STAFF REPORT
SUBJECT:
Resolution of Intention: Vacation of a portion of Flores Street, 10th Street and Pennsylvania Avenue, south of
Baseline Street.
BACKGROUND:
A request was received from the San Bernardino City Unified School District to vacate portions of three streets
located in the site of the new high school. Streets to be vacated are Flores Street, 10th Street and Pennsylvania
A venue south of Baseline Street (Attachments 1 and 2). The school district is aware that the City of San
Bernardino will need to retain easements and other rights in the vacated streets or at new locations to be
dedicated for right of way.
On March 15, 1999, authorization was given to proceed with the proposed vacation and Plan No. 9944 was
approved.
All affected City Departments and Utility Companies were notified of the proposal on March 16, 1999 and a
reply was due by March 30, 1999. The attached sheet (Attachment 3) summarizes the responses received.

The Resolution of Intention, which sets a Public Hearing for ~ , has been attached hereto for your
action also. Upon the approval of said Resolution, all adjacent property owners will be notified by mail of the
hearing date.
FINANCIAL IMPACT:
The applicant has paid a $1,000 non-refundable processing fee for the street vacation.
RECOMMENDATION:
Adopt Resolution.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS
3 INTENTION TO ORDER THE VACATION OF A PORTION OF FLORES STREET,
10TH STREET AND PENNSYLVANIA A VENUE SOUTH OF BASELINE STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:

hereby declares its intention to order the vacation of portions of Flores Street, lOth Street and

Flores Street and 10" Street:
That portion of Block 21 of Rancho San Bernardino, as per map recorded in Book
7 of Maps, page 7, records of the County Recorder of San Bernardino County,
State of California, and a portion of Tract No. 2639, as per map recorded in
Book 37 of Maps, Page 50, records of said County, and a portion of Parcel Map
No. 8121, as per map recorded in Book 95 of Parcel Maps, pages 72 and 73,
records of said County, more particularly described as follows:
Beginning at the Northwest comer of Lot 8 of Tract No.2639 said point also being
the intersection of South line of 10111 Street and the East line of Pennsylvania
Avenue (formerly Olive Avenue); thence East along said South line to the West
line of Flores Street; thence South along said West line of Flores Street to a point
that is 191.25 feet North of the centerline of Ninth Street as measured along said
West line and it's Southerly prolongation; thence East, at right angles, along a
straight line to the East line of Flores Street; thence North along said East line to
the South line of said 10111 Street; thence East along the said South line to the East
line of said Tract No. 2639; thence North along said East line and it's Northerly
prolongation to the North line of said lOth Street; thence West along said North
line to the East line of said Flores Street; thence North along said East line to it's
Northerly terminus as shown on said Parcel Map 8121; thence West along said
terminus line to the West line of said Flores Street; thence South along the West
line of said Flores Street to the North line of said 10th Street; thence West along
said North line to the East line of said Pennsylvania Avenue; thence South along
a straight line to the point of beginning.

That portion of Down's Subdivision, in the City of San Bernardino, County of
San Bernardino, State of California, as shown on the Map recorded in Book 4 of
Maps, Page 1, records of said County, more particularly described as follows:

Beginning at the Northeast corner of Lot 5 of said Down's Subdivision said point
also being the intersection of the South line of Baseline Street and the West line of
Pennsylvania Avenue (formerly Olive Avenue); thence South, along said West
line, a distance of 1,266.56 feet, more or less, to a point that is 253.46 feet South
of the North line of Lot 3, said Down's Subdivision; thence East, at right angles,
along a straight line to the East line of said Pennsylvania A venue; thence North
along said East line to said South line of said Baseline Street; thence West along
a straight line to the point of beginning.
SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in

with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law",
being Division 9, Part 3, of the Street and Highways Code of the State of California.
SECTION 3. That the hour of 10:00 a.m., on June 21,1999, in the Council Chambers of
City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place when
and where all persons interested in or objecting to the proposed vacation may appear before the
said Mayor and Common Council and offer evidence in relation thereto, for further particulars as
to the proposed vacation, see that map marked "Plan No. 9944, approved on 03/15/99, attached
as Exhibit 'A'.
SECTION 4. That the City Engineer of the City of San Bernardino hereby is directed to
cause Notices of Street vacation to be posted as required by said "Public Street, Highways and
Service Easements Vacation Law."
SECTION S. That the City Clerk shall certify to the adoption of this Resolution of
intention and shall cause the same to be published once a week for two successive weeks in The
Sun, a newspaper published and circulated in the City of San Bernardino, prior to the
above date set forth for the public hearing.

publish the resolution in the Sun newspaper, once on Mav 26. 1999 and again on June 2. 1999.

Also, attached is a copy of Plan No. 9944 depicting the proposed vacation. Please file this map in your office, as
referenced in said resolution.
