SUBJECT
Resolution of the City of San Bernardino ratifying the submittal of a grant application and
authorizing the Police Department to administer the Alcoholic Beverage Control Grant funds in
accordance with the expenditure plan.
BACKGROUND
The State of California Department of Alcohol Beverage Control will award gr~ts up to
$125,000 in Fiscal Year 2008/09 to local law enforcement agencies to develop an effective,
comprehensive and strategic approach to eliminating the crime and nuisance problems associated
with problem, alcoholic beverage outlets, and then institutionalize those approaches within the
local police agency. To achieve its goals, the program emphasizes a "full-court press" strategy
in correcting and eliminating alcohol-related problems at the point of sale with a strong emphasis
on comprehensive enforcement tactics. Selected police agencies will implement the full-court
press through a variety of innovative project objectives involving both educational and
enforcement programs, including training of law enforcement personnel, community
involvement, prevention, enforcement, records management, liaison with the ABC district office,
and media involvement. The deadline for grant applications was March 28, 2008.
The Vice & Narcotics Unit's proposal, Attack Underage Drinking, targets the problem of
underage drinking stemming from both on and off sale liquor license establishments, using both
educational and enforcement programs. If awarded, the grant will provide $125,000 for overtime
to complete the grant goals and objectives. Grant funds will provide 1,692 hours of overtime for
police officers and 272 hours for sergeants to perform educational and enforcement programs.
FINANCIAL IMPACT
There will be no impact on the City's General Fund. The Police Department will be using a total
of$125,000 in Alcoholic Beverage Control grant funds, if awarded, to perform enforcement and
educational programs in support of grant goals and objectives.

Overtime
Overtime will be worked by investigators and supervisors assigned to Vice & Narcotics and
police officers assigned to Patrol to perform various enforcement and educational programs in
furtherance of the grant goals and objectives. A total of $125,000 in grant overtime has been
requested which will provide a total of 1,964 hours of overtime to perform the following Attack
Underage Drinking programs:
Provide updated training on ABC laws to approximately 100 patrol officers, vice
investigators and supervisors.
Meet with owners and operators of the three most problematic ABC licensed
establishments to educate them on ABC laws.
Continue working with officials from California State University San Bernardino and San
Bernardino Valley College regarding underage drinking problems.
Conduct undercover surveillance programs at the three most problematic ABC licensed
establishments.
Conduct "Cops in Shops" programs.
Conduct DUI checkpoint programs.
Conduct enforcement programs such as "Underage Decoy", "Shoulder Tap", "Trap
Door" and "Impact" programs.
Conduct LEAD (Licensee Education on Alcohol and Drugs) training for retail licensees,
their employees and ABC license applicants.

The San Bernardino Police Department is pleased to submit a grant application with the
Alcoholic Beverage Control in the amount of $125,000. Our proposal, Attack Underage
Drinking, a two-prong attack on underage drinking, uses both education and enforcement
programs to achieve grant goals and objectives. Our efforts will be data driven, using
crime analysis mapping data and input from patrol officers to identifY problem
establishments throughout the grant period in order to maximize the effectiveness of our
programs and grant funding.
Educational programs will consist of partnerships with California State University San
Bernardino and San Bernardino Valley College, IMPACT training sessions, LEAD
business education programs, Roll Call training for patrol officers and media coverage of
grant programs and outcomes. Enforcement programs will include bar checks, active
surveillance, Shoulder-Tap operations. Minor Decoy operations, Trap Door operations
and DUI checkpoints.
We are confident that these programs, accomplished with the assistance of the Alcoholic
Beverage Control, will significantly reduce the incidence of underage drinking in San
Bernardino and improve the quality of life for both the business community and our
residents.

Established in 1850, the San Bernardino Police Department currently consists of
517 personnel, including 347 sworn and 170 non-sworn. The department service
area is divided into five geographically based area commands, which are further
broken down into 21 beats to provide police services to the citizens of the City.

5. Project Description: Summarize the proposed project covering the objectives, method of procedure, evaluation, and
end product. This project will be specifically used to attack the problem of under-
age drinking from both on and off sale establishments, by use of both educational
and enforcement action. The investigators, along with ABC officers, will use
several methods of enforcement to reduce the problem of underage drinking and
associated crimes. Licensed establishments will be contacted and the program will
be closely monitored allowing for tactics and enforcement options to be adjusted as
needed to ensure the most effective results.

