SUBJECT
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
execution of annual agreements with the County of San Bernardino to provide equipment and
user access into the National Law Enforcement Telecommunication System (NLETS), the
California Law Enforcement Telecommunications (CLETS), and the Sheriffs Central Name
Index (CN!).
BACKGROUND
The San Bernardino Police Department is authorized to access the National and California Law
Enforcement Telecommunication Systems (NLETS & CLETS) through the County of San
Bernardino's message switch. The County of San Bernardino also maintains various regional
criminal justice information systems that are accessed through the Sheriff Department's Central
Name Index (CNI).
Access to NLETS and CLETS is essential to obtain criminal offender records and other criminal
justice information from national and state computer systems including data files such as FBI,
NCIC, DMV and Stolen Vehicle Systems. Additional regional criminal justice information is
available through the County of San Bernardino CNI system including all local warrant
information and court calendar information.
Both contracts were previously executed on July 92001, for FY 01102, with NLETS/CLETS fees
totaling $8,161.20 and CN! charges totaling $25,716.00. The combined total for these two
contracts in FY 01102 was $33,877.20.
The attached contracts represent fees for equipment and expected user transactions for FY 02/03.
As with other municipalities, our fees are based on a prorated system of expected use calculated
from 2001 data.
FINANCIAL IMPACT
Equipment and user access fees during FY 02/03 for NLETS/CLETS are $811.84 per month or
$9,742.08 annually. CNI fees are $2202.00 per month or $26,424.00 annually. The combined
fee total for FY 02/03 is $36,166.08.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF ANNUAL

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San Bernardino
authorize the Purchasing Manager to execute an agreement between the City of San Bernardino
and the County of San Bernardino, in an amount not to exceed $9,742.08, for equipment and
user access, into the National Law Enforcement Telecommunication System (NLETS) and the
California Law Enforcement Telecommunication System (CLETS), a copy of which is attached
hereto marked Exhibit "A" and incorporated herein by reference as fully as though set forth at
length.
SECTION 2. That the Mayor and Common Council of the City of San Bernardino
authorize the Purchasing Manager to execute an agreement between the City of San Bernardino
and the County of San Bernardino, in an amount not to exceed $26,424.00, for equipment and
user access into the Sheriffs Central Name Index (CNI), a copy of which is attached hereto
marked Exhibit "B" and incorporated herein by reference as fully as though set forth at length.
SECTION 3. The authorization to execute the above referenced purchase orders is
rescinded if purchase orders are not issued within ninety (90) days of the passage of this
resolution.

1. This contract is for the furnishing, by COUNTY to CONTRACTOR, of teleprocessing services.
It is the intent of the parties to promote more effective regional law enforcement through the
cooperative use and maintenance of the COUNTY's computerized data files.

CONTRACTOR agrees to limit access to COUNTY's data files to Criminal Justice Law
Enforcement Personnel and to adhere to all State, COUNTY and Federal laws applicable to the
confidentiality and the release of information. Signed agreement of use for each of the above
systems shall be completed by CONTRACTOR.
4. Access to the COUNTY's Sheriff Central Name Index (CNI) database is also limited, as follows:
a) In the interest of maintaining a regional criminal justice database, CONTRACTOR is
granted update capability to the COUNTY's Sheriff CNI database for Officer reporting
and ID transactions. The data entered into CNI by the CONTRACTOR will be relevant
to the criminal justice process. The completeness, accuracy, objectivity, and verifiability
of information entered into the system is paramount and the CONTRACTOR will
cooperate with regular auditing of the system to assure reliability of stored data. In
addition, procedures for purging or canceling entries will be adhered to for enhancing
reliability of all data.
b) The CONTRACTOR will enter into the CNI system only that data originating with
organizations who are party to this or a similar contract with the COUNTY.
c) The CONTRACTOR agrees to cause employees, having access to the SHERIFF's
Central Name Index (CNI), to complete clearance forms as provided by the COUNTY
before such access will be allowed.

