In doing the initial work, it was determined that the model, as a basic requirement, must extend beyond the boundaries of the com- munity. Although not in great detail, it must look at the surrounding communities and their traffic and land use data. After investigation and contact with the adjacent com- munities, it was determined that the cost of expanding the model (by adding sufficient detail to the other areas) would produce a regional model and could be done at less cost than each city preparing its own model. In turn, each adjacent city, including Redlands, Highland, Grand Terrace, Colton, Lorna Linda and Rialto, was contacted to see if there was interest in a joint effort. All of the listed cities have executed agreements to pay the addi tional cost with the exception of Colton who is working on obtaining Council, approval of the agreement. It is realized that a model that addresses all of the concerns of the region, would speed the development process and eliminate many points of con- flict. JHK and Associates has provided the City with a listing, by city, of the costs and the total dollar cost for each community is contained in the approved agreement with each city. This is billable to the adjacent cities as progress is made on the model development. This amendment, or rather expansion to the agreement, is provided for within the original agreement and is based on written agreement by both parties. Costs to the six (6) participating cities will be as follows: Colton $ 20,490.00 Grand Terrace 5,834.00 Highland 18,014.00 Lorna Linda 8,673.00 Redlands 33,789.00 Rialto 33,602.00 Total $ 120,402.00 The cost breakdown is based on a combination of area of the city and total population as well as the number of traffic analysis zones necessary for the specific city. In addition to the above funds to be collected from participating cities, the Ci ty of S?'l l'Ir>Tn?xC'j.nr:> "'ill see a reduction in its share of $14,440.0n As originally proposed, the contract was for $149,858.00 with $20,000.00 for equipment and software. This cost to San Bernardino has now been reduced to $115,418.00 as portions that were required are now spread to adjacent cities as a part of their work. '-' RESOLUTION NO. 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF THE FIRST AMENDMENT TO THE AGREEMENT WITH JHK & 3 ASSOCIATES RELATING TO PROFESSIONAL SERVICES FOR DEVELOPMENT OF A TRANSPORTATION DEMAND FORECAST MODEL. 4 5 6 7 8 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute, on behalf of said City, the First Amendment to the Agreement with JHK & Associates 9 relating to professional services for the development of a 10 Transportation Demand Forecast Model, a copy of which agreement 11 is attached hereto, marked Exhibit "A" and incorporated herein by 12 reference as fully as though set forth at length. 13 SECTION 2. The agreement shall not take effect until 14 fully signed and executed by both parties. The City shall not be 15 obligated hereunder unless and until the agreement is fully 16 executed and no oral agreement relating thereto shall be implied 17 or authorized. 18 SECTION 3. WITNESSETH: WHEREAS, City and Engineer entered into an Agreement on September 6, 1993, relative to providing professional design services for development of a Transportation Demand Forecast Model; and WHEREAS, the six (6) adjoining cities have requested to be included in the model development; and WHEREAS, the six (6) adjacent cities have entered into, or are in the process of entering into, individual agreements with the City for the development, operation and maintenance of the model; and WHEREAS, additional data and model development work is needed to add the additional city areas; and WHEREAS, the agreements with the adjacent cities provide for payment of fees associated with the additional work on a proportional basis for the services provided; and WHEREAS, City and Engineer desire to amend the terms and conditions of their Agreement to include the six (6) adjoining cities into the model; and WHEREAS, Engineer is the best qualified to perform the required design serv~ces, due to their involvement in the base model development and agreement to provide basic services to City; and WHEREAS, Engineer has adequate professional engineering staff to provide the desired additional services. NOW, THEREFORE, it is mutually agreed as follows: 1. The Agreement between City and Engineer, dated 9-6- 93, relative to providing professional services in connection with development of the East Valley Sub-Regional Transportation Model, is hereby amended as follows: c - -....I FIRST AMENDMENT TO AGREEMENT: PROFESSIONAL SERVICES FOR EAST VALLEY SUB-REGIONAL TRANSPORTATION MODEL a. Section 1, "SCOPE OF SERVICES," is expanded to include the required additional work to incorporate the six (6) adjoining cities into the East Valley Sub-Regional Model. b. Section 5, "COMPENSATION," is amended to increase the reimbursement to the Engineer from $149,858 to $235,820, with a proration to each participating city as listed in Exhibit 1. 2. accordance $120,401.
