Recommended Motion:
1. Authorize the Director of Finance to amend the FY 2007-2008 budget by deleting project SS07-29 from

Resolution approving Agreement for Professional Design Services with Hall & Foreman, Inc. for
realignment of an existing 1-215 Freeway Frontage Road northwesterly of Little League Drive and
extending 0.73 mile northwesterly from its existing terminus to Dement Street in Devore (SS07-
29).
Background:
On August 20, 2007, the Mayor and Common Council approved the FY 2007/08 Capital
Improvement Program (CIP) allocating a total amount of $497,700 for this project from a
combination of%2-cent sales tax (Measure I) fund and developer contribution through EDA for the
design of a new road between Little League Drive and Devore Road(SS07-29).
Since the early 1980's the Verdemont area has experienced heavy growth southeasterly of Little
League Drive. Development in the area northwest of Little League Drive has been hampered by
lack of adequate access. The Development Code requires that all subdivision development in the
City provide two standard means of access. Each means of access, at a minimum, is required to be
paved and dedicated and designed to provide two traffic lanes, one in each direction.
Century Crowell Communities is proposing a residential subdivision northwesterly of Little
League Drive along the I-215 Frontage Road. The Frontage Road was built by the State in the
1950's as part of the I-215 Freeway. The geometric design of the road is not adequate to support
additional traffic and it dead-ends 1.28 miles northwest of Little League Drive. In order for
Century Crowell Communities to develop its subdivision, the Frontage Road must be realigned
and extended approximately 0.73 miles to Dement Street near Devore Road.
In meetings between City staff, EDA staff and the developer, it was agreed that the City would
assume responsibility for design of the extension of the road. On February 26, 2007, the City
issued a request for proposals (RFP) to provide professional design services for the project.
Copies of the RFP were sent to 15 consultants including firms located in the City Limits of San
Bernardino who have indicated interest in performing work for the City. Three proposals were
received, but none were from local firms.
In general, the work required by the RFP consists of designing the realignment and extension of
the I-215 Frontage Road between Little League Drive and Dement Street, including preliminary
environmental review and acquisition of right-of-way. The scope of services for this work is
further described in further detail in the attached copy of the RFP.
The proposals were reviewed (Phase I) and the consultants interviewed (Phase II) in accordance
with the consultant selection process approved by the Mayor and Common Council on September
2, 2003. The Phase I rating system included such factors as past experience with similar types of
projects, adequacy and experience of staff, completeness of proposal, past experience working
with the consultant and understanding the requirements of the project. Based on review of
proposals and interviews with the three consultants, the staff reviewers/evaluators selected the

team of Hall & Foreman, Inc. based on their qualifications and staff's previous experience with the
firm, completeness of the proposal, understanding of the project, and other criteria. The
reviewers/evaluators feel that the proposal submitted by Hall & Foreman, Inc. best meets the needs
of the City and recommends award of a design contract to Hall & Foreman, Inc.
Proposed fees for services were as follows:

Hall & Foreman, Inc. has extensive experience in local land development. The firm is currently
under contract to the City to provide on-call plan review services and has performed satisfactorily
under terms of that contract.
The proposal submitted by Hall & Foreman, Inc. offers the lowest proposed consultant fee and was
determined to be clearly superior by the rating panel based on a consideration of all the rating
factors and it offers the lowest proposed consultant fee.
Hall & Foreman, Inc. estimates that the design services under terms of the Agreement can be
completed within 6 months. However, other constraints related to environmental review, right-of-
way acquisition, and resource agency review (Corps of Engineers, County Flood Control, State
Department of Fish and Game, Water Quality Control Board, etc.) will likely extend the project to
late-2008.
The estimated total cost of this Agreement is as follows:
Fixed Fee $281,805.00

Financial Impact:
The funding source will consist of banked funds for payback of an EDA loan for Verdemont
Infrastructure. EDA is processing a companion item to forgo payback of the loan in order to
facilitate development of the area. Approximately $247,700 in Measure I funds are currently
allocated to this project. Those funds will no longer be needed and can be reallocated to other
projects in the upcoming fiscal year.

14 approval and acquisition of right-of-way, which may include decertification of existing operating
15 State R/W, pursuant to the Agreement for Services, attached hereto and incorporated herein as
16
Exhibit "A", for the not-to-exceed amount of$281,805.00 plus $863.00 per hole for potholing,
17
18 based on the Proposal dated March 26, 2007, Attachments "1", "2", and "3" to Exhibit "A" and
19 incorporated herein, and the Request for Proposal (RFP), attached hereto and incorporated herein
20 as Exhibit "B." Pursuant to this determination, the Purchasing Manager is hereby authorized and
21 directed to issue Purchase Orders for said services to said firm which references this Resolution.
22 SECTION 2. The City Manager is hereby authorized and directed to execute said

Agreement on behalf of the City.

25 SECTION 3. The authorization to execute the above referenced Agreement is rescinded
26 if it is not executed within sixty(60) days of the passage of this resolution.

0.73 MILES FROM ITS EXISTING TERMINUS TO DEMENT STREET,
INCLUDING PRELIMINARY ENVIRONMENTAL REVIEW AND
ACQUISITION OF RIGHT-OF-WAY, WHICH MAY INCLUDE
DECERTIFICATION OF EXISTING OPERATING STATE R/W (SS07-29).
THIS AGREEMENT is made and entered into this day of ,
2008 ("Effective Date"), by and between the CITY OF SAN BERNARDINO, a charter
city ("City"), and Hall&Foreman, Inc. ("Consultant").
WITNESSETH :
A. WHEREAS, City proposes to have Consultant provide Professional Civil
Engineering Design Services for the Realignment and Extension of an Existing 1-215
Freeway Frontage Road from Little League Drive to Dement Street described herein
below; and
B. WHEREAS, Consultant represents that it has that degree of specialized expertise
contemplated within California Government Code, Section 37103, and holds all
necessary licenses to practice and perform the services herein contemplated; and
C. WHEREAS, City and Consultant desire to contract for specific services in
connection with the project described below (the "Project") and desire to set forth their
rights, duties and liabilities in connection with the services to be performed; and
D. WHEREAS, no official or employee of City has a financial interest, within the
provisions of California Government Code, Sections 1090-1092, in the subject matter of
this Agreement.
NOW, THEREFORE, for and in consideration of the mutual covenants and
conditions contained herein, the parties hereby agree as follows:
1.0. SERVICES PROVIDED BY CONSULTANT
1.1. Scope of Services. Contractor shall provide Professional Civil Engineering
Design Services for the realignment of an existing 1-215 Freeway Frontage Road
northwesterly of Little League Drive and extension 0.73 mile northwesterly from its
existing terminus to Dement Street (SS07-29). The project includes environmental
approval and acquisition of right-of-way, which may include decertification of existing
operating State R/W, in accordance with the City's standards and Consultant's proposal
dated March 26, 2007, attached hereto and incorporated herein as Attachment"I".
1.2. Professional Practices. All professional services to be provided by
Consultant pursuant to this Agreement shall be provided by personnel experienced in
their respective fields and in a manner consistent with the standards of care, diligence and

skill ordinarily exercised by professional consultants in similar fields and circumstances
in accordance with sound professional practices. Consultant also warrants that it is
familiar with all laws that may affect its performance of this Agreement and shall advise
City of any changes in any laws that may affect Consultant's performance of this
Agreement.
1.3. Warranty. Consultant warrants that it shall perform the services required-
by this Agreement in compliance with all applicable Federal and California employment
laws including, but not limited to, those laws related to minimum hours and wages;
occupational health and safety; fair employment and employment practices; workers'
compensation insurance and safety in employment; and all other Federal, State and local
laws and ordinances applicable to the services required under this Agreement.
Consultant shall indemnify and hold harmless City from and against all claims, demands,
payments, suits, actions, proceedings, and judgments of every nature and description
including attorneys' fees and costs, presented, brought, or recovered against City for, or
on account of any liability under any of the above-mentioned laws, which may be
incurred by reason of Consultant's performance under this Agreement.
1.4. Non-discrimination. In performing this Agreement, Consultant shall not
engage in, nor permit its agents to engage in, discrimination in employment of persons
because of their race, religion, color, national origin, ancestry, age, physical handicap,
medical condition, marital status, sexual gender or sexual orientation, or any other
category protected by law, except as permitted pursuant to Section 12940 of the
Government Code. Violation of this provision may result in the imposition of penalties
referred to in Labor Code, Section 1735.
1.5 Non-Exclusive Agreement. Consultant acknowledges that City may enter
into agreements with other consultants for services similar to the services that are subject
to this Agreement or may have its own employees perform services similar to those
services contemplated by this Agreement.
1.6. Delegation and Assignment. This is a personal service contract, and the
duties set forth herein shall not be delegated or assigned to any person or entity without
the prior written consent of City.
1.7. Business License: The Consultant shall obtain and maintain a valid City
Business Registration Certificate during the term of this Agreement.
1.8. Duty of Loyalty/Conflict of Interest: The Consultant understands and
agrees that as the City's consultant, Consultant shall maintain a fiduciary duty and a duty
of loyalty to the City in performing Consultant's obligations under this Agreement.
Consultant, in performing its obligations under this Agreement, is governed by
California's conflict of interest laws, Government Code Section 87100 et seq., and Title
2, California Code of Regulations Section 18700 et seq.