Only authorized data on standard formats will be entered into CN!. For special, unique
information the Sheriffs concurrence must be obtained in advance.
e) The Sheriff or his representative will act as "Controller" facilitating the entry and
retrieval of computerized CNI information.
f) CONTRACTOR agrees to update CNI for all law enforcement related incidents reported
within its jurisdiction in a timely fashion to insure integrity of CNI and promote regional
cooperation and effectiveness in law enforcement.
5. The CONTRACTOR agrees to appoint a security/privacy officer who shall be responsible for all
security and privacy considerations relating to the CNI, and the terminals attached thereto. This
officer will be the liaison point with the controller regarding security and privacy control.
6. The COUNTY's Information Services Department (ISO) shall coordinate a pre-installation
teleprocessing network service site survey and determine installation requirements for
CONTRACTOR location. CONTRACTOR shall render full cooperation to COUNTY.
7. ISO will act as teleprocessing network service manager and the COUNTY will offer two types of
network services to the CONTRACTOR as selected on the Teleprocessing Network Services
"Exhibit A" attached hereto and incorporated herein by reference. These services are generally
described as follows:

a)
Class A - COUNTY provides data circuits and modems, and complete data
communications support services of problem isolation and resolution from COUNTY
host computer to CONTRACTOR terminals. Charges for Class A services are in

accordance with established ISD network rate, per each COUNTY Central Computer
connected teleprocessing device.
Each request to add equipment for teleprocessing will be evaluated independently,
depending upon specific circumstances of each CONTRACTOR location and ability of
COUNTY to provide additional service.
b}
Class B - COUNTY provides data circuit and modems, and specific data communication
support devices of problem isolation and resolution from COUNTY's Central Computer
to the last component of lSD-supplied equipment (usually the modem on the
CONTRACTOR end of the circuit). The CONTRACTOR is responsible for the
coordination of all problem isolation and resolution involving equipment and software
not supplied by ISD. Charges for Class B services shall be two network units at the
standard ISD network rate at each CONTRACTOR location. Teleprocessing equipment
additions are subject to ISD review and approval as COUNTY Central Computer
compatible devices.
Each request to add equipment for teleprocessing services will be evaluated
independently, depending upon specific circumstances of each CONTRACTOR location
and ability of COUNTY to provide additional services.
8.
CONTRACTOR shall pay to COUNTY a monthly sum of money per Schedule "A" attached
hereto and incorporated herein by reference. CONTRACTOR agrees to pay for all installation
costs. The total cost of additional services, equipment, related supplies and changes or
modifications will be paid for by the CONTRACTOR. The total cost to repair or replace
equipment damaged by neglect, malicious actions or accident shall be the responsibility of the
CONTRACTOR.
COUNTY shall have the right to renegotiate the rate of services performed under this contract at
the end of each fiscal year, and said rate may be adjusted upward or downward to reflect the
actual cost.
9. It is understood by and between the parties hereto that this contract shall be deemed executory to
the extent of the monies available to COUNTY and no liability on account thereof shall be
incurred by COUNTY beyond monies budgeted for the purpose thereof.
10. Training of CONTRACTOR personnel on teleprocessing equipment and operations shall be
provided by the COUNTY upon CONTRACTOR request. Training hours, charges and content
of training are to be mutually agreed upon by both parties at the time services are requested.
II.
The term of this contract shall be a period of three years commencing on July 01, 2002.
Notwithstanding the foregoing, this contract may be terminated at any time with or without cause
by CONTRACTOR or by COUNTY upon written notice given to the other party at least thirty
(30) days before the date specified for such termination. Any such termination shall coincide
with the end of a calendar month. In the event of such termination, each party shall fully pay and
discharge all obligations in favor of the other accruing prior to the date of such termination and
each party shall be released from all obligations or performance which would otherwise accrue
subsequent to the date of such termination. Neither party shall incur any liability to the other by
reason of termination.

Any and all notices required to be given hereunder shall be given in writing by registered or

operational and CONTRACTOR billing shall begin according to this date.