ABC Grant Application for FY 2008/09
Attack Underage Drinking
Summary
Established in 1850, the San Bernardino Police Department currently has an authorized strength
of 517 personnel, including 347 sworn and 170 non-sworn personnel. The department has
adopted Community Policing and Problem Solving (COPPS) as a department wide policing
strategy. The City has been divided into five geographic Area Commands, each staffed with a
police lieutenant and a complement of police officers and support staff. Area personnel, in
conjunction with community members, are responsible for identifying and eliminating problems
in the community.
The police department is divided into three divisions: Patrol, Investigations and Administrative
Services. The Vice Unit, comprised of two investigators under the direction of a sergeant, is part
of the Investigations Division. In addition to the enforcement of ABC related activities, this unit
is responsible for the enforcement of all vice related crimes, to include street level prostitution,
escorts, motel prostitution, massage parlors, gaming and carnivals, gambling, animal fighting,
lewd act investigations, and adult book stores. They also work directly with City Hall,
particularly the Business Registration and Planning Departments.
The department is seeking ABC grant funding in the amount of $125,000. This funding will
allow the department to Attack Underage Drinking in our community and improve the quality of
life by enhancing alcohol-related enforcement and prevention programs. The specific goals of
our proposal are as follows:
I. Reduce the incidence of underage drinking in the community through a variety of education
and enforcement programs.
2. Establish and strengthen partnerships with California State University San Bernardino and
San Bernardino Valley College officials.
3. Identify and target problematic ABC licensed establishments using crime analysis
information and input from patrol officers and the community.
4. Contact business owners and operators at identified problem establishments to solicit
voluntary cooperation and compliance.
5. Conduct at least (6) DUI Checkpoint programs.
6. Coordinate and conduct (60) IMPACT training sessions.
7. Conduct at least (25) Bar Checks / Active Surveillance.
8. Conduct at least (14) Shoulder-Tap / Minor Decoy Operations.
9. Conduct (2) LEAD business education programs.
10. Conduct at least (4) Trap Door operations.
II. Use local media to publicize grant funded programs and outcomes.
12. (2) Vice investigators will attend (2) ABC grant training conferences.
13. Conduct Roll Call training on alcohol-related issues for patrol officers each quarter.
14. Complete all required grant financial and progress reports.
C Problem Statement
The City of San Bernardino is the county seat for San Bernardino County. San Bernardino is
located 60 miles east of Los Angeles and is surrounded by the neighboring communities of
Highland, Lorna Linda, Rialto, Colton, Redlands, and Devore. Interstate freeways 1-215, 1-10,
and 1-210 provide travel through the City. The City has an ethnically diverse population of
207,172 residents, with 29% of the population of Anglo descent, 15% African American, 8%
Asian and 47% Hispanic. 38.4% of the City's population is under the age of 18. We are home
to the California State University San Bernardino and San Bernardino Valley College where
17,066 and 13,000 students, respectively, are enrolled. According to the United States economic
forecast, the Inland Empire, which incorporates the City of San Bernardino, is one of the top ten
growth areas in the nation with the fastest developing urban area.

In 2007, police officers responded to over 94,000 calls for service and made 16,505 arrests,
including 1,292 juvenile arrests. Four juveniles were arrested for DUl and 46 for public
intoxication. The City reported 12,242 total Part 1 (serious felony) crimes to the Department of
Justice, including 2,152 violent crimes and 10,090 property crimes. The Morgan Quitno Awards
has listed the City of San Bernardino as one of the top 50 most dangerous cities in America the
past four years. Our crime rate has been adversely impacted by a number of interrelated factors:
low rents, a low percentage of owner occupied residences, 1,400 resident parolees, 56% of the
community receiving state or federal aid, and a high number of residents living below the
poverty level.
The primary alcohol-related problem facing the City is underage drinking at the ABC licensed
establishments. The secondary problems are the associated crimes of drinking in public, public
intoxication, intoxicated patrons fighting in the parking lots and general quality of life issues for
the businesses and residences that are in close proximity of a licensed location. Among the most
problematic are three large night club type establishments that draw underage patrons from as far
south as San Diego and as far west as Los Angeles. Identified problems include juvenile
drinking, public intoxication, fighting, loitering, driving under the influence, vandalism, etc.
These problems have been validated through 257 calls for service, public complaints,
information from bar operators and security, arrests, traffic collisions, ABC information, and
vice programs.
Businesses located in close proximity to licensed establishments suffer economically as they are
forced to close when the patrons of the establishment loiter and commit vandalism, graffiti, and
thefts. Two additional bar/nightclub facilities are in the process of opening. Efforts to resolve
these problem establishments have included active surveillance with arrests of offenders and
meetings with owners attempting to secure voluntary compliance at their business. Our efforts
have been severely restricted due to limited funds available for the programs.
There are 394 licensed establishments within the City of San Bernardino (104 type 20, 86 type
21,10 type 40,70 type 41, 4 type 42, 68 type 47,18 type 48,7 type 51, 5 type 52, I type 57,16
type 58, 1 type 64, 2 type 68, and 2 type 77). Currently with only two officers assigned to full
time investigatory vice responsibilities and the large number of licensed establishments, it is very
difficult to adequately ensure proper compliance with all applicable ABC laws, as well as local