2.0. COMPENSATION AND BILLING
2.1. Compensation. Over the term of this Agreement, Contractor shall be
compensated for such services for the fixed amount of $281,805.00 plus $863.00 per
hole for potholing as indicated in Attachment "2" attached and made a part
hereof.
2.2. Additional Services. Consultant shall not receive compensation for any
services provided outside the scope of services specified in this Agreement unless the
City, prior to Consultant performing the additional services, approves such additional
services in writing. It is specifically understood that oral requests and/or approvals of
such additional services or additional compensation shall be barred and are
unenforceable.
2.3. Method of Billing. Consultant may submit invoices to the City Engineer
for approval on a progress basis, but no more often than monthly. Said invoice shall be
based on the total of all of Consultant's services, which have been completed to City's
sole satisfaction. City shall pay Consultant's invoice within forty-five (45) days from the
date City receives said invoice. Each invoice shall describe in detail, the services
performed and the associated time for completion. Any additional services approved and
performed pursuant to this Agreement shall be designated as "Additional Services" and
shall identify the number of the authorized change order, where applicable, on all
invoices.

2.4. Records and Audits. Records of Consultant's services relating to this
Agreement shall be maintained in accordance with generally recognized accounting
principles and shall be made available to City or its City Engineer for inspection and/or
audit at mutually convenient times for a period of three (3) years from the Effective Date.
3.0. TIME OF PERFORMANCE
3.1. Commencement and Completion of Work. The professional services to be
performed pursuant to this Agreement shall commence within five (5) days from the
Effective Date of this Agreement. Said services shall be substantially completed within
six (6) months unless otherwise approved by the City Engineer. Failure to commence
work in a timely manner and/or diligently pursue work to completion may be grounds for
termination of this Agreement. It is recognized that some services, such as right-of-way
acquisition and decertification of existing operating State R/W, may take longer. Such
services shall be pursued to completion.
3.2. Excusable Delays. Neither party shall be responsible for delays or lack of
performance resulting from acts beyond the reasonable control of the party or parties.
Such acts shall include, but not be limited to, acts of God, fire, strikes, material shortages,
compliance with laws or regulations, riots, acts of war, or any other conditions beyond
the reasonable control of a party.

4.0. TERM AND TERMINATION
4.1. Term. This Agreement shall commence on the Effective Date and
continue until satisfactory completion of all work contemplated herein. All work shall be
completed within the timeframe and in accordance with the schedule as provided by the
City.
4.2. Notice of Termination. The City reserves and has the right and privilege
of canceling, suspending or abandoning the execution of all or any part of the work
contemplated by this Agreement,with or without cause, at any time, by providing written
notice to Consultant. The termination of this Agreement shall be deemed effective upon
receipt of the notice of termination. In the event of such termination, Consultant shall
immediately stop rendering services under this Agreement unless directed otherwise by
the City.
4.3. Compensation. In the event of termination, City shall pay Consultant for
reasonable costs incurred and professional services satisfactorily performed up to and
including the date of City's written notice of termination. Compensation for work in
progress shall be prorated as to the percentage of work completed as of the effective date
of termination in accordance with the fees set forth herein. In ascertaining the
professional services actually rendered hereunder up to the effective date of termination
of this Agreement, consideration shall be given to both completed work and work in
progress, to complete and incomplete drawings, and to other documents pertaining to the
services contemplated herein whether delivered to the City or in the possession of the
Consultant.
4.4 Documents. In the event of termination of this Agreement, all documents
prepared by Consultant in its performance of this Agreement including, but not limited
to, finished or unfinished design, development and construction documents, data studies,
drawings, maps and reports, shall be delivered to the City within ten (10) days of delivery
of termination notice to Consultant, at no cost to City. Any use of uncompleted
documents without specific written authorization from Consultant shall be at City's sole
risk and without liability or legal expense to Consultant.
5.0. INSURANCE
5.1. Minimum Scope and Limits of Insurance. Consultant shall obtain and
maintain during the life of this Agreement all of the following insurance coverages:
(a) Comprehensive general liability, including premises-operations,
products/completed operations, broad form property damage,
blanket contractual liability, independent contractors, personal
injury with a policy limit of not less than One Million Dollars
($1,000,000.00), combined single limits, per occurrence and
aggregate.

(b) Automobile liability for owned vehicles, hired, and non-owned
vehicles, with a policy limit of not less than One Million Dollars
($1,000,000.00), combined single limits, per occurrence and
aggregate.
(c) Workers' compensation insurance as required by the State of
California.
(d) Professional,errors and omissions ("E&O") liability insurance with
policy limits of not less than One Million Dollars ($1,000,000.00),
combined single limits, per occurrence and aggregate. Consultant
shall obtain and maintain, said E&O liability insurance during the
life of this Agreement and for three years after completion of the
work hereunder.
5.2. Endorsements. The comprehensive general liability insurance policy shall
contain or be endorsed to contain the following provisions:
(a) Additional insureds: "The City of San Bernardino and its elected
and appointed boards, officers, agents, and employees are addition-
al insureds with respect to this subject project and contract with
City."
(b) Notice: "Said policy shall not terminate, nor shall it be cancelled,
nor the coverage reduced, until thirty (30) days after written notice
is given to City."
(c) Other insurance: "Any other insurance maintained by the City of
San Bernardino shall be excess and not contributing with the
insurance provided by this policy."
5.3. Certificates of Insurance. Consultant shall provide to City certificates of
insurance showing the insurance coverages and required endorsements described above,
in a form and content approved by City, prior to performing any services under this
Agreement.
5.4. Non-limiting. Nothing in this Section shall be construed as limiting in any
way, the indemnification provision contained in this Agreement, or the extent to which
Consultant may be held responsible for payments of damages to persons or property.
6.0. GENERAL PROVISIONS
6.1. Entire Agreement. This Agreement constitutes the entire Agreement
between the parties with respect to any matter referenced herein and supersedes any and
all other prior writings and oral negotiations. This Agreement may be modified only in
writing, and signed by the parties in interest at the time of such modification. The terms

of this Agreement shall prevail over any inconsistent provision in any other contract
document appurtenant hereto, including exhibits to this Agreement.
6.2. Representatives. The Director of Development Services or her designee
shall be the representative of City for purposes of this Agreement and may issue all
consents, approvals, directives and agreements on behalf of the City, called for by this
Agreement, except as otherwise expressly provided in this Agreement.
Consultant shall designate a representative for purposes of this Agreement
who shall be authorized to issue all consents, approvals, directives and agreements on
behalf of Consultant called for by this Agreement, except as otherwise expressly
provided in this Agreement.
6.3. Project Managers. City shall designate a Construction Engineer to work
directly with Consultant in the performance of this Agreement.
Consultant shall designate a Project Manager who shall represent it and be
its agent in all consultations with City during the term of this Agreement. Consultant or
its Project Manager shall attend and assist in all coordination meetings called by City.
6.4. Notices. Any notices, documents, correspondence or other
communications concerning this Agreement or the work hereunder may be provided by
personal delivery, facsimile or mail and shall be addressed as set forth below. Such
communication shall be deemed served or delivered: a) at the time of delivery if such
communication is sent by personal delivery; b) at the time of transmission if such
communication is sent by facsimile; and c) 48 hours after deposit in the U.S. Mail as
reflected by the official U.S. postmark if such communication is sent through regular
United States mail.

6.5. Attorneys' Fees. In the event that litigation is brought by any party in
connection with this Agreement, the prevailing party shall be entitled to recover from the
opposing party all costs and expenses, including reasonable attorneys' fees, incurred by
the prevailing party in the exercise of any of its rights or remedies hereunder or the
enforcement of any of the terms, conditions, or provisions hereof. The costs, salary and
expenses of the City Attorney and members of his office in enforcing this contract on
behalf of the City shall be considered as "attorneys' fees" for the purposes of this
paragraph.

6.6. Governing Law. This Agreement shall be governed by and construed
under the laws of the State of California without giving effect to that body of laws
pertaining to conflict of laws. In the event of any legal action to enforce or interpret this
Agreement, the parties hereto agree that the sole and exclusive venue shall be a court of
competent jurisdiction located in San Bernardino County, California.
6.7. Assignment. Consultant shall not voluntarily or by operation of law
assign, transfer, sublet or encumber all or any part of Consultant's interest in this
Agreement without City's prior written consent. Any attempted assignment, transfer,
subletting or encumbrance shall be void and shall constitute a breach of this Agreement
and cause for termination of this Agreement. Regardless of City's consent, no subletting
or assignment shall release Consultant of Consultant's obligation to perform all other
obligations to be performed by Consultant hereunder for the term of this Agreement.
6.8 Indemnification and Hold Harmless. Consultant shall protect, defend,
indemnify and hold harmless City and its elected and appointed officials, officers, and
employees from any and all claims, liabilities, expenses, including attorney fees, damage
to property or injuries to or death of any person or persons or damages of any nature
including, but not by way of limitation, all civil claims or workers' compensation claims,
arising out of or in any way connected with the intentional or negligent acts, errors or
omissions of Consultant, its employees, agents or subcontractors in the performance of
this Agreement.
6.9. Independent Contractor. Consultant is and shall be acting at all times as an
independent contractor and not as an employee of City. Consultant shall secure, at his
expense, and be responsible for any and all payment of Income Tax, Social Security,
State Disability Insurance Compensation, Unemployment Compensation, and other
payroll deductions for Consultant and its officers, agents, and employees, and all business
licenses, if any are required, in connection with the services to be performed hereunder.
6.10 Ownership of Documents. All findings, reports, documents, information
and data including, but not limited to, computer tapes or discs, files and tapes furnished
or prepared by Consultant or any of its subcontractors in the course of performance of
this Agreement, shall be and remain the sole property of City. Consultant agrees that any
such documents or information shall not be made available to any individual or
organization without the prior consent of City. Any use of such documents for other
projects not contemplated by this Agreement, and any use of incomplete documents, shall
be at the sole risk of City and without liability or legal exposure to Consultant. City shall
indemnify and hold harmless Consultant from all claims, damages, losses, and expenses,
including attorneys' fees, arising out of or resulting from City's use of such documents
for other projects not contemplated by this Agreement or use of incomplete documents
furnished by Consultant. Consultant shall deliver to City any findings, reports,
documents, information, data, in any form, including but not limited to, computer tapes,
discs, files audio tapes or any other Project related items as requested by City or its
authorized representative, at no additional cost to the City.

