Recommended Motion:
Adopt resolution.
That direct funding in the amount of$5,000 from the FY 02/03 civic and promotion fund be
approved; that indirect funding in the amount of $4,966, plus the cost of a damage bond, be
transferred from the FY 02/03 civic and promotion fund to various city departmental accounts as
listed in the attached staff report; and that a waiver of fees and use of city personnel and
equipment be authorized to assist in the 2002 Salute to the Route event scheduled for September
21,2002.

Staff Report
SUBJECT:
Resolution authorizing agreement between the City of San Bernardino and "The Gents" for civic
and promotion funding in the amount of$5,000 from the FY 02/03 budget to assist with the
conduct of their "Salute to the Route" event on September 21,2002. The organization is also
requesting a waiver of applicable departmental fees in connection with the event.
BACKGROUND:
Mr. Danny Flores, Chairman of the "Salute to the Route" event has requested financial assistance
from the City in the amount of $1 0,000 to aid in the conduct of that event scheduled for
September 21, 2002 at Nunez Park. Attached is a completed Request for Funding Assistance for
your review which includes a proposed budget, estimated revenue from other sources, and the
anticipated cost of the event to the organization. He is also requesting a waiver of fees for
departmental personnel and equipment to assist with the event. These fees are as follows:

At the August 1,2002, Special meeting of the Ways and Means Committee, it was recommended
that the agreement be made with The Gents in the amount of $5,000 in direct funding, and
$4,966 for indirect costs. Additionally, it was recommended that the City procure a damage
bond for this event.
This is the third year in which Mr. Flores has requested financial support for this event. Last
year, the Mayor and Council approved $10,000 in civic and promotion funding to support the
activity.
The event is a car show similar to the larger Route 66 event which is intended to showcase many
"Iowrider" custom cars and bicycles and embodies the spirit of the City's Hispanic community.
The event encompasses Hispanic art, culture and history. Musical entertainment and traditional
Mexican foods will add to the flavor ofthe event.
FINANCIAL IMPACT:
Included in the FY02/03 budget is $153,500 (Acct. #001-091-5186) in civic and promotion funds
which are traditionally used to support events of common interest to the community. Attached
is a matrix showing the two requests the City has received this year to-date as well as the actual
expenditure report of civic and promotion expenses for year ending June 30, 2002.

RECOMMENDATION:
Adopt resolution.
That direct funding in the amount of $5,000 be approved; that indirect funding in the amount of
$4,966, plus the cost of an $8,000 damage bond, be transferred from the FY02/03 civic and
promotion fund to various city departmental accounts as listed in the attached staff report; and
that a waiver of fees and use of city personnel and equipment be authorized to assist in the 2002
Salute to the Route event scheduled for September 21,2002.

Chief Zimmon;
The Gents Organization of San Bernardino, a community service group for
over 20 years, is requesting permission from your department to allow the
sale of alcoholic beverages as directed by the Alcohol and Beverage Control
State Department, State of California.
The Gents Organization is planning a beer garden during the Sa/ute to the
Route annual event scheduled for September 21, 2002 from lOam to 7pm
and located at Nunez Park, 1717 West 5th Street, San Bernardino. The beer
garden will be fenced in and isolated from the Children's section.
In asking approval for such a permit, the Gents Organization will be better
equipped to provide this service to our community in a safe enviromnent
which will be enclosed, allowing access to adults only. We expect
anywhere from 5,000 attendees and up this year. The members of the Gents
Organization are well respected in this community due to their volunteer
efforts and support of youth offender's rehab programs in collaboration
with Los Padrinos, Youth Justice Center, Latino Peace Officer's Assn. and
others. This event will provide needed financial assistance for the Gents
Organization to support our area high school students with scholarship
programs and youth activities.

Dear Committee Members:
This year Salute to the Route celebrates its lOth Anniversary commemorating the original
Route 66 highway on our City's West Side. This fumily-oriented event sponsored by The
Gents showcases over 300 beautiful classic and low-rider cars and bicycles, with quality
vendors, entertainment and music that attracts over 10,000 fans and spectators to our
City. The event also cross promotes our Route 66 Rendezvous@ event, which is held the
same weekend. The council and I have attended both events for the past four years.
In addition to the above, this year's Salute to the Route theme focuses on a family health
faire, with free participation by related organizations that serve our community. Salute to
the Route committee, under the founder and executive director, Danny Flores, has proven
itself to be well run and very safe. It is the foremost event that brings positive support for
our West Side as well as valuable scholarships for our youth through The Gents nonprofit
organization from event proceeds.
I am requesting that all City fees be waived for this event, and that $10,000 from the
City's Civic and Promotion Fund be allocated for this year's 2002 Salute to the Route
event. Thank you for your support.

Civic and Promotion Funding
This AGREEMENT is entered into between the CITY OF SAN BERNARDINO, a
unicipal corporation, referred to as "City" and "THE GENTS", a non-profit, 501 ( c) (3)

organization, referred to as "Organization."

