SUBJECT:
Resolutions establishing fair market values for the acquisition of street and highway and slope
and drainage easements located northerly of Kendall Drive, easterly of the Devil's Creek Flood
Control Channel, relative to the construction of Campus Parkway (formerly referenced as the
extension of Pepper Linden Drive) and authorization to acquire said easements.
BACKGROUND:
On July 15, 2002, the five year CIP (Capital Improvement Program) was approved. Among the
various projects identified in the CIP for FY 2002/2003 is the construction of a street extending
from Kendall Drive to Northpark Boulevard. The proposed street was referenced in the budget as
the extension of Pepper Linden Drive. At the suggestion of California State University, the new
street is proposed to be named Campus Parkway. This street is needed to lessen the present and
anticipated future traffic impact to and from the University. The first phase of the project
includes the acquisition of right of way and appurtenant easements, the construction of one
traffic lane in both directions, and the installation of a traffic signal at the intersection of Kendall
Drive and Pepper Linden Drive. Future phases will include the addition of two additional lanes
of traffic, sidewalk, median and landscaping. Ultimately, the street will allow access to the
University from the 1-215 Freeway and the proposed 1-210 Freeway some time in the future
when funding becomes available.
The design of this portion of Campus Parkway has been completed and partial acquisitions
across three parcels will be needed. Staff sent Request for Proposals to several appraisal firms
and the firm of Len Perdue and Associates was contracted to provide appraisals for the three
parcels. The first parcel (APN 0261-231-06), consists of street and highway and slope and
drainage easements. The remaining two parcels (APN 0261-231-07 and 0261-231-27), only
require slope and drainage easements to facilitate the extension of the street through the hill
which is located at the rear of the parcels. The attached maps indicate the areas necessary for the
various easements.
After the appraisal was received, minor changes were made in the design to allow more efficient
grading and minimize the need for importing and exporting fill, thus reducing overall costs for
the project. This resulted in a modification in the areas needed to be acquired. The appropriate
cost per square foot, as determined by the appraiser, was extended by staff across the modified
areas and final values amended accordingly. The parcels across which only slope and drainage
easements need to be acquired, were determined by the appraiser to be of nominal value and thus
did not change, although the easement areas were reduced. The only modification in value to
these parcels was the addition of the value of temporary construction easements adjacent to the
two parcels which was estimated by staff at nominal rates. The construction easements consist of
10-foot strips adjacent to and southerly of the slope and drainage easements and were not

identified in the original appraisal. The attached summary sheets show the original values, as
determined by the appraiser, and the amended values.
All three property owners have been contacted by the City and informed of the City's intent to
acquire the necessary easements and have been informed of the appraised value, subject to
confirmation by the Mayor and Council. The attached resolutions establish these values as fair
market value.
In the event the acquisition of these easements cannot be successfully negotiated, the City may
exercise the option of eminent domain to acquire these easements if authorized by the Mayor and
Common Council.
FINANCIAL IMPACT:
$99,280 from the Gas Tax Fund (126-369-5504-7007) approved in the 5 year CIP budget
RECOMMENDATION:
Staff recommends adoption of the attached resolutions and that staff be authorized to proceed
with the acquisition of easements.

14 parcel of real property from which said easements are to be acquired; and

WHEREAS, an appraisal has been prepared by Len Purdue and Associates, a California
general certified appraiser; and
WHEREAS, City has reviewed the appraiser's determination of the fair market value
.ofthe land and his report thereon; and

WHEREAS, staff has amended said determination of fair market value as a result of an
increase of area to be acquired.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON

strip of land, 100 feet wide, lying within said Lot 14, the centerline of which is described as

Beginning on the centerline of Kendall Drive, distant thereon 1010.28.feet from its intersection
with the centerline of Deerfield Street, as said street is delineated on the Map of Tract No. 10647,
as per plat thereof recorded in Book 159 of Maps, pages 39 and 40, records of said County;
thence North 320 06' 26" East, a distance of225.00 feet, to a tangent curve, concave
southeasterly, having a radius of 1850.00 feet; thence northeasterly, along said curve, through a
central angle of21 039' 01', an arc distance of 699.1 I feet to the point of termination.
The sidelines of said easement shall be lengthened or shortened as to commence on the
southwesterly line of said Lot 14 and terminate on the northeasterly line of said lot 14.

Beginning at the most westerly corner of said Lot 14, said point also being on the northeasterly
line of Kendall Drive, having a half-width of 40 feet; thence North 320 15' 50" East, along the
northwesterly line of said Lot 14, a distance of 34.79 feet; thence South 120 48' 52" East, a
distance of35.11 feet; thence South 320 15' 50" West, a distance of 10.00 feet, to the
southwesterly line of said Lot 14 and said northeasterly line of Kendall Drive; thence North 570