6.11 Public Records Act Disclosure. Consultant has been advised and is aware
that all reports, documents, information and data including, but not limited to, computer
tapes, discs or files furnished or prepared by Consultant, or any of its subcontractors, and
provided to City may be subject to public disclosure as required by the California Public
Records Act (California Government Code Section 6250 et. seq.). Exceptions to public
disclosure may be those documents or information that qualify as trade secrets, as that
term is defined in the California Government Code Section 6254.7, and of which
Consultant informs City of such trade secret. The City will endeavor to maintain as
confidential all information obtained by it that is designated as a trade secret. The City
shall not, in any way, be liable or responsible for the disclosure of any trade secret
including, without limitation, those records so marked if disclosure is deemed to be
required by law or by order of the Court.
6.12. Responsibility for Errors. Consultant shall be responsible for its work and
results under this Agreement. Consultant, when requested, shall furnish clarification
and/or explanation as may be required by the City's representative, regarding any
services rendered under this Agreement at no additional cost to City. In the event that an
error or omission attributable to Consultant occurs, then Consultant shall, at no cost to
City, provide all necessary design drawings, estimates and other Consultant professional
services necessary to rectify and correct the matter to the sole satisfaction of City and to
participate in any meeting required with regard to the correction.
6.13. Prohibited Employ. Consultant will not employ any regular
employee of City while this Agreement is in effect.
6.14. Order of Precedence. In the event of an inconsistency or conflict in this
Agreement and any of the attached Exhibits or Attachments, the terms set forth in this
Agreement shall prevail.
6.15. Costs. Each party shall bear its own costs and fees incurred in the
preparation and negotiation of this Agreement and in the performance of its obligations
hereunder except as expressly provided herein.
6.16. No Third Party Beneficiary Rights. This Agreement is entered into for the
sole benefit of City and Consultant and no other parties are intended to be direct or
incidental beneficiaries of this Agreement and no third party shall have any right in,
under or to this Agreement.
6.17. Headings. Paragraphs and subparagraph headings contained in this
Agreement are included solely for convenience and are not intended to modify, explain or
to be a full or accurate description of the content thereof and shall not in any way affect
the meaning or interpretation of this Agreement.
6.18. Construction. The parties have participated jointly in the negotiation and
drafting of this Agreement. In the event an ambiguity or question of intent or
interpretation arises with respect to this Agreement, this Agreement shall be construed as

if drafted jointly by the parties and in accordance with its fair meaning. There shall be no
presumption or burden of proof favoring or disfavoring any party by virtue of the
authorship of any of the provisions of this Agreement.
6.19 Amendments. Only a writing executed by the parties hereto or their
respective successors and assigns may amend this Agreement.
6.20. Waiver. The delay or failure of either party at any time to require
performance or compliance by the other of any of its obligations or agreements shall in
no way be deemed a waiver of those rights to require such performance or compliance.
No waiver of any provision of this Agreement shall be effective unless in writing and
signed by a duly authorized representative of the party against whom enforcement of a
waiver is sought. The waiver of any right or remedy in respect to any occurrence or
event shall not be deemed a waiver of any right or remedy in respect to any other
occurrence or event, nor shall any waiver constitute a continuing waiver. -
6.21. Severability. If any provision of this Agreement is determined by a court
of competent jurisdiction to be unenforceable in any circumstance, such determination
shall not affect the validity or enforceability of the remaining terms and provisions hereof
or of the offending provision in any other circumstance.
6.22. Counterparts. This Agreement may be executed in one or more
counterparts, each of which shall be deemed an original. All counterparts shall be
construed together and shall constitute one agreement.
6.23. Corporate Authority. The persons executing this Agreement on behalf of
the parties hereto warrant that they are duly authorized to execute this Agreement on
behalf of said parties and that by doing so, the parties hereto are formally bound to the
provisions of this Agreement.

Hall&Foreman, Inc.(HFI) is an excellent choice for the realignment project that the City of San Bernardino is
undertaking. HFI specializes in these type of projects and is currently working on Century Vintage Homes'adjoining
residential development tract and on the Glen Helen Parkway project across from I-215.The team members
proposed for this project were selected for their expertise and knowledge of the project site and the issues/concerns
involved.They are in constant communication with the developers and agencies currently involved and have the City's
best interests at heart.
As HFI understands it, the immediate need is to assemble a qualified team who can investigate realignment

Section 1 Project Understanding
Scope of The City of San Bernardino is seeking the engineering and surveying services of a
Services consulting team to provide the design, right-of-way,and environmental approval for the
realignment of an existing frontage road and extension of a roadway along the northeast
side of the I- 215 Freeway from Little League Drive to the intersection of Dement Street
and Cable Canyon Road.The existing roadway alignment is adjacent to Cable Creek and
within Caltrans right-of-way.The roadway will be designed as a City collector street with
' r a 60 feet of right-of-way; 40 feet curb face to curb face. A traffic signal will need to be
Y designed for the intersection of the proposed roadway and Little League Drive
One of the main issues with the proposed roadway alignment is that the roadway is
IIA r adjacent to Cable Creek. Recent storm events,following the Grand Prix and Old fires,
+ a 1
have created substantial amounts of debris flow.The design of the roadway will have to
take into account that the elevation of the roadway surface needs tone above the
flooded water surface elevations to provide an all weather road and the protection of the
roadway with rip-rap to prevent erosion of the side slopes. HFI plans to utilize
information gained from the design of the Rolling Hills Rancho development to assist in
the design of the road surface elevations and roadway slope protection.
K' Another issue is the acquisition of right-of-way from both public agencies and private
owners to accommodate the most efficient alignment.A significant proportion of the
roadway will be in Caltrans right-of-way.
A 24-inch water line is to be designed and plan checked for approval as well as a 12-inch
sewer line from Little League Drive to the Rolling Hills Ranch subdivision's main entryway
approximately 1,000 If (See Exhibits at the end of this section).
Hydrology and hydraulic calculations for Cable Creek Road are presently being done to
ensure adequate protection for the subdivision (Rolling Hills Ranch Tract 34747).These
calculations can be adopted for the protective design of the road from the northwest
corner of the subdivision to Cable Canyon Road(Dement Road).
HFI has through its preliminary studies, research,and meetings with San Bernardino's
Redevelopment Agency and San Bernardino County Flood Control District(SBCFCD)for
the adjacent subdivision gained an in-depth understanding of the problems and solutions
liy affecting the road design. Problems including the horizontal and vertical alignment,flood
` control,and protection of the roadway have presented themselves. Environmental
constraints have also been discussed in detail.
In order for the Tentative Tract 34747 to not be subject to mitigation, the suggested
design and construction of the road project should be done in no less than two phases.
Phase 1 would include construction of Little League Drive to the northwest corner of the
subdivision. Phase 2 should be from the northwest corner to Dement Road.
It is anticipated that the construction of a temporary access road will be built from Little
League Drive to the existing Frontage Road,as necessary to give access to the existing
pet cemetery and residential homes(See Exhibits at the end of this section).
Trappings were completed for this project area in the year 2004. However, because two
years have passed,Agency may request new biological surveys.

Section 1 Scope of Services
Scope of
Services PHASE A:PRELIMINARY DESIGN
Task 1-Meetings
The HFI team will arrange a kick-off meeting within one week of the notice to
proceed.
HFI will meet with the City staff during the preliminary design phase to resolve issues
and ensure continuity with City standards and preferences(we will plan for a
minimum of one meeting a week)During the Engineering phase, the team will meet
with the City on a bi-weekly basis for updates on the project progress,concerns
III problems and accomplishments
Task 2- Project Schedule
HFI will prepare an updated project schedule for presentation and discussion at the
kick-off meeting within one week of the notice to proceed.The-project schedule will
indicate the design tasks and projects timing from stat to submittal of final PS&E.
HFI will provided the City with an updated schedule every two weeks indicating
progress and the effect on the proposed milestones.
Task 3-Utility Research
HFI will conduct utility research and identify the location and depth of all existing
utilities as identified by Underground Service Alert(USA)within the limits of the
project. HFI will contact all utilities indicted by USA by written correspondence to
make the company aware of the proposed project, request their drawings to
determine existing utility fine locations and inquire about any plans for any future
utility work. HFI will provide research as required to complete any removal,
relocation,or adjustment to any existing utility facilities where conflicts are
anticipated.All existing utility facilities as shown on drawings provide by the utility
`"" companies drawings will be shown on the roadway drawings. Copies of all written
communications and copies of drawings provided by the utility companies will be
provided to the City.
Task 4-Right-of-Way Research
HFI will conduct the necessary research to determine the existing public right-of-way
and identify the required right-of-way needed to construct the proposed
improvements.
PHASE B:ENGINEERING
HFI will provide surveying and engineering services to prepare and complete required
construction documents, including plans,specifications,and cost estimates'for the
following items:
Task 1-Roadway Design,Signing and Striping,Street Light
(from Little League Drive to Dement Street/Cable Canyon Road)
Task 1B-Design Survey
Design of the proposed collector road to eliminate the substandard reverse curve
northwest of the intersection with Little League Drive, including necessary
modifications to the intersection.
Design of the proposed collector road through the proposed subdivision

