do not exceed the provisions of that section.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:
section 1. Notwithstanding any other provision of
the Redevelopment Plan (as amended), to the contrary the
Redevelopment Plan is hereby amended such that the provisions of
the Redevelopment Plan shall be effective until January 1, 2009.
section 2. A new subparagraph is added to the
end of section C of the Redevelopment Plan entitled "Limitations"
which shall read: The Agency shall not pay indebtedness or
receive tax increment revenues pursuant to Health and Safety Code
33670 after ten (10) years from the termination of the effective
date of the Redevelopment Plan.
section 3. The City Clerk is hereby directed
to send a Certified copy of this Ordinance to the Agency.
section 4. Effective Date. This Ordinance
shall be in full force and effect thirty (30) days after its
passage.
section 5. publication. The City Clerk is
hereby ordered and directed to certify to the passage of this

Project (the "Redevelopment Plan"); and
WHEREAS, the Mayor and Common Council of the city of
San Bernardino (the "city Council"), approved and adopted the

13 section 1. The first sentence of the second to
14 last paragraph of section VI(B) of the Redevelopment Plan which
15 establishes the time limit on establishing loans, advances, and
16 indebtedness, is hereby amended to read: "No loan, advance, or
17 indebtedness to be repaid from such allocations of taxes
18 established or incurred by the Agency to finance in whole or part
19 the Redevelopment Project shall be established or incurred after
20 January 1, 2004".

22 Section 2. The second sentence of the second

ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
STATE COLLEGE REDEVELOPMENT PROJECT
6 WHEREAS, the Redevelopment Agency of the City of San
7 Bernardino (the "Agency"), has formulated, prepared and approved
8 the Redevelopment Plan for the State College Redevelopment
9 Project (the "Redevelopment Plan"); and

WHEREAS, the Mayor and Common Council of the city of
San Bernardino (the "City council"), approved and adopted the
Redevelopment Plan pursuant to a duly enacted Ordinance on April
27, 1970; and
WHEREAS, Section 33333.6 of the California Community
Redevelopment Law has established certain limitations on the
incurring and repaying of indebtedness and the duration of
limitations
which
apply to every
redevelopment plans,
redevelopment plan adopted on or before December 31, 1993; and

22 WHEREAS, Section 33333.6 further provides that unless
23 a redevelopment plan adopted prior to January 1, 1994, already
24 contains limitations which comply with that Section, the
25 legislative body shall adopt an ordinance on or before December
<:: 26 31, 1994, to amend the redevelopment plan either 1) to amend an
27 existing time limit that exceeds the applicable time limit

1 established by that section, or 2) to establish time limits that
2 do not exceed the provisions of that Section.

4 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

7 section 1. The provisions of this Ordinance shall
8 supersede any prior amendments to the Redevelopment Plan.

10 section 2. A new Section G is hereby added to the
11 Redevelopment Plan to read as follows:

13 The provisions of this Redevelopment Plan shall be
14 effective for forty (40) years from the date of adoption of this
15 Redevelopment Plan.
16
17 The Agency shall not pay indebtedness or receive
18 property tax increment revenues pursuant to Health and Safety
19 Code section 33670 after ten (10) years from the termination of
20 the effective date of the Redevelopment Plan.
21
22 section 3. The city Clerk is hereby directed to
23 send a Certified copy of this Ordinance to the Agency.

25 section 4. Effective Date. This Ordinance shall be
26 in full force and effect thirty (30) days after its passage.

WHEREAS, the Redevelopment Agency of the City of
San Bernardino (the "Agency"), has formulated, prepared and
approved the Redevelopment Plan for the Tri-City Redevelopment
Project (the "Redevelopment Plan"); and
WHEREAS, the Mayor and Common Council of the city
of San Bernardino (the "city Council"), approved and adopted the
Redevelopment Plan pursuant to a duly enacted Ordinance on June
20, 1983; and
WHEREAS, section 33333.6 of the California
community Redevelopment Law has established certain limitations
on the incurring and repaying of indebtedness and the duration of
which limitations
redevelopment plans,
apply to every
redevelopment plan adopted on or before December 31, 1993; and
WHEREAS, section 33333.6 further provides that
unless a redevelopment plan adopted prior to January 1, 1994,
already contains limitations which comply with that Section, the
legislative body shall adopt an ordinance on or before December
31, 1994, to amend the redevelopment plan either 1) to amend an
existing time limit that exceeds the applicable time limit
established by that section, or 2) to establish time limits that

7 exceed the time limit established by section 33333.6 (b); and
8 therefore no amendment is required related to such limitation.

10 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
11 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

13 section 1. The first sentence of the second to
14 last paragraph of section VI(B) of the Redevelopment Plan which
15 establishes the time limit on establishing loans, advances, and
16 indebtedness, is hereby amended to read: "No loan, advance, or
17 indebtedness to be repaid from such allocations of taxes
18 established or incurred by the Agency to finance in whole or part
19 the Redevelopment Project shall be established or incurred after
20 January 1, 2004".

22 section 2. The second sentence of the second
23 to last paragraph of section VI(B) of the Redevelopment Plan is
24 hereby amended to read: "The Agency shall not pay indebtedness
25 or receive property taxes pursuant to section 33670 after ten
26 (10) years from the termination of the effective date of the
27 Redevelopment Plan". Based upon the ,termination date set forth
28 on the Redevelopment Plan, the Agency shall not pay indebtedness

Redevelopment Plan pursuant to a duly enacted Ordinance on June
16, 1986; and
WHEREAS, section 33333.6 of the California Community
Redevelopment Law has established certain limitations on the
incurring and repaying of indebtedness and the duration of
redevelopment plans,
which
limitations apply to every
redevelopment plan adopted on or before December 31, 1993; and
WHEREAS, section 33333.6 further provides that unless

10 follows: "Except for the non-discrimination and non-segregation
11 provision, (which shall run in perpetuity), the provisions of
12 this Plan concerning land use shall be effective and the
13 provisions of other documents formulated pursuant to the Plan may
14 be made effective until June 25, 2030, except that the Agency may
15 receive property taxes and pay indebtedness up until and
16 including July 11, 2040.