COUNTY agrees to indemnify and hold harmless the CONTRACTOR its officers, agents,
volunteers from any and all claims, actions or losses, damages and/or liability resulting from the
COUNTY's negligent acts or omissions which arise from the COUNTY's performance of its
obligations under this contract.
16. CONTRACTOR agrees to indemnify, defend (with counsel approved by COUNTY) and hold
harmless the COUNTY and its officers, employees, agents and volunteers from any and all
claims, actions, losses, damages and/or liability arising out of its obligations under this contract.
17. In the event the COUNTY and/or the CONTRACTOR is found to be comparatively at fault for
any claim, action, loss or damage which results from their respective obligations under the
contract, the COUNTY and/or the CONTRACTOR shall indemnify the other to the extent of its
comparative fault.
18. Furthermore, if the COUNTY or CONTRACTOR attempts to seek recovery from the other for
Workers Compensation benefits paid to an employee, the COUNTY and CONTRACTOR agree
that any alleged negligence of the employee shall not be construed against the employer of that
employee.

This contract represents the full and complete understanding of the parties with respect to the
subject matter hereto, this contract supersedes all prior oral and written agreements or
understanding between the parties with respect to the subject matter hereto. This contract shall
be governed by the laws of the State of California. Venue for any lawsuit pertaining to this
contract shall be Superior Court of California, County of San Bernardino, San Bernardino
Division. Any amendment to this contract shall be in writing signed by both parties.

I.
In this contract, the COUNTY OF SAN BERNARDINO, acting as the administrator of the
California Law Enforcement Telecommunication System (CLETS), shall hereinafter be referred to as the
"SUBSCRIBER-CONTROLLER."
II.
PURPOSE OF CONTRACT. This contract provides for the SUBSCRIBER-CONTROLLER to
serve as the agent responsible for the exchange of criminal offender record information and other
criminal justice information between USER AGENCY and the SUBSCRIBER-CONTROLLER and
statewide criminal justice agencies. In addition, it provides for SUBSCRIBER-CONTROLLER to
facilitate the interchange of computerized criminal history data between the Federal Bureau of
Investigation (FBI), National Crime Information Center (NCIC), National Law Enforcement
Telecommunications System (NLETS), Department of Motor Vehicles (DMV), and the California Law
Enforcement Telecommunications System (CLETS), received via the State CLETS network.

III.
SUBSCRIBER-CONTROLLER Security Officer will review all applications for connection to
the Telecommunications System, as well as requests to modify, move or increase the number of
terminals in an existing agency.
IV.
TERM AND TERMINATION. The term of this contract shall be for a period of three years
commencing on July 01, 2002. Notwithstanding the foregoing, this contract may be terminated at any
time with or without cause by USER AGENCY or by SUBSCRIBER-CONTROLLER upon written
notice given to the other party at least ninety (90) days prior to the date specified for such termination.
Any such termination date shall coincide with the end of a calendar month. In the event of such
termination, each party shall fully pay and discharge all obligations in favor of the other accruing prior to
the date of such termination, and each party shall be released from all obligations or performance which

V.
INFORMATION SERVICES. SUBSCRIBER-CONTROLLER agrees to furnish the USER
AGENCY access to such criminal offender record information and other criminal justice information as
is made available to the State through the CLETS network.
VI.
EOUIPMENT. SUBSCRIBER-CONTROLLER shall assist in the selection of the equipment
for, provide, maintain, operate, and manage an electronic data communications system in the San
Bernardino County Sheriffs Communication Control Center in order to provide the services specified in
this contract. SUBSCRIBER-CONTROLLER shall provide to the USER AGENCY the required
communication lines to connect with the County's Message Switcher computer. The required
equipment shall consist of:
I. Computer-to-computer interface via telecommunications circuit of the County's Message Switcher
computer to the USERAGENCY computer system, OR