Design of a traffic signal for the intersection of the proposed collector road with Little

.. y HFI will prepare the improvement plans, specifications,and cost estimates for the project in conformance with City of San Bernardino standards, Caltrans standards,
and the requirements of the Manual of Uniform Traffic Control Devices(MUTCD)and
California Supplement, latest edition.
Plans,specifications,and estimate shall conform to the following requirements:
a) The plans will be prepared at a scale of 1 inch = 40 feet on standard
24"by 36"sheets, using the City of San Bernardino standard title block.
b) The plans will clearly show existing conditions, including but not limited to,
the location and type of signing and striping, pavement markings, storm drain
facilities and street condition.
c) HFI will be responsible for survey, research and other data or work needed to
establish existing topography,lines and grades. Information readily available
from City files will be made available to the consultant at no charge.
d) Street improvement plans will clearly indicate the type and location of existing
and proposed storm drain and street improvements, including but not limited to
curbs,gutters,curb ramps,cross gutters,and streetlights.
e) A separate signing and striping plan sheet will be included showing the type
and location of existing and proposed signing and striping, including but not
limited to lane striping,stop bars,cross walks,pavement markings, raise
pavement markers and any other traffic control devices.The signing and striping
plan sheet will be drawn to a scale of 1" = 40"on a 24"x 36" sheet, which will
include a Standard title block of the City of San Bernardino.
f) All improvements will be designed in compliance and accordance with the
Americans with Disabilities Act(ADA).
g) The street improvement plans will include, but not be limited to,curbs,
gutters, berms, and curb ramps. Limits of pavement,sawcuts, removals and
construction should also be shown. Improvements,which are intended to be
completed in the future,will be clearly identified as"Future Improvements".

Section 1 h) The plans, specifications and cost estimates will be signed and sealed by a
Scope of civil engineer licensed to practice civil engineering in the State of California.
Services
Task 4- Right-of-Way
Identify need for additional right-of-way for the extension of the proposed collector
road both for the alignment near Little League Drive and southeast of Dement Street/
Cable Canyon Road. HFI will prepare legal descriptions, plats,and secure title
reports for the right-of-way to be acquired.
aw■N Acquire right-of-way and permits from public agencies.
Communication with and acquisition of the right-of-way from private property owners
will be the responsibility of the City.
If condemnation becomes necessary, HFI will provide necessary title documents,
engineering documents, communication,etc. necessary to support the eminent
domain process
Task 5-Environmental Documents,Approvals,and Permits
This Scope of Services is based on the following assumptions:
■ The proposed Project will require a Section 404 permit from the U.S. Army
Corps of Engineers.
■ The proposed Project will require a Section 401 certification from the
Regional Water Quality Control Board.
■ The proposed Project will require a Streambed Alteration Agreement from
the California Department of Fish and Game.
■ As part of the processing of the Section 404 permit application,a Section 7
consultation between the Corps of Engineers and the U.S. Fish and Wildlife
Service will be required.
■ No state ESA compliance will be needed.
SSI's Scope of Services will consist of the following:
Aid in Defining Project
Solution Strategies,Inc. (SSI)will review project design and provide comments to
ensure that the project is feasible to permit.
Aid in CEQA Compliance
SSI will review and comment on technical studies relevant to permit processing
issues and attend meetings with the City and its consultants,when requested.
Analysis of State and Federal ESA Requirements
SSI will aid in determining any requirements for the project pursuant to the state
and/or federal ESAs. SSI, with the aid of the biological consultant, will prepare any
supplemental information that may be necessary. SSI will oversee the processing of
any ESA compliance documents.
Analysis of Mitigation Requirements
SSI will aid in determining the mitigation proposal(s)for permits and ESA issues.
SSI will work with the revegetation/restoration or biological consultant to prepare the
habitat mitigation and monitoring plans by reviewing and commenting on such
documents.

Section 1 Collect Needed Documentation
Scope Of SSI will collect the necessary documentation to compile and process the permit
Services applications. Where the information/documentation is not available, SSI will work
with the Client and team to select the appropriate consultant and develop a suitable
scope of work to supply the information/documentation.
Prepare and File Regulatory Permit Applications
SSI will obtain current application forms from the USACOE, RWQCB,and the CDFG
websites SSI will collect all relevant information to complete the data fields.This
collection also may require a site visit for observation, field notes,and/or
photography. SSI will draft the applications and coordinate with a consultant of
Client's choice for the preparation of required exhibits, if any.
Client Review of Applications
Applications will be reviewed by Client prior to submittal. SSI will meet with Client to
present the draft applications and answer any immediate questions.After review of
draft documents, necessary changes will be made.
Submit Applications to Respective Agencies
SSI will submit the applications in the agency-preferred formats with the necessary
exhibits.A copy of each application will be supplied to Client. Extra copies can be
provided on request.
SSI will communicate the agency fee requirements to Client approximately one week
prior to submittal. SSI does not advance the application fees on behalf of Client.
Coordinate Agency Review and Processing of Project
SSI will communicate with the agency staff(s)to follow-up on the processing after
granting an approximately four-week grace period. By that time,the documents
should have moved up the processing line and should be on the"radar screens"of
the regulators.Contact would be for the purpose of verbally framing the application
in the minds of the staff members and for the purpose of attempting to spur the
process along.SSI will continue coordination with the agencies until the permits are
received.
ECORP Consulting, Incas Scope of Services will consist of the following:
Based on previous experiences with the area,focused surveys for coastal California
gnatcatcher(Polioptila californica californica),San Bernardino kangaroo rat
(Dipodomys merriami parvus),various listed/sensitive plants,and a wetland
delineation survey will likely be required for CEQA documentation and permitting
associated with the road alignment and extension.The ECORP Team will implement
the tasks necessary to implement and complete the California Environmental Quality
Act(CEQA)consultation process with the California Department of Fish and Game
(CDFG)and National Environmental Policy Act(NEPA)consultation process with the
U.S.Army Corps of Engineers(ACOE)and the U.S. Fish and Wildlife Service
(USFWS).The services that will be provided under this task include:
■ assistance with project-related negotiations;
■ a literature review, biological reconnaissance survey,and biological technical
report of findings;
■ focused wildlife and plant surveys;
■ jurisdictional delineation and report;and,
Section 1 ■ preparation of a preliminary draft, draft, and final draft of the Biological
Scope of Assessment and incorporation of Client,Team, and Agency comments into
Services these documents.
The following paragraphs describe these services in more detail.
Assistance with Project-Related Negotiations
The ECORP Team will assist the Client with all project related negotiations by aiding
in the preparation of client position statements, in gathering intelligence related to
the project, in the management of the political climate in relation to the project,and
in participating in negotiations with the resources agencies and other stakeholders.
As necessary, various members of the ECORP Team will attend meetings with Hall&
Foreman and the various stakeholders/interested parties that will become active at
some point in the process of gaining approvals for the I-215 Realignment and
Extension Project.
The actual number of meetings required for this task is unknown but we will assume
the following number of hours will be provided by ECORP.
Literature Review and Biological Reconnaissance Survey and Report
Prior to conducting a biological survey of the project, ECORP will conduct a literature
review of the California Natural Diversity Data Base and the California Native Plant
Society's Electronic Inventory to identify listed and/or sensitive plant and wildlife
species that have previously been recorded on or in the vicinity of the site. In
addition, ECORP will review any known previous biological reports that were written
for the site. Following the literature review, ECORP will conduct a biological
reconnaissance survey of the site for the purpose of documenting existing biological
conditions and determining the potential for listed and/or sensitive plant and wildlife
species to occur. ECORP's biologists will walk the proposed realignment area and
document the plant and wildlife species observed during the survey. In addition,the
biologists will map the vegetation communities that occur on site and will take
photographs for the purpose of documenting the current conditions.
Following the completion of the survey, ECORP will prepare a technical report of
findings.The report will document the existing biological conditions and, based on
the existing conditions,determine the potential for listed or sensitive species to occur
on the site.The report will contain approximately 25 pages of text and approximately
10 graphics(including location,vicinity,vegetation maps,and site photographs).
Focused Coastal California Gnatcatcher Surveys
In the event that suitable habitat for the coastal California gnatcatcher(CAGN)is
identified during the biological reconnaissance survey,focused surveys would be
conducted in order to determine presence/absence of this federally threatened bird
species. Protocol-level CAGN surveys would be conducted during the 2007 breeding
season (March 15 to June 30)in areas that are determined to have suitable sage
scrub habitat.A notification letter would be prepared and submitted to USFWS at
least 10 days prior to starting focused surveys. Six(6)weekly surveys would be
conducted by a biologist that has a 10(a)(1)(A) permit for surveying for CAGN.
Surveys would be conducted between 0600 and 1200. No more than 80 acres of
suitable habitat would be surveyed per biologist per day and surveys would not be
conducted during unsuitable weather conditions(=550F, no excessive fog,wind, rain,
heat).Surveys would consist of slowly walking various routes throughout suitable
habitat within 300'of proposed construction activities.The surveyor(s)would play a

