Description) Vacation processing fees Finance: Council Notes: Agenda Item No. (5 gl'~I()r CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Authorization to Proceed - Proposed vacation of a portion of Pico Avenue, south of Rialto Avenue, Belleview Street, east and west of Pico A venue and that certain east/west alley, south of Rialto Avenue and east of Pi co Avenue and plan approval. BACKGROUND: On June 3, 2002, this office received an application for the vacation of a portion of Pico A venue, northerly and southerly of Belleview Street, and a portion of the alley east of Pico A venue, between Belleview Street and Rialto Avenue. The request was submitted by Buddy N. Long, Trustee for Long Family Trust. Mr. Long is currently in negotiations with Ruger Farms Manufacturing to acquire the remaining parcels for the future development of a manufacturing company which could potentially provide up to 500 jobs for the City. The proposed vacation of these streets would also assist in the prevention of public dumping and enable future development of the surrounding parcels by making them contiguous. Since Mr. Long already owns the majority of the adjoining parcels, it is staff's opinion that the portions of these streets proposed to be vacated will no longer be needed as public right of way. Previously, there was a dispute between the petitioner and the adjoining property owner on the southwest comer of Rialto A venue and Pico A venue regarding the vacation of these streets. The owner has since passed away and his heirs lost the property in bankruptcy proceedings. The current owner of the property, Ronald O. Nuckles of Nuckles Oil Company, has signed the petitioner in favor of the vacation. If authorization to proceed is given, all affected City departments, utilities and property owners will be contacted for comments or any possible conflicts with any existing utilities. FINANCIAL IMPACT: None. Applicant has paid the first half of the processing fee and will pay the remainder prior to the legal proceedings. RECOMMENDATION: Staff recommends that authorization to proceed with the proposed vacation be given and that Plan No. 10501 be approved.