statutes. Nevertheless, during the period from January 1,2006 through December 31, 2007, a
total of 13 shoulder-tap and decoy operations were conducted, resulting in 83 arrests. Using
scarce police resources to address these crimes diminishes our ability to respond to serious and
violent crimes. These combined factors, coupled with fiscal restraints due to renewed state and
local budget reductions, challenge our ability to provide quality police services.
The City Attorney, who handles the various municipal code violations, and the District
Attorney's Office that prosecutes the state law violations, are both highly supportive of
enforcement programs as well as preventive measures. Obviously, the preventive programs are
preferred, as this will minimize the drain on their limited resources.
Proiect Description
Past experience has shown that a two-prong attack on the problem of underage drinking has been
most effective. The first step is a proactive educational effort directed at the targeted ABC
establishments, selected by their location or past history, that have a high likelihood of underage
patrons trying to illegally purchase or use alcohol. Conducting site visits and providing
owner/operators with the information to aid employees in identifying underage patrons and take
the appropriate steps to eliminate that activity will reduce enforcement efforts. A secondary
benefit is the development of a partnership with the establishment which opens communication
lines with the police department.
Educational efforts will also be directed at the underage population that may try to purchase
alcohol. This will be accomplished through partnerships with California State University San
Bernardino, via the ABC Partnership Program, and San Bernardino Valley College.
Additionally, through the effective use of print and radio media, the message that underage
drinking is illegal will be reinforced. .
The second prong in attacking underage drinking is use of decoy programs and undercover
surveillance programs to target the offenders themselves. One goal would be to conduct
programs in trouble spots where the arrest of subjects is necessary, and to meet with owners /
operators to resolve the problems. Encouraging compliance with the ABC rules and regulations
would be achieved by involving them in solving alcohol-related problems at their businesses.
For example, a nightclub owner that is having problems with minors using fake ill's would assist
us by allowing a Trap Door program. An establishment that is having trouble with subjects
drinking in their parking lot or surrounding businesses would assist officers in conducting a
surveillance program to arrest violators. Grant funds will allow the San Bernardino Police
Department to conduct these programs on a weekly or as-needed basis, rather than on a monthly
basis. Thus both establishments and patrons will be aware of the close monitoring by the police
department, allowing the department to maintain a visible proactive presence which deters
further violations.

Proiect Personnel
The Police Department's Vice Unit will be responsible for the implementation of the project and
for continuous monitoring and evaluation of the effectiveness of the project. They will complete
all necessary progress reports required of the grant. The following personnel will be required to
carry out grant objectives as supported by the proposed budget.
Sergeant Brad Lawrence is a 23-year veteran police officer. He has four years experience as a
sergeant and directly supervises the Vice Unit.
Investigator Jerry Valdivia is a 26-year veteran police officer. He has over four years of
experience working in the Vice Unit. He has participated in over 800 vice programs, including
prostitution, ABC operations, lewd acts, gaming and smoking. Jerry has completed 200-hours of
advance officer training related to vice operations.
Investigator Dave Baughman is a 14-year veteran police officer with two law enforcement
agencies. He has over three years experience in the Vice Unit. Dave has participated in over
500 programs, including prostitution (pimping, street level, escort, and child exploitation), ABC,
gaming, animal fighting, tobacco investigations, and lewd conduct. He has attended 220-hours
of advance officer training related to vice operations.
Overtime will be utilized to complete grant funded goals, objectives and programs with the
exception of data collection and analysis, identification of problem establishments, Roll Call
training, IMPACT training and LEAD Training. These programs will be completed by vice