The parties agree to as follows:
1. Recitals.
A. Organization has requested financial assistance from City for the
Fiscal year 2002/03, in order to assist in defraying the expenses connected with the conduct of
events related to car show and cruise on September 21, 2002 , as outlined in the Request for
Funding Assistance (Attachment "A") and letter to the City from Salute to the Route, dated July
1,2002, (Attachment "B") copies of which are attached hereto. The terms of the request are
incorporated herein by reference and shall govern the uses of the funds provided herein. The
financial assistance provided for in this Agreement is made on a one-time basis, and receipt of
said funds shall not imply a continuing obligation of the City beyond the terms of this

20 B. The expenditure is for a valid municipal public purpose, to wit: for the
21 conduct of events related to the Salute to the Route annual car show and cruise.

Use of Funds.
The funds paid to Organization shall be used solely for the purposes set forth in
aragraph I above. No deviation from these provisions shall be made without the express
pproval of the City of San Bernardino. Any unexpended funds shall be returned to the City by

Accountability.

accepted accounting principles by Organization in such manner as to permit City to easily trace

the expenditure of the funds. All books and records of Organization are to be kept open for
inspection at any time during the business day by the City or its officers or agents. Failure to

14 submit the financial records in accordance with this section will result in the Organization
15 reimbursing the City in the full amount received by Organization. At the conclusion of the
16 program, Organization shall present the City Administrator or his designee copies of all receipts
17 for expenditures connected with said program in the total amount of FIVE THOUSAND

Hold Harmless.

Organization covenants and agrees to defend, (if requested by City), indemnify, and hold
22 harmless the City, its departments, agencies, boards, commissions, elected officials, officers,
23 attorneys, employees and agents from all liabilities and charges, expenses (including counsel
24 fees), suits, or losses, however occurring, or damages arising or growing out of the use or receipt
25 of the funds paid hereunder and all operations under this Agreement. Payments hereunder are

made with the understanding that the City is not involved in the performance of services or other

1 activities of Organization. The costs, salary and expenses of the City Attorney and members of

is office in enforcing this Agreement on behalf of the City shall be considered as "counsel fees"
for the purposes of this paragraph.
6. Insurance.
While not restricting or limiting the foregoing, during the term of this
7 Agreement, Organization shall maintain in effect policies of comprehensive public, general and
8 automobile liability insurance, in the amount of$I,OOO,OOO, per occurrence combined single
9 limit, naming Salute to the Route, and the City of San Bernardino, its departments, agencies,
10
boards, commissions, elected officials, officers, attorneys, employees, and agents as additionally
11

insured. A certificate of insurance evidencing such coverage shall be provided to the Mayor or
13 her designee, with the added notation that the insurance policy shall not be terminated or
14 materially altered without 10 days prior written notice to the City.

7.
Termination.
City shall have the right to terminate this Agreement and any funding
17 remaining unpaid hereunder for any reason by mailing a ten-day written notice to Organization
18
and this Agreement shall terminate ten days after the mailing of such notice. In the event this

Organization hereby covenants that it has taken all actions necessary to

10. Entire Agreement.
This Agreement and any documents or instruments attached hereto or
eferred to herein integrate all terms and conditions mentioned herein or incidental hereto, and
supersede all negotiations and prior writing in respect to the subject matter hereof. In the event
f conflict between the terms, conditions or provisions of this Agreement, and any such
document or instrument, the terms and conditions of this Agreement shall prevail.

The "Sa/ute to the Route" Board of Directors presents the tenth annual "Sa/ute to the Route" to be held
Saturday, September 21, 2002 at Nunei Park in San Bernardino.

The "Sa/ute to the Route" is a community event held each September in recognition of Route 66. All
proceeds are contributed to local non-profit agencies for student scholarships. This year's recipients will
be the Gents Organization.
The day of the event will feature a custom car show, lowrider bicycle displays, local bands performing
on stage as well as food and vendor booths.
Service organizations such as the Boy Scouts of America, People's Choice, Ronald McDonald House,
The American Red Cross, Inland AIDS Project, the PAL Center and others are welcomed free of charge
to provide outreach to the community. We host organizations such as the San Bernardino County
Department of Public Health, the California Highway Patrol, San Bernardino County Sheriffs
Department, and the San Bernardino City Police Department so they may educate the public about the
services they provide. This year we also welcome health organizations such as Molina Medical, La Salle
Medical, and IEHP so they may provide health and safety information to the public.
On behalf of the "Sa/ute to the Route" Board of Directors, I am requesting $10,000 from the Ways &
Means Committee in our endeavor to provide these services to the community. Attached is our proposed

At the Mayor and Common Council meeting of August 5, 2002, the City of San Bernardino
adopted Resolution 2002-267 - Resolution authorizing an agreement between the City of San
Bernardino and "The Gents" for Civic and Promotion funding from the FY 02/03 budget to
assist in the conduct of the "Salute to the Route" event.
Enclosed are two (2) original agreements. Please sign in the appropriate location and return the
executed agreements to the City Clerk's Office, Attn: Michelle Taylor, P.O. Box 1318, San
Bernardino, CA 92402, as soon as possible.
Please be advised that the resolution and agreement will be null and void if not executed
within 60 days, or by October 4, 2002.