coordinates and noting the locations on maps and field forms.
A technical report of findings will be prepared and 1 copy of the report will be
submitted to U.S. Fish and Wildlife Service within 45 days of completion of the final
survey per 10(a)(1)(A)permitting requirements. Results of the CAGN focused surveys
will be summarized in the biological reconnaissance report and the CAGN technical
report will be included as an appendix.
San Bernardino Kangaroo Rat Trapping Surveys
If sign of kangaroo rats is observed during the reconnaissance survey or if the habitat
seems particularly suitable for San Bernardino kangaroo rats(SBKR), subsequent
trapping surveys would be conducted to determine presence/absence of this federally
endangered mammal species.Trapping would follow the existing protocol,consisting
of 5 consecutive nights with Sherman 12-inch live traps set in locations with the
highest likelihood of capturing target species.Trapping can occur any time of year
since this species is active year round. But trapping would be conducted when the
ground conditions would be dry and, ideally, later in the year when the majority of
annual grasses and forbs have died back(April -September).
Following completion of the trapping surveys,a technical report of findings will be
prepared in accordance with 10(a)(1)(A)permitting requirements. Results of the
P` trapping surveys will be summarized in the biological reconnaissance report and the

SBKR technical report will be included as an appendix.
Focused Plant Surveys
In the event that potential habitat for listed and/or sensitive plant species is identified
during the biological reconnaissance survey, focused plant surveys would be
conducted to determine the presence or absence of these species. Surveys would
focus on any federal-listed,state-listed,or CNPS List 1A, 16, 2, and 3 species with
potential to occur on the project site.The focused plant surveys will provide 100%
coverage of the project area in accordance with the California Native Plant Society
Botanical Survey Guidelines.The surveys would be conducted during the blooming
period of listed and/or sensitive plant species that are determined to have potential
to occur on site in order to maximize detection and identification of these species.
Results of the focused plant surveys will be summarized in the biological
reconnaissance report
Jurisdictional Delineation and Report
ECORP will conduct a jurisdictional delineation of the existing frontage road,
proposed realignment area,and the area where the road extension will be placed.
The delineation will identify the current boundaries of U.S.Army Corps of Engineers
(ACOE)and California Department of Fish and Game(CDFG)jurisdictions.The field
assessment will include evaluating the habitats, soils,and hydrology in the drainages
and mapping of the ACOE and CDFG jurisdiction in each of the drainages.
The dominant vegetation type in the drainages and soil delineations of potential
streambed/wetland areas will be discussed in a delineation report. The report will
include a hydrology analysis in relationship to state and federal requirements and
jurisdictional determinations in acreage. In addition, the direct and indirect impacts

Section 1 of the proposed project on streambed/wetlands will be determined and an evaluation
Scope Of of the perceived cumulative biological impacts, if any, to streambed/wetlands
Services associated with the project will be made. Results of the jurisdictional delineation will
be summarized in the biological reconnaissance report and provided to the client as a
separate report(as required for permit applications).
Biological Assessment
If focused surveys determine the presence of federally listed plant or wildlife species
at the project site, members of the ECORP team will attend an Informal Consultation
meeting with USFWS to discuss the agency's concerns and the plan for moving
ahead with a Section 7 Consultation. Based on the outcome of this meeting,the
ECORP Team will investigate potential mitigation options that will offset the impacts
of the development of the I-215 Realignment and Extension Project.The ECORP
Team will work closely with HFI to determine the content of the Project Description
for the Biological Assessment.A draft of the Project Description will be provided to
the Client for review and comment. If applicable,this Project Description can be
provided to the USFWS during Informal Consultation to determine whether changes
need to be made prior to the initiation of Formal Consultation.The Project
Description will become part of the Biological Assessment.
The ECORP Team will prepare a Biological Assessment for the impacts to federally
listed plant or wildlife species that are determined to occur on site.The format of the
Biological Assessment(BA) will follow the U.S. Fish and Wildlife Service's
Endangered Species Consultation Handbook.The BA will include the following
sections: Introduction,History of Coordination with the Agencies, Project Description,
General Environmental Setting, Listed Species and Assessment of Habitat, Impact
Assessment,Conclusion and Determination, References, List of Preparers,and
Appendices.The ECORP team will work closely with the Client in the preparation of
the BA.The BA will likely contain approximately 30 to 50 pages of text and 5 to 10
graphics.In addition, it will contain approximately 60 pages of appendices.
ECORP will provide the Client and the Team with five copies(3 to the Client and 2 to
Solution Strategies)of a preliminary draft of the BA for review and comment. ECORP
will then incorporate the comments from the Team into the Draft BA that will be
submitted to the Corps of Engineers and USFWS. ECORP will provide the Client with
five copies of the Draft BA prior to the submittal to ACOE and FWS. If necessary,
ECORP will also prepare a Final Draft of the BA that incorporates comments from
both the ACOE and USFWS. Five copies of the Final Draft BA will be provided to the
Client.
Task 6-Potholes
Pothole existing underground utilities where a high probability for conflict exists.

Mr. Bierman has over 35 years of civil engineering experience in the management and
engineering of drainage projects,site development,freeway and airport drainage
projects,commercial, industrial and residential site improvements. He recently managed
and designed projects for the Cities of Ontario, Upland,Rialto,and Fontana; and the San
Bernardino County Flood Control District, Mr. Bierman's experience includes design of
plans for sewers,streets,storm drains,water conveyance and grading;development of
Master Plans of Drainage;and drainage systems designs.
Project Experience
9th Street Reconstruction, Upland: (Project Manager) HFI was contracted for this
east/west directional transportation corridor that carries approximately 8,500 vehicles per
day and serves as a truck route through the City of Upland. HFI provided professional civil
engineering and design services for the street reconstruction and water infrastructure
improvements for 9th Street between San Antonio Avenue and Euclid Avenue(Route 83).
The project includes a water line replacement in 9th Street from Garnet Way to Euclid
Avenue, upgrades to curb returns to meet ADA approved requirements,and permits and
review by Caltrans for right-of-way.Specifically HFI's work included a topographic survey;
geotechnical investigation; preparation of street improvement plans and profiles,water
main improvement plans and profiles,signing and striping plans, traffic control plans,and
special provisions to meet City standards; preliminary and final engineer's cost estimates,
and preparation of as-built plans upon project completion.
Citrus Avenue Widening,Fontana:(Project Manager)Provided engineering services
for approximately one mile of street widening at Citrus Avenue, a showcase project due to
its location as an off ramp for the new Route 210 freeway.The project included improve-
ments for widening the roadway from two to four lanes, storm drains, landscaping,
lighting,traffic signals,and sewers.The scope of work also included the design of drive-
ways;preparation of right-of-way acquisition documents for adjacent residential proper-
ties that were impacted by the increase in right-of-way width; and sewer laterals to
homeowners adjacent to the project who are presently on septic tank systems.The total
construction for the project was approximately$3.5 million.
"A"Street, Upland: (Project Manager) Mr. Bierman served as the Project Manager for
the design of this Metrolink station frontage street.The project included roadway rehabili-
tation,street widening,and an at-grade railroad crossing for approximately 1,500 feet of
street.The work also included station parking improvements,design of a drop off area,
landscaping and cross walk pavement enhancement.
State Route 30,SANBAG/Caltrans:(Project Manager) Responsibilities for hydrology/
hydraulic studies,storm drain design,quantity estimates and specifications for offsite
drainage facilities within several segments of this freeway. Design included large diameter
pipes carrying storm water under the depressed freeway.
Section 2 Cherry Avenue,County of Los Angeles: (Project Manager) Mr. Bierman was respon-
Project Team sible for the design of one mile of arterial highway through two cities and the county. The
design included street widening, utility relocations, and a 60-inch storm drain with the
associated laterals and catch basins. Coordination with adjacent property owners, which
included the redesign of driveways and additional right-of-way requirements, presented
challenges in this assignment.
Inverness Drive,La Canada/Flintridge: (Project Manager)Project includes a slope
failure on Inverness Drive. Intense rains from the storms of 2004/2005 caused two
sections of the road to fall away. One section was 90'and one section was 40. HFI was
responsible for the analyses and research for providing recommendations to the City along
with design of the roadway and utility replacement and PS&E. HFI also provided laser
scanning services and forensic investigation to determine damage and to minimize safety
hazards. Project is ongoing and the cost is approximately$1 million.
Santa Ana Avenue, Rialto: (Project Manager)Responsible for on-site hydrology study,
storm drain design and design of Santa Ana Avenue adjacent to the City of Rialto's
treatment plant.
Riverside Drive Sidewalk Project Between Clover Lane and Colony High School,
Ontario:(Project Manager)The City needs to provide protection for High School students
by providing sidewalk improvements along the south side of Riverside Drive from the
Colony High School west to Clover Lane.A recent accident in the City of Fontana in which
a car hit a student as she walked along the edge of the roadway made the need for a
sidewalk very clear. Uncontrolled mid-block pedestrian crossings needed to be discouraged
by providing safe access to a signalized intersection.The land use adjacent to this road-
way is dairy pens and sheds. HFI investigated sidewalk alternatives.All alternatives will
take into account the existing storm drain inlets near the edge of pavement, existing poles
adjacent to the roadway,driveways that serve adjacent properties,and areas where
bushes intrude into the walkway.
Public Works Plan Review Services,San Bernardino: (Project Manager)HFI was
selected in 2006 to provide plan checking services for the City of San Bernardino on an on-
call basis.The project requires coordination with the City and County. Plan checking
services for the City include, but are not limited to; research and review of street,sewer
and storm drain improvement plans; rough and precise grading plans; hydrology/hydrau-
lics reports; retaining wall and other structural design calculations;tract and parcel maps;
right of way and easement documents;traffic signal plans and studies.After the review,
HFI prepares correction letters and logs containing necessary corrections to make the
maps acceptable for recording.
On-Call Engineering Services,County of San Bernardino: (Project Manager)HFI is
providing County of San Bernardino staff with on-call services for Capital Improvement
Projects(CIP).The scope of services includes street and trails construction/design,traffic
signal design,signing and striping,water quality management,sanitary sewer design/
waterlines,surveying and mapping,geotechnical,grading,street design,storm drain
design,potholing, aerial photography, landscape design,and community outreach as
needed.Services also include coordination of projects with other public agencies and
utility companies. Engineering fees are based on an hourly rate schedule.

