July 16,2007 Resolution awarding a contract to L.A. Builders, Inc. for 1-215 Freeway segment 3 Sewer
Line Relocation (SW08-08), per Plan No. 11916.
August 2007 The Mayor and Common Council approved FY 2007-08 CIP Budget.
Recommended Motion:
I. Adopt Resolutions; and
2. Authorize the Director of Finance to amend the Fiscal Year 2007-2008 budget to increase the project
expenditure Acct. No. 242-362-5504-7747 by $1,363,500 and to make a corresponding increase in
revenue resulting from the future Caltrans reimbursement of project expenses.

STAFF REPORT
Subject:
Resolutions awarding contracts to Weka, Inc. for 1) Construction of Sewer Force Main and Colton Lift
Station Improvements at Inland Center Drive and Sewer Main and Sewer Encasements at Mill Street;
and 2) Relocation of Sewer Force Main near Inland Center Mall east of Ring Road and south ofInland
Center Drive (SW08-08), per Project Plan No's 12350 and 12086, respectively.
Background:
In June of 2005, the California Department of Transportation (Caltrans) proposed that the City of San
Bernardino enter into a Utility Agreement as part of their realignment and widening of the 1-215
Freeway. The agreement, which required Caltrans to reimburse the City for all engineering, inspection
and construction costs associated with the relocation of our facilities, was signed by the Mayor on June
29, 2005. Total project costs at this time were estimated at $3,337,097, exclusive of contingencies.
The project consists of the following three phases:
PHASE 1
I. Relocating four sewer siphons - A contract was awarded for Phase I work in July 2007 in the
amount of $867,888, with total project costs for this phase estimated at $1,150,000. Phase I work
is nearly complete.
PHASE 2
I. Relocating an existing sewer force main outside the newly acquired freeway rights of way.
2. Improving the existing sewer lift station to accommodate additional flows.
3. Installing a new sewer main in Mill Street.
4. Encasing both the new and existing sewer mains in Mill Street.
PHASE 3
1. Relocating the existing sewer force main east of Ring Road and south of Inland Center Drive.
Plans and specifications for Phase 2 of this project were completed and the project was opened to
public bidding on December 14, 2007. The project was advertised locally in the San Bernardino
County Sun Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego
Daily Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online,
Construction Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber
of Commerce.
Bids have been received and are listed below:

Based on review of the sealed competitive bids received, staff has determined that Weka, Inc. of
Redlands, the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced
contract to Weka, Inc.
The estimated project costs are as follows:
$ 1,141,690.00
$ 171,253.50
$ 187,056.50
$ 1 500,000.00
Phase 3 of the project was bid separately from Phase 2 work and involves the relocation of an existing
sewer force main east of Ring Road and south of Inland Center Drive. Work consists of cutting into the
existing parking lot of the Inland Center Mall, digging and supporting the open trench, installing and
connecting a new sewer force main and replacing the earth and parking lot to former conditions.
Plans and specifications for Phase 3 of the project were completed and the project was opened to
public bidding on December 14, 2007. The project was advertised locally in the San Bernardino
County Sun Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego

Financial Impact:
The Utility Agreement with Caltrans requires that the City be reimbursed for the cost of relocating and
reconstructing our facilities in order to allow for Caltrans to proceed with their freeway realignment
and widening project for the 1-215 freeway; therefore, the financial impact is neutral.
Recommendation:
I. Adopt Resolutions; and
2. Authorize the Director of Finance to amend the Fiscal Year 2007-2008 budget to increase the
project expenditure Acc!. No. 242-362-5504-7747 by $1,363,500 and to make a corresponding

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Weka, Inc. 826 Brookside Avenue, Suite G, Redlands, CA 92373, is the
lowest responsible bidder for the Construction of Sewer Force Main and Colton Lift Station
Improvements at Inland Center Drive and Sewer Main and Sewer Main Encasements at Mill
13 Street (SW08-08), per Project Plan No. 12350. A contract is awarded accordingly to said
14 bidder in a total amount of$1,141,690.00, with a contingency amount of $187,056.50, but such
15 award shall be effective only upon being fully executed by both parties. All other bids,

therefore, are hereby rejected. The City Manager is hereby authorized and directed to execute
said contract on behalf of the City; a copy of the contract is on file in the office of the City
Clerk and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
