Home My WebLink About1982-099I RESOLUTION NO. 82-99 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING CONFLICT OF INTEREST CODES TO INCORPORATE BY REFERENCE THE FAIR POLITICAL 3 PRACTICES COMMISSION'S STANDARD MODEL CONFLICT OF INTEREST CODE. 4 WHEREAS, amendments to the Political Reform Act, Government 5 Code Sections 81000, et seq., have in the past and foreseeably 6 will in the future require conforming amendments to be made in 7 Conflict of Interest Codes adopted and promulgated pursuant to its 8 (`provisions; and I 9 1 WHEREAS, the Fair Political Practices Commission has adopted 10 !a regulation, 2 Cal. Adm. Code Section 18730, which contains the 11 (terms of a standard model Conflict of Interest Code, which can be 12 incorporated by reference, and which will be amended to conform to 13 amendments in the Political Reform Act after public notice and 14 hearings conducted by the Fair Political Practices Commission 15 SECTION 2. pursuant to the Administrative Procedure Act, Government Code 16 Code Sections 11370, et seq.; and 17 WHEREAS, incorporation by reference of the terms of the 18 aforementioned regulation and amendments to it in Conflict of 19 Interest Codes will save this body time and money by minimizing 20 the actions required of this body to keep the Codes in conformity 21 with the Political Reform Act, 22 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 23 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 24 SECTION 1. All prior resolutions or other actions of the 25 Mayor and Common Council in conflict herewith are hereby 26 repealed. 2711 SECTION 2. The terms of 2 Cal. Adm. Code Section 18730 and 28 any amendments to it duly adopted by the Fair Political Practices 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 J commission, are hereby incorporated by reference and constitute the Conflict of Interest Codes for all departments, divisions, agencies, boards and commissions other than those specified in Government Code Section 87200. Designated positions required to file disclosure statements and categories in which such disclosures are required to be made are set forth in Appendices A and B hereto, which are hereby incorporated herein by reference. SECTION 3. Pursuant to Subsection (4)(B) of the Conflict of Interest Code, persons holding designated positions shall file statements of economic interests with their department, which shall make and retain a copy and forward the originals to the City Clerk, to whom the Mayor and Common Council hereby delegate the authority to carry out the duties of filing officer. I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of San Bernardino at a regular meeting thereof, held on the 1st day of March 1982, by the
