STAFF REPORT
The Traffic Engineering Section has received many
complaints from motorists concerning the 25 m.p.h. speed limit on
Rosewood Drive, between Orchard Drive and Tippecanoe Avenue. The
Police Department has been enforcing the speed limit, prompting
complaints from the motorists who are being issued speeding
tickets. The motorists contend that the speed limit is too low
and, therefore, constitutes a speed trap. Following are the
results of our investigation into this matter.
The speed limit was originally posted by the County, while
the street was still under their jurisdiction. At that time,
Rosewood Drive dead-ended at Orchard Drive, so the 25 m.p.h.
speed limit clearly applied. After the City annexed this area,
Harriman Place was built and the dead-end removed, making this
street a connector between Tippecanoe Avenue and Hospitality
Lane. This action changed the function of this street from a
local residential to collector, thereby making the 25 m.p.h.
speed limit inappropriate. An engineering study was evaluated to
determine the appropriate speed limit for the street.
The study found that the critical speeds (85th percentile)
range between 40 and 42 m.p.h. and average 41 m.p.h. It also
found that 100 percent of the motorists traveling through this
section of Rosewood Drive are in violation of the 25 m.p.h. speed
limit. Normally, a 40 m.p.h. speed limit would be recommended at
these rates of the critical speeds. However, due to the
residential nature of this area, it is recommended that the speed
limit be raised to only 35 m.p.h.
The Traffic Safety Committee reviewed this item at their
April 14, 1993, meeting. The Committee concurred with the
findings and recommendations of the Traffic Engineer, that a 35
m.p.h. speed limit be established.
We recommend that the speed limit be raised from 25 m.p.h.
to 35 m.p.h.

9 In accordance with and pursuant to the authority of
10 Sections 22357, 22358, and 22360, of the California Vehicle Code,
11 the Mayor and Common Council do hereby determine and declare,
12 upon the basis of an Engineering and Traffic Investigation, that
13 the Prima Facie Speed Limit of Thirty-Five miles per hour shall
14 be established on the following streets or portions thereof in