Carbon Canyon Road(SR 142)Road Reconstruction/Widening,Brea:(Principal in
Charge)Prepared plans and cost estimates for the reconstruction of Carbon Canyon Road
within a 120-foot-wide right of way from Valencia Avenue to 5,000 feet East of Valencia
Avenue in the City of Brea.The project was completed to supplement Developer
improvements for Olinda Heights residential tract. Project included four phases of
construction including traffic control plans,construction staging plans and traffic signal
modification plans for each phase.The pavement section included treated permeable
base and sub-drain systems.This project also included relocation of transmission lines
for Southern California Edison, preparation of plans for 4,800 feet of an 18-inch water
main and 78-inch, 1,400-foot-long storm drain.
Yucaipa Boulevard Street Rehabilitation,Yucaipa: (Principal in Charge)HFI
prepared street rehabilitation plans for improvements to three miles of the eastbound
traffic lanes for Yucaipa Boulevard,a major arterial street, from 7th Street to 11th Street
including improvements to the Yucaipa Boulevard and Oak Glen Road intersection.The
project was completed to supplement Developer improvements to the westbound traffic
lanes constructed at the same time for the Chapman Heights Development. HFI's services
included field review to identify areas of major distress and cracking requiring removals of
the existing roadway pavement section versus those that would require a two-inch
asphaltic concrete overlay only.Construction plans were produced using existing street
improvement plans. HFI's efforts also included coordination with local street contractors to
obtain competitive bids and review of the Contractor bids for completeness. HFI also
provided support staff to assist the City Street Superintendent for inspection of the final
street improvements.
Antonio Parkway Street Widening/Resurfacing,County of Orange: (Principal in
Charge)Prepared final plans for widening and resurfacing of a one-mile segment of
Antonio Parkway adjacent to the planned community of Ladera Ranch.Widening consisted
of adding split-level roadway section with a 20 foot,landscaped median to widening the
existing four-lane roadway to a 6-lane divided major arterial. Field survey services were
provided to identify as-built conditions for the existing roadway in order to accommodate a
resurfacing of the existing pavement. Other improvements included:storm drain,OCTA
bus bays,signing and striping plans,and a signal plan for the future Covenant Hills Road
intersection.

Section 2 Chase Drive Phase III Street Improvements,Corona: (Principal in Charge)Project
Project Team includes 1,700 feet of street improvement from Garrettson Avenue to Sonrisa Drive.
Improvements include removal and replacement of AC pavement, removal of existing
parkway culverts,addition of curb and gutter, bike path,parkway landscaping, relocation
of adult palm trees on south side of the roadway, and a storm drain line to connect with
the existing drainage system at the intersection of Garrettson Avenue and Chase Drive.
Landscape improvements will extend to the property line of each resident. Improvements
also include relocation of existing electrical poles on the north side of the roadway,
relocation,or removal and replacement,of existing 35 mph speed limit sign, and the
removal of existing citrus trees and shrubs within the right of way.
Clearglen Avenue Rehabilitation, Los Angeles County Department of Public
Works: (Principal in Charge)This rehabilitation project entailed three phases including
preparation of a Materials Report recommending alternatives based upon field test data.
HFI conducted topographic and design surveys; prepared a Project Design Concept Report
(PDC)to describe the costs,schedule,details,and limits of the road improvements;
prepared PS&E for roadway and traffic rehabilitation improvements to be used for obtain-
ing contract bids; provided construction services,as requested,for BFI's and plan and
quantity changes;and prepared"as-built"plan revisions to reflect all changes made
during construction. Field review of the project was conducted in accordance with DPW
guidelines and rehabilitation improvements to include drainage; removal of slotted cross
gutters and parkway culverts; repair/replacement of concrete sidewalk,curb and gutter,
ADA ramps,and driveways; replacement/upgrade of guard rails and signal heads; re-
striping of traffic lanes; bus pads;and other miscellaneous items.
Brea Boulevard,Brea:(Project Manager)Prepared the widening of a 3-mile street
segment,including right-of-way engineering,significant private property modifications,
major utility relocation,Edison under-grounding of transmission and distribution lines,
railroad crossing improvements and improved track crossing material, eight new signal-
ized intersections, landscape and hardscape including colored concrete intersection
improvements.To meet the Caltrans design standards,the street storm drain system was
expanded.Caltrans was involved in the approval process for the intersection improve-
ments at Imperial Highway,State Route 90. (Construction Manager)responsible for the
major task of implementing the construction staging to maintain adequate traffic flow,
maintain access to the local businesses,and maintain utility services during construction.
All projects were successful in meeting design and construction deadlines and costs were
maintained within the approved budgets.

segment through downtown.As lead consultant, responsible for coordination with Caltrans
Project Management Section,preparation of the State Partnership Agreement, right-of-
way engineering, appraisal and acquisition services, in accordance with Caltrans guide-
lines, project study report, project report and fact sheets, plan and specification prepara-
tion in accordance with Caltrans requirements,geotechnical investigation,and pavement
reconstruction requirements. Project spanned 10 years from conceptual studies to funding

street rehabilitation plans for improvements to three miles of the eastbound traffic lanes
for Yucaipa Boulevard,a major arterial street,from 7th Street to 11th Street including

a car hit a student as she walked along the edge of the roadway made the need for a
sidewalk very clear. Uncontrolled mid-block pedestrian crossings needed to be discouraged
by providing safe access to a signalized intersection.The land use adjacent to this road-
way is dairy pens and sheds. HFI investigated sidewalk alternatives.All alternatives will
take into account the existing storm drain inlets near the edge of pavement, existing poles
adjacent to the roadway,driveways that serve adjacent properties, and areas where
bushes intrude into the walkway.

Street Slope Failure,La Canada/Flintridge:(Staff Engineer)Project areas include a
slope failure on Inverness Drive that took out an important roadside and a crib wall failure
on Foothill Blvd. From the beginning there were challenges to these projects that required
creative and innovative technology.Inverness Drive is a residential street that connects
hillside residents with the City.The intense rain caused two sections of the road to fall
away.The sections included one 90'section and one 40'section,which left the road
impassable by any vehicles.The road is located on a steep slope surrounded by hills and
valley that made it extremely difficult to access the areas of failure for investigation and
surveying.Another challenge to both City projects has been the involvement of the com-
munity.Several residents have portions of their land that are affected by the storm
damage.This project is ongoing has proven to be both a challenge and a reward to HFI's
team.

included compaction,Proctor,and R-value testing of the roadway embankment,structure
materials,and aggregate base;AC paving testing of asphalt concrete;and concrete
cylinder and unit weight testing of structural concrete.All work has been performed under
Caltrans specifications and test methods. Project was started in December 2005 and
completed in December 2006.Approximate cost was$1 million.
K.Hovnanian Bridges,Beaumont:(Project Manager/Project Engineer)Geotechnical
investigation to develop recommendations for the design and construction of four pro-
posed bridges across Potrero Creek within the Four Seasons at Highland, an active adult
residential development.These bridges are proposed to be single span bridges with two
abutments.Also providing geotechnical observation and testing and special inspection and
materials testing of the bridge construction. Responsible for review and analysis of
relevant geotechnical reports and lab data,coordination of subsurface exploration that

Wineville Extension Recycled Water Pipeline,Fontana/Ontario:(Project Manager/
Engineer)Provided geologic hazard review for this project which consisted of three
segments of pressurized pipeline in city streets.There is two 16-inch-diameter pipelines
up to 4,500 feet long and a 12-in-diameter pipeline at 18,900 feet long. Performed review

Ms. Schroeder has more than 18 years of experience in managing projects and conducting
biological surveys in California. She is a wildlife biologist with specific expertise in assess-
ing avian resources and conducting nest monitoring surveys in coastal sage scrub and
riparian habitats. Prior to becoming a Project Manager, Ms. Schroeder conducted general
biological surveys and focused surveys for California gnatcatchers,least Bell's vireos,

