1. That the Director of Public Works/City Engineer and the City Clerk are hereby
authorized to proceed with the proposed vacation of the "L" shaped alley
located between Arrowhead Avenue and Pershing Avenue and between 29th Street
and Route 30 Freeway. and
2. That Plan No. 9209, showing the proposed vacation of the "L" shaped alley
located between Arrowhead Avenue and Pershing Avenue and between 29th Street
and the State right-of-way for the 30 Freeway is approved. and
3. That the East/West section (City-owned portion) of the alley lying West of
Pershing Avenue and North of 29th Street, be lared excess pro y.

STAFF REPORT
A request was received from Tom Tissot, who lives at 2904 Pershing Avenue and 11 of
the neighbors in the vicinity of the alley in question, to vacate the "L" shaped
alley lying between Arrowhead Avenue and Pershing Avenue and between 29th Street
and the 30 Freeway right-of-way. This request represents all but one of those
owners who adjoin the alley. The only owner who has not been contacted regarding
the vacation is an absentee owner who rents out his house to people who are part of
the problem (Lots 4 and 5 fronting on Arrowhead Avenue). In previous contacts he
has not been cooperative in dealing with neighbors' problems with his tenants.
The petitioner has deposited the required $500.00, which represents one-half of the
total fee of $1,000.00. The remaining $500.00 will be due after the investigative
proceedings, if the petitioners wish to proceed.
Due to the configuration of the two alleys, easy ingress and egress allow a heavy
volume of traffic, both cars and motorcycles, at all hours of the day and night.
The neighbors are concerned that the easy access to the alley is the reason for the
increased crime in the neighborhood - drug dealing, breaking into and stealing from
cars, breaking into and entering homes and garages, transients loitering in the
alley, unknown men riding bicycles back and forth through the alley, and one case
of prostitution. Mr. Tissot was robbed recently - entry was gained to his rear
yard through the alley. Several items (edger, lawn mower, leaf blower) were
stolen and his 12 year old dog was beaten by the thieves. Vacation of the alley
would allow the adjoining residents to fence the alley and stop most of the
problems before they occur.
The North/South section was dedicated when the subdivision was developed many years
ago. This section of the alley would take determination by a title company as to
how the vacated alley will revert to the adjoining property owners upon its vaca-
tion.
However, fee title to the East/West portion of the alley was relinquished (by the
State) to the City when the 30 Freeway was constructed (See the attached drawing).
Therefore, this portion of the alley will have to be declared surplus property in
order to offer it for sale. As this parcel would only have a beneficial use to the
adjoining property owner to the South, its value is considered to be less than
$2,000.00. This will allow Real Property staff to offer the property to the ad-
joining property owner for a nominal fee.
Currently refuse is picked up in the alley. The petitioners are in agreement that
they would carry their refuse to the front curb. Kevin Barnes, Refuse Supervisor,
has indicated that there would be no problem with street side refuse pickup with a
curb setback of approximately 15 feet at the East entrance to the alley.
