RS so RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGRW1ENT WITH "THE COUNSELING TEAM" FOR PROVIDING AN EMPLOYEE ASSISTANCE PRO- GRAM FOR SWORN POLICE OFFICERS. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOllOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized ar.cI directed to execute on behalf of said City an Agreement with "The Coun- seling Team" for providing employee assistance program services to sworn Police Officers of the City (P 1 - P 7), a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. Approved as to form: . , .. THE COUNSELING TEAM 370 W. 6th St., Suite 215 San Bernardino, CA 92401 CONSULTING AGREEMENT 1. PARTIES TO AGREEMENT. This agreerrent is made on ~u/r6; 1985, between The City of San Bernardino and The Counseling Team, 370 W. 6th St., Suite 215, San Bernardino, CA 92401. 2. SCOPE OF WORK. The Counseling Team henceforth to be known as the Con- sultant, hereby agrees to perform the following services: a. Preliminary evaluation and counseling for all sworn police department officers (PI-P7), and their :i.rmediate family rrembers, and referral to corrmunity treatment resources. b. Follow-up of said officers (and/or family menDers) under treatment. c. Consultation with supervisors regarding problem employees and/or any aspect of the Enployee Assistance Program. d. Provide supervisory training relative to Enployee Assistance Program referral procedures. e. Conduct education seminars and briefings for all levels of managerrent concerning services provided by the Enployee Assistance Program. f. Assist labor and managerrent in developrent of policies and procedures for Enployee Assistance Program. g. Assist labor and management introducing the Enployee Assistance Pro- gram to aforementioned employees. 3. INDEPENDENT CONTRACTOR STATUS. Consultant shall have control over the details of and means of performing the services required, and shall be subject to the City of San Bernardino City Police Department only with respect to the s=pe of work and the general results required. Nothing in this agreement shall be construed to make Consultant or any of its employees or agents to be employees or agents of the San Bernardino City Police Department. 4. FEES AND CHARGES. The cost to the City of San Bernardino for these ser- vices will be Six Hundred Fifty D?llars and no/lOO ($650.00) per rronth. On consurrmation of agreerrent, pre-treatment and referral services are available at no cost to aforementioned employees. If The Counseling Team in turn needs to refer covered individuals to another professional indi- vidual/agency outside The Counseling Team, then the cost incurred for same becOIreS the individual responsibility of the employee. Every effort will be made to refer employees to free, insurance-covered agencies, or those agencies which operate on an ability-to-pay basis. r Consulting. Agr-eeIlEnt Page 2 '. 5. LENGI'H OF SERVICE AGREEMENI'. This agr-eeIlEnt will beCOllE effective on March 1, 1985, and remain effective until March 1, 1986. 6. PERFORMl\NCE OF SERVICES. Consultant will render its services at 370 W. Sixth Street, Suite 215, San Bernardino, CA., until further notice. REPORTS SUBMITI'ED BY CONSULTANT WILL: a. Accurately des=ibe services performed during the contract period, for audit purposes. b. Make reference to this Agr-eeIlEnt or otherwise identify the report(s) in such manner as the City of San Bernardino/Police IEpartrrent may reasonably require. c. Provide feedback annually to the City of San Bernardino/Police IEpt. for the purpose of evaluating the effectiveness of the EAP. 7. SUBCONTRACTING. The services under the Agr-eeIlEnt shall be performed by Consultant and no services shall be subcontracted to any other party except with the written consent of the City of San Bernardino. 8. RESPONSIBILITY. Consultant assurres all liability for the services to be performed and for worker's co~nsation law. Consultant agr-ees to hold the City of San Bernardino harmless from, and to indemnify it against any loss, injury, damage or legal liability arising out of Consultant's work or omission. The cost of the City of San Bernardino defending against a claim for any alleged loss, damage, injury, or legal liability arising out of Consultant's work or omission shall be paid by Consultant.
