MOTION:
That the Community Development Commission approve a change order in an amount not to
exceed $45,000, for asbestos remediation of 402 North "0" Street (Law Library project) alld
further, that the Development Department budget be accordingly increased and the Acting
Executive Director be authorized to execute all documents to facilitate this action.

On April 18, 1994, the Community Development Commission authorized the Executive Director to execute an
Agreement of Purchase and Sale and joint escrow instructions between Bank of America and the Redevelopment
Agency and set a joint Public Hearing for May 16, 1994, to consider the approval of a Disposition and
Development Agreement with the Law Library.
On May 16. 1994, the Community Development Commission held a Public Hearing, as required under the
Community Redevelopment Law, and approved a Disposition and Development Agreement with the Law
Library and an Assignment and Assumption Agreement with Bank of America and ratified its prior approval of
escrow instructions with Bank of America.
On June 6, 1994, the Community Development Commission approved the expenditure of an additional $600,000
to purchase 402 North ''D'' Street from Bank of America, with reimbursement to come when the building sale to
the Law Library is closed.
On November II, 1994, the Redevelopment Committee recommended that the Community Development
Commission approve a Change Order for $45,000, for asbestos remediation at 402 North "0" Street.

TIle Commission approved the purchase of the old Security Pacific building (the "Building") from
Bank of America in order to transfer it to the County Law Library's Board of Trustees (the "Law
Library"). The Agency assumed the obligations under certain asbestos abatement contmcts from Bank
of America, and was therefore responsible to deliver the Building to the Law Library, clean of
asbestos, at closing of the sale.
Since the purchase of the Building by the Agency, there have been several discrepancies in the
interpretation of the abatement manual by the respective contmctors. It has been detenn ined that the
Change Onlers required in order to meet the Law Library's criteria to purchase the Building total
approximately $113,728.
The required abatement includes the following items:

abatement of elevator beams
Brick walls
PSIs monitoring of brick wall
Drywall in north and south lobbies
Drywall in elevator shafts
Drywall in duct shafts
PSIs costs for monitoring lobby, elevator shafts

However. it has been subsequently negotiated and agreed, subject to the approval of the Commission,
that the amounts required from the Agency to fulfill the above requirements will total approximately
$40,os3.

In order to achieve the lower costs, the Law Library has approved containment of the beam s within
the elevator shafts and containment of the duct shafts which substantially reduces the change order
amounts as follows:

Additionally, the Law Library has agreed to contribute $10,000 toward this amount and Janus
Corporation (the asbestos removal contractor) has agreed to contribute $3,387 to this am ount, as well.
Thus, this leaves a total amount payable by the Agency of $40,053.
We have been infonned by Janus Corporation that one of the elevators is inoperable and will require
repair prior to abatement. Additionally, in the process of tearing out materials, other costs may arise
prior to the completion of the abatement. Staff therefore recommended additional funds of $4,947 be
added to accommodate any such additional requirements. The Redevelopment Committee considered
this mailer on November 10, 1994, and recommended that the Community Development Commission
authorize a Change Order for the old Security Pacific Building (402 North "D" Street, San Bernardino,
California) asbestos abatement in an amount not to exceed $45,000.
Staff recommends adoption of the fonn motion.