Riverside County,Ion Communities:Project Manager responsible for coordinating the
biological resources survey and preparation of a report for a 65-acres site in Riverside.
This report was prepared in such a way as to adhere to the guidelines and requirements
in the Western Riverside County Multi-Species Habitat Conservation Plan(MSHCP).The
site was surveyed for common and sensitive species of plants and wildlife, as well as for
the presence of potential wildlife movement corridors. In addition, recommendations were
given for further focused surveys for listed species of wildlife that required additional
surveys under the MSHCP. Focused surveys were conducted on the site for burrowing
owls.
Biological Resources Assessment for the Chapman Heights Property,City of
Yucaipa,Odle and Associates:As Principal Wildlife Biologist, responsible for conduct-
ing and overseeing surveys for common, listed,and/or sensitive species of wildlife and
plants.The site consisted of approximately 1,500 acres of Riversidian Alluvial Fan Sage
Scrub, Coastal Sage Scrub, non-native grasslands,and orchards.At issue were the
potential presence of the California gnatcatcher,San Bernardino Merriam's kangaroo rat,

Dr. Mason has been professionally involved with cultural resources management in
southern California since 1983. Dr. Mason is the author of over 150 reports dealing with
cultural resource surveys,evaluations,and mitigation programs in all southern California
counties.Section 106 experience includes successful nomination of the San Antonio
Terrace Archaeological District on Vandenberg AFB to the NRHP and preparing a Historic
Preservation Plan for the District. Dr. Mason was also Principal Investigator for the data
recovery and construction monitoring program for the San Joaquin Hills Transportation
Corridor, a Section 106 project reviewed by Caltrans. Dr. Mason was the Principal Investi-
gator for the Newport Coast Archaeological Project in coastal Orange County. This project
was the largest privately funded cultural resources mitigation program on the West Coast

cultural resources sections for CEQA documents and was a consultant to the California

Planned Residential Development consisting of 342 single-family residential lots, two park
sites, three water reservoir sites, and private streets on 352.8 acres.The project site was

Cottonwood Hills Archaeological Test Program,Lake Elsinore,Riverside County
Pardee Homes: Principal Investigator and Report Author for archaeological test and
evaluation programs at five prehistoric sites and one historic site on a property proposed
for residential development in the City of Lake Elsinore, Riverside County. One large
residential base or village was evaluated as eligible for the CRHR and NRHP and preserva-
tion in open space was recommended.The other sites were evaluated as not eligible.The
reports were reviewed by the Corps of Engineers and the SHPO because a 404 permit
was required for the project.The SHPO did not object to the determinations of eligibility

Olinda Archaeological Test and Data Recovery Program,Brea,Orange County,
SunCal Companies:Principal Investigator and Report Author for test programs at one
prehistoric site and two historic sites,as well as data recovery at the prehistoric site.The
sites were located on land proposed for residential development in the former Olinda oil
fields in Brea,Orange County,California.The prehistoric site was a temporary camp from
the Milling Stone Period.The historic sites were part of the former oil company town of
Olinda.
Pacific Highlands Ranch Data Recovery and Indexing Program,San Diego,
Pardee Construction Company: Principal Archaeologist- Directed data recovery at four
prehistoric sites and"indexing"at five sites that were to be preserved in open space,as
required by the project EIR for the Pacific Highlands Ranch project north of Carmel Valley
in the City of San Diego.The subsurface boundaries of concentrations of cultural material
within each site slated for data recovery were defined by excavating a total of 252 system-
atically spaced shovel test probes(STPs) in several phases of work.As required by the
City, the data recovery program consisted of hand excavation of 78 1 by 1 meter units
comprising a five percent sample of each concentration within each site. Statistical
analysis showed that additional excavation would only produce redundant data.A report
was completed that provides an interpretation of activities carried out at these sites which
were occupied during the early part of the La Jolla Complex(circa 9,000 to 6,000 BP).
Subsequently, when a 404 permit was needed for the project,the report was accepted by
the Corps of Engineers in satisfaction of the Section 106 process.

Associates Empire.The$47.4-million interchange will be located approximately 1.5 miles south of
the I-15/State Route 60(I-15/SR 60) interchange in the Mira Loma area of western
Riverside County. Once operational, it will help alleviate increasing traffic flow problems,
effectively separating commercial truck traffic from commuter corridors and residential
areas. Currently estimated to complete in May 2007,the I-15/Cantu-Galleano Ranch Road
interchange will play a significant role in the overall development and economic success

Solution Strategies, Description:The Vulcan Materials Cajon Creek Project provides for the production of
Inc, aggregate materials,the development of a light industrial project,and the preservation of
six miles of Cajon Creek. In-stream mining was designed to maintain stream equilibrium.
Following mining, the mined areas were restored using suitable native plant species.A
mitigation bank was established on areas not required to offset project related impacts.
This project preserved, enhanced,and restored approximately six miles of the creek.The
project site provides habitat for twenty-two sensitive species and serves as a vital habitat
link into the San Bernardino Mountains.SSTs principals aided in processing applications
for Section 404 permit, including a Section 7 consultation,Section 401 certification,and
the Streambed Alteration Agreement.The Section 7 consultation was for state and federal
listed plants and animals.A major responsibility was overseeing the preparation of the
Biological Assessment and negotiating the conditions incorporated in the Section 7 Biologi-
cal Opinion.The project also included the development of memoranda with the state and
federal agencies for the long-term management of a conservation bank(the Cajon Creek
Habitat Conservation Management Area)for 22 sensitive species established as part of the

Section 7 Items,Actions,or Information HFI Expects From City
Comments/ It would be beneficial to the project if the City would provide assistance in working with
Suggestions/ Caltrans in the acquisition of right-of-way, meeting any conditions and standards that
Expectations they might impose on the project, and helping to obtain a speedy review of the project
documents that Caltrans might undertake.
HFI understands that it will be necessary for the San Bernardino County Flood Control
(SBCFD)to review the hydrology and hydraulic calculations for the Flows in Cable Creek
adjacent to the roadway. Timely review from SBCFD for these calculations and an
acceptable design for the slope protection of the roadway may be an item that HFI needs
assistnace from the City for, as well as project team members to meet anticipated
Project Schedule deadlines.
Comments or Suggestions _
Due to potential mitigation, HFI suggests that the project be phased into two independent
street segments/phases.The first segment should be from Little League Drive to the
northwest corner of Tract 34737.The second segment should run from the northwest
corner to Cable Canyon Road. Please see Section 1 "Scope of Services"under project

I. INTRODUCTION
The City of San Bernardino is soliciting the services of a consulting engineering
firm for realignment of an existing 1-215 Freeway Frontage Road northwesterly
of Little League Drive and extension 0.73 mile northwesterly from its existing
terminus to Dement Street (SS07-29). The project includes environmental
approval and acquisition of right-of-way, which may include decertification of
existing operating State RAN.
II. BACKGROUND
The 1-215 frontage road, which is the subject of this RFP, currently exists from
Little League Drive to a point approximately 1.28 miles northwesterly thereof
where it terminates. The existing road consists of two paved traffic lanes
constructed by the State of California in conjunction with the 1-215 corridor and
relinquished by the State to the City of San Bernardino in the 1950's. The
alignment is substandard near the intersection with Little League Drive.
Signalization of the intersection of the road and Little League Drive.
Coordination with potential development on the east side of Little League Drive
will be necessary.
io Hall & Foreman, Inc. completed preliminary alignment concepts for the project.
Copies of the preliminary alignment concepts, identified as Exhibits 1", "2" &
"Y, are attached.
Most of the property needed for the project is controlled by the City of San
Bernardino Economic Development Agency (EDA) and Caltrans; however, a
small amount of needed right-of-way near Little League Drive is owned by a
private party.
III. SCOPE OF SERVICES
1. Consultant shall prepare and complete all required construction documents,
including plans, specifications, and cost estimates for the following items:
a) Construction of the "proposed collector road" to eliminate the
substandard reverse curve near Little League Drive, including
intersection modifications at Little League Drive.
b) Modifications to the existing frontage road as indicated in the attached
alignment study.

10 c) The extension of the frontage road from its existing ter

Street.
d) Drainage modifications necessary to drain the road and protect it from
flooding. Hydrology and hydraulic calculations must be provided to
support the drainage design.
e) Signalization of the intersection of the road and Little League Drive.
Coordination with potential development on the east side of Little League
Drive will be necessary.
f) Identification of right-of-way needs for the extension of the street and the
"proposed collector road", including preparation of legal descriptions,
plats and securing of title reports for the parcels to be acquired for the
project.
g) Acquisition of right-of-way and permits from public agencies. Note: City
staff shall conduct all communications with private property
owners.
h) If condemnation becomes necessary, the consultant shall provide all
necessary title documents, engineering documents, communication, etc.
necessary to support the eminent domain process. It is anticipated that
the acquisition of right-of-way from EDA and Caltrans will occur through
friendly negotiations.
i) Consultant shall complete all necessary CEQA documentation including
all studies and submittals to the City for CEQA clearance. It shall be the
consultant's responsibility to obtain CEQA clearance for the project. City
staff will facilitate the process, but the consultant shall perform all work
necessary for CEQA clearance and represent the project, if needed, at
meetings.
j) Consultant shall be responsible for obtaining all approvals from outside
agencies for the work, including but, not limited, to permits from
Caltrans, San Bernardino County Flood Control District, streambed
alteration agreement from the California Department of Fish and Game
(CDF&G), Section 404 permit from the U.S. Army Corps of Engineers,
clearance from the U.S. Fish and Wildlife Service and a 401C waiver
from the California Water Quality Control Board, Santa Ana Region.
k) Consultant shall pothole existing underground utilities where a high
probability for conflict with proposed improvements exists.

