Recommended motion:
That Planning staff be directed to prepare an amendment to
General Plan Policy 1.19.11 and to prepare an amendment to the

Subiect:
Auto body and paint shops located in the CG, Commercial
General land use designations.
Mayor and Common Council meeting May 10, 1993
REOUEST
That Planning staff be directed to prepare a General Plan Amendment
and a Development Code Amendment to allow auto body and paint
shops, subject to a conditional use permit, in the Commercial
General land use designations. Existing auto body and paint shops
would be allowed to remain as conforming permitted uses, and
additions or other renovations would be subject to a Development
Permit.
BACKGROUND
When the General Plan was adopted on June 2, 1989, it included
Community-Serving Commercial Uses, Policy 1.19.11 which reads:
Permit the development of new and used car dealerships and
auto-related retail and service uses (excluding auto body and
paint) with a Conditional Use Permit to ensure compatibility
with adjacent uses.
Consequently, when the Development Code was adopted on June 3,
1991, auto body and paint shops were excluded from the permitted
uses table in all CG designations.
Approximately 20 auto body and paint shops in San Bernardino are
located in the Commercial General land use ~signations. These
businesses are now non conforming and are not permitted to expand
to any significant degree. This has caused hardship for these
business owners who have no desire to relocate.
RECOMMENDATION
It is recommended that the Mayor and Common Council direct Planning
staff to prepare an amendment to General Plan Policy 1.19.11, and
to prepare an amendment to the Development Code to consider
permitting auto body and paint shops in the Commercial General land
use designations.
