STAFF REPORT
THE POLICE DEPARTMENT HAS OPERATED A COMMUNITY SERVICE OFFICE AT 1292 w. MI LL
STREET, UNIT #106, SINCE JANUARY 1989. THIS SITE HAS COST THE CITY $300 PER MONTH
IN LEASE COSTS PAID TO THE OWNER OF THE SITE, MR. RICHARD CHURCHWELL.
8ASED ON RECENT DISCUSSIONS WITH COUNCILMAN HERNANDEZ AND THE PROPERTY OWNER. IT
WAS AGREED TO REVISE THE EXISTING LEASE AGREEMENT TO REFLECT A NEW ANNUAL LEASE
RATE OF $35 PER MONTH. THIS REFLECTS AN ANNUAL SAVINGS OF $3180 PER YEAR (NOT
INCLUDING THE CURRENT FISCAL YEAR, WHICH HAS ALREADY EXPENDED SOME OF THE MONTHLY
FUNDS ).

EXECUTION OF AN AMENDMENT TO LEASE AGREEMENT WITH RICHARD K.
CHURCHWELL AND D. MARLENE CHURCHWELL, TRUSTEES OF THE CHURCHWELL
FAMILY TRUST, TO LEASE OFFICE SPACE LOCATED AT 1292 W. MILL
STREET, UNIT #1016
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is
hereby authorized and directed to 6xecute on behalf of said City
an Amendment to Lease Agreement with Richard K. Churchwell and D.
Marlene Churchwell, Trustees of the Churchwell Family Trust, to
lease office space located at 1292 W. Mill Street, Unit #1016, San

Exhibit "A" and incorporated herein by reference as fully as

Bernardino, California, a copy of which is attached hereto marked
though set forth at length.

SECTION 2.
The authorization to execute the above
15
referenced agreement is rescinded if the parties to the agreement
16
fail to execute it within sixty (60) days of the passage of this
17 resolution.

AMENDMENT TO LEASE AGREEMENT
This Amendment to Lease Agreement made this day of
April, 1993 and between RICHARD K. CHURCHWELL and D. MARLENE
CHURCHWELL, Trustees of the CHURCHWELL FAMILY TRUST (herein called
"Landlord") or assignee as designated, and the CITY OF SAN
BERNARDINO, a municipal corporation, (herein called "Tenant").
WHEREAS, Landlord and Tenant are parties to that certain
lease agreement dated November 4, 1988, wi th respect to the
premises located at 1292 West Mill Street, #106, in the City of
San Bernardino, County of San Bernardino, State of California; and
WHEREAS, the parties desire to amend said lease in the manner
hereinafter set forth;
NOW, THEREFORE, the parties do agree as follows:
1. Paragraph 4.B. is amended to read: "The lease term
shall be a period of forty-eight (48) months, commencing on the
Commencement Date, thereafter terminating on December 31, 1993.
2. The first sentence of Paragraph 5.A. is amended to read:
"Tenant agrees to pay to Landlord as Minimum Rent without notice
or demand, the monthly sum of Thirty-five Dollars ($35.00).
