03--07-88 Resolution No. 88-67 adopted expanding boundaries of
Assessment District No. 976.
06-06--88 Resolution No. 88-179 adopted awarding a contract to
Cherokee Landscape Services for the low bid price of
$24,400.00.
06-19-89 -- Change Order No. 1 approved extending the contract for
one year, adjusting bid prices by 6.5% for inflation,
incorporating supplemental items of work, for an
increase in annual contract price to $29,977.00.

05-20-91 -- Contract Change Order No. 3 approved extending the
contract for one year, at no increase to the contract
unit price.
05-18-92 -- Change Order No. 4 approved to extend the contract for
one year, from 7-1-92 to 6-30-93, and transfer of
$38,966.00 to A.D. #976 approved.

A total of 7 bids were received, ranging from $46,169.00
to $73,485.16. The low bid of $46,169.00 is 35.4% below the
Engineer's Estimate of $71,574.00.
Below is an estimate of the total annual cost for
providing these landscape maintenance services, from 7-1-93 to 6-
30-94.

Funding for the costs incurred on this project will be
provided pursuant to Resolution No. 86-341, adopted on 8-19-86,
Resolution No. 87-9, adopted on 1-05-87, Resolution No. 88-67,
adopted on 3-7-88, and Resolution No. 90-199, adopted 6-4-90,
which orders the installation and maintenance of the landscaping.
The landscaping was installed under previous contracts. All
costs for this contract will be recovered through assessments on
Districts 976, 991, and 997.
Inspection of the maintenance effort by the Contractor
will be provided by the Department of Parks, Recreation and
Community Services.
We recommend that a contract be awarded for the low bid
price.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING IN
3 ASSESSMENT DISTRICTS NOS. 976, 991 AND 997.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Mentone Turf Supply is the lowest responsible
6
bidder for:

Maintenance of Landscaping in Assessment Districts
Nos. 976, 991, and 997, per Plans Nos. 7034-B, 7782 and 8301.

contract is
awarded accordingly to said bidder for the total
amount of $46,169.00, but such award shall be effective only upon
10
the contract being fully executed hy both parties.

All other
is hereby
bids,
rejected.

authorized and directed to execute said contract on behalf of the

a copy of the contract is on file in the office of the City
Clerk and incorporated herein by reference as fully as though set

forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or

course of conduct of any party.

SECTION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