Compensation for potholing shall be on a per pothole basis and cost of
potholing shall be stated separately from the consultant's design fee.
1) Consultant shall investigate alternatives for the realignment of Dement
Street for an improved intersection with Santa Fe Street or Devore Road.
The design of the selected alternative may be added as an amendment
to the basic contract.
2. Consultant shall prepare the improvement plans, specifications, and cost
estimates for the project in conformance with City of San Bernardino
standards, Caltrans standards, and the requirements of the Manual on
Uniform Traffic Control Devices (MUTCD) and California Supplement, latest
edition.
Plans, specifications, and estimate shall conformance to the following
design requirements:
a) The plans shall be prepared at a scale of 1 inch = 40 feet on standard
24" by 36" sheets, using the City of San Bernardino standard title block.
A scale of 1 inch = 20 feet may be used subject to approval of the City
Engineer.
b) The plans shall clearly show existing conditions, including but not limited
to, the location and type of signing and striping, pavement markings,
storm drain facilities and street condition.
c) Consultant shall be responsible for survey; research and other data or
work needed to establish existing conditions. Information readily
available from City files will be made available to the consultant at no
charge.
d) Improvement plans shall clearly indicate the following
• The type and location of existing and proposed signing and striping,
including but not limited to lane striping, stop bars, cross walks,
pavement markings, and any other traffic control devices.
• Signing and striping, pavement markings, raised pavement markers,
stop bars, crosswalks and related traffic control devices shall be
designed and detailed on a separate sheet drawn to a scale of 1" _

• The type and location of existing and proposed storm drain and street
improvements, including but not limited to curbs, gutters, curb ramps,
and cross gutters, street lights, culverts and open channels.
e) All improvements shall be designed in compliance and accordance with
the Americans with Disabilities Act (ADA).
f) The street improvement plans shall include, but not be limited to, curbs,
gutters, berms, and curb ramps. Limits of pavement, sawcuts, removals
and construction should also be shown.
g) The plans, specifications and cost estimates shall be signed and sealed
by a civil engineer licensed to practice civil engineering in the State of
California. Legal descriptions and plats shall be signed and sealed by a
civil engineer or land surveyor, licensed to practice surveying in the
State of California.
3. Consultant should meet and confer with City staff periodically during the
preliminary design phase to resolve design issues and ensure continuity
with City standards and preferences.
4. Consultant shall conduct utility research and identify the location and depth
of all existing utilities within the limits of the proposed improvements.
Consultant shall be responsible for identifying and resolving utility conflicts
both overhead and underground. Copies of all written communication
(including maps) between the consultant and utility companies shall be
provided to the City.
5. Consultant shall conduct the necessary research to determine the existing
public right-of-way and identify the required right-of-way needed to construct
the proposed improvements. A preliminary study conducted by City Staff
indicates that additional right of way will be required. Consultant shall
prepare the appropriate legal descriptions and plats describing the property
to be acquired. Consultant's obligation for right-of-way identification,
documentation and acquisition shall be as stated in Item III-1 above.
6. Consultant shall identify any additional improvements that are required to
construct the proposed street improvements. Additional improvements may
include but not be limited to curb and gutter, drainage improvements, storm
drains, street widening, curbs, curb ramps, and channelization. If additional
improvements are required, consultant shall include the design of those
improvements in the scope of the proposal and incorporate them into the
plans, specifications and cost estimates.

7. Consultant shall submit an updated project schedule within 1 week of
receiving a notice to proceed, indicating the design tasks and project timing
from start to submittal of final PS&E. The Consultant shall estimate two (2)
City plan reviews for each plan set. Each review should be estimated to take
three (3) weeks for schedule purposes. Consultant shall provide an updated
schedule showing progress and timing every two weeks.
Upon completion of the consultant's work, the City shall have in hand, both an
electronic, and a hard copy of an approved and signed set of completed plans,
technical specifications, quantities, estimates and special provisions ready for
bidding including all supporting data, calculations, utility locations, utility
notices, survey data, permits and other details necessary to complete this
project in a format acceptable to the City.
Consultant should expect to meet with the City on a bi-weekly basis for updates
on project progress, concerns, problems and accomplishments. The City
desires to have the completed design in hand within six (6) months after the
notice to proceed is issued. Acquisition of R/W, if required, may take longer,
but shall be diligently pursued by the consultant.
IV PROPOSAL REQUIREMENTS
A. Four (4) copies of the proposal shall be submitted to the following:

Proposals shall be received in hand by this Division up to the hour of
4:00 P.M. on Monday, March 26, 2007.
B. Responsive proposals will include, but not be limited to, the following:
1. Responsive proposals will present a Scope of Services that
includes at a minimum the above described services and any
other tasks necessary to achieve completion of design (PS&E)
needed for the successful construction of the proposed
improvements.
2. Identify the professional, technical and support staff that will be
performing the work associated with the proposed scope of

services. Short resumes may be included, but extensive resumes
should be limited to key personnel only.
3. Include a timeline indicating project milestones for the delivery of
final plans, specifications, and cost estimates ready for public bid,
including but not limited to a flow chart showing project tasks and
timing. Include allowances for review periods.
4. Include a list of similar projects recently completed by the
Consultant, identifying the location, date, agency and contact
person name, and address and phone number.
5. Previous obligations with other projects (related to time and
availability of staff).
6. Name of sub-consultants to be used for specific aspects of the
project, including a summary of previous working arrangements
on similar types of work.
7. Statement of local preference eligibility, including identification of
any office located in the City of San Bernardino and the number of
employees stationed at the office, the number of employees doing
business inside the City limits, and a copy of your firm's City of
San Bernardino Business License.
8. Items, actions or information the Consultant expects to be
provided by the City.
9. Any comments or suggestion that the Consultant believes
necessary to improve the finished project or to comply with the
requirements of this RFP.
10. Separate sealed envelope. Fixed fee or not-to-exceed fee for
the work required by this RFP, together with an hourly rate sheet
applicable to this project for classifications above, including all
materials and expenses, shall be submitted in a separate sealed
envelope. Please note that the City will not pay or
compensate separately for travel time, courier services,
mileage or reimbursement for travel to the City of San
Bernardino to attend meetings or conduct the activities
necessary to complete tasks required to be performed as
part of consultant services.

The fee proposal shall include the total fee and a separate fee
breakdown for the traffic signal improvements and another one for
the street and drainage improvements. This is necessary for cost
tracking within the City's Capital Improvement Program.
V. SELECTION PROCESS
The selection process will be based on a point system and will consist of three
phases as follows:
1. First phase selection shall consist of an evaluation by staff (including the
Development Services Director, City Engineer, a Senior Engineer and
Project Manager) of proposals based on the above items identified in
Section IV B (except No. 10). An additional five (5) points will be given
to City of San Bernardino based consultants. In order to be deemed as
"City of San Bernardino Based Consultant, the company shall have an
office with a minimum of one (1) owner or employee doing business
inside the City limits and shall possess a City Business License. The
three (3) consultants with the highest points will continue to the
interviews. A maximum of 100 points can be achieved in this phase of
the selection process. The three consultants with the highest numerical
scores will be invited to continue with the second phase of the selection
process.
2. Second phase of the selection process will consist of staff evaluation of
a presentation by the three consultants with the highest numerical score
from the first phase selection. The interview will be detailed questions
on this specific project, including, but not limited to, personnel, schedule,
project staging, and knowledge of the project. Five (5) points of local
preference will also be awarded in this phase of the selection process for
Consultants that meet the requirements identified in paragraph 1 above.
A maximum of 100 points can be achieved in this phase of the selection
process.
3. The third and final phase of the selection process will consist of staff
submitting a final package to the Mayor and Council for consideration
approval. Final scores of the top three consultants will be submitted to
the Mayor and Common Council with a recommendation to award an
Agreement for Professional Services to the consultant with the highest
numerical score. However, the Mayor and Common Council have the
prerogative to award an Agreement for Professional Services to any of
the top three consultants or reject all proposals.

4. If the Mayor and Common Council award an Agreement for Professional
Services, the selected consultant will be requested to execute an
Agreement for Professional Services (draft copy attached). Failure of
the consultant to execute the Agreement within 60 days of approval by
the Mayor and Common Council will void the approval.
VI GENERAL
This "Request for Proposal" does not commit the City to award a contract, pay
any costs incurred in the preparation of a proposal in response to this request,
procure or contract for any services. All proposals submitted in response to this
request will become the property of the City and may be used by the City in any
way deemed appropriate. The City reserves the right to accept or to reject, in
part or in its entirety, the response to the request for proposal if such action is
deemed to be in the best interest of the City.
Any contract entered into as a result of this proposal shall be considered to
include the items of work detailed in this proposal unless specifically deleted in
the proposal at the request of the City.
VII PAYMENT
The Consultant that is recommended by Staff and approved by Common Council shall attend the pre-design meeting to establish)they tart
date. Once the Notice to Proceed has been given, the Consultant can submit
for payments. The City will release funds at percentages with receipt of Plans,
Notices, or Specifications. No payment shall be given above the percentage of
completed work accepted by the City. The City shall hold 15% of the total cost
for 360 calendar days after acceptance of plans and specifications by the City,
or 45 calendar days after the City issues a Notice of Completion for the project,
whichever occurs first.
Addenda to this RFP, if any, will be faxed to prospective consultants no less
than five (5) business days prior to the due date. Consultants shall be required
to acknowledge receipt of all addenda as part of the proposal.
