RESOLUTION NO. 2007-470
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AMENDING RESOLUTION 2005-363 TO INCLUDE THE USE OF A
CITY REGISTER OF HISTORICAL AND ARCHITECTURALLY SIGNIFICANT
PROPERTIES FOR THE PURPOSES OF MILLS ACT ELIGIBILITY.
WHEREAS, California Govemment Code, Article 12, Section 50280, more commonly
known as the Mills Act, established legislation providing property tax relief for owners of
qualified historic properties who contract with a city to abide by reasonable preservation
requirements; and
WHEREAS, under the current method of determination, many homes that might
otherwise be qualified for Mills Act Preservation Agreements. are not contained in a 1991
survey of historically significant structures;
THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. . Section 5 of Resolution 2005-363 is hereby amended to read as follows:
"SECTION 5. Eligibility for a Preservation Agreement shall be limited
to the owners of those properties identified in the San Bernardino Historic
Resources Reconnaissance Survey, Volume 2 - Tabular List of All Surveyed
Historic Resources, dated April 30, 1991, and/or the official City Register of
Historical and Architecturally Significant Properties, which may be created by
the Historic Preservation Commission. The Mayor and Council hereby find that
all properties contained in these lists shall be considered Qualified Historic
Properties for purposes of the Mills Act, pursuant to California Government
Code Section 50280. 1 (b) ."