2. Telecammunicatians circuit, terminals, printers, protacal canversian baxes, and ancillary suppart
peripherals to. provide camputerized access af law enforcement infarmatian. (See equipment
listing).
VII.
USER AGENCY shall pay SUBSCRIBER-CONTROLLER the sum af maney per Schedules
"An and "Bn attached hereto. and incarparated herein by reference. Basic installatian af service will be
provided by the SUBSCRIBER-CONTROLLER. Installatian fees, cast af additianal services,
equipment, related supplies and changes ar madificatians will be paid far by the USER AGENCY. The
tatal cast to. repair ar replace SUBSCRIBER-CONTROLLER supplied equipment damaged by neglect,
maliciaus actians, ar accident shall be the respansibility af the USER AGENCY. Time casts,
maintenance and diagnastic casts will be paid by the USER AGENCY. Casts will be adjusted in the
event af telephane campany rate changes. All equipment used by the USER AGENCY under this
cantract shall became the property af the USER AGENCY upan terminatian af this cantract.
SUBSCRIBER-CONTROLLER shall have the right to. adjust the cantract rates annually by an
amendment to. this cantract and at any time to. reflect increased labar casts from Memarandum af
Understanding changes which increase labar casts.
VIII.
It is understaad by and between the parties hereto. that this can tract shall be deemed executory to.
the extent af the maneys available to. SUBSCRIBER-CONTROLLER and no. liability an accaunt thereaf
shall be incurred by SUBSCRIBER-CONTROLLER beyand maneys budgeted far the purpase thereaf.
IX.
SUBSCRIBER-CONTROLLER shall render assistance to. the USER AGENCY in arder to.
provide far timely, efficient, and accurate implementatian af CAD/CLETS/RMS netwark aperatians.
The data provided to. SUBSCRffiER-CONTROLLER by the USER AGENCY will be relevant to. the
criminal justice process. The campleteness, accuracy, abjectivity, and verifiability af infarmatian
entered into. the infarmatian system is paramaunt and the USER AGENCY will caaperate with the
regular auditing af the system in accardance with the Califarnia Department af Justice CLETS Palicies,
Practices, and Procedures Manual, to. assure reliability af stored data. In additian, the procedures far
purging ar canceling entries will be adhered to. in arder to. enhance the reliability af all data. The USER
AGENCY will nat enter into. the system, data ariginating with any arganizatian nat a party to. this
cantract ar party to. a separate but similar cantract with SUBSCRIBER-CONTROLLER.
X.
The USER AGENCY agrees to. limit access to. infarmatian furnished by SUBSCRIBER-
CONTROLLER to. its awn emplayees and ather criminal justice/Iaw enfarcement agencies. The USER
AGENCY further agrees to. camply with Federal and State laws, rules, procedures, and palicies farmally

San Bernardino County IBM computer system to the Sheriffs Central Name Index (CNI), or to the
Traffic Citation System (TCITE), to complete security training before such access will be allowed.
XI.
SUBSCRIBER-CONTROLLER reserves the right to suspend access to any information provided
for in this contract, in accordance with the State CLETS Policies, Practices and Procedures Manual,
when any rule, policy, or procedure adopted by SUBSCRIBER-CONTROLLER, or approved by the
NCIC or law of this county, state, or federal government applicable to the security and privacy of
information is violated or appears to be violated by the USER AGENCY.
XII.
The USER AGENCY agrees to appoint a security and privacy officer in accordance with the
State CLETS Policies, Practices, and Procedures Manual, and as designated by the State of California
and the SUBSCRIBER-CONTROLLER who shall be responsible for all security and privacy
considerations relating to the use of the USER AGENCY's terminal or terminals. The security and
privacy officer shall be the liaison point for SUBSCRIBER-CONTROLLER regarding security and
privacy matters.
XIII.
The USER AGENCY agrees to indemnify, defend, and hold harmless the SUBSCRIBER-
CONTROLLER and its authorized officers, employees, agents, and volunteers from any and all claims,
actions, losses, damages, and/or liability arising from USER AGENCY's acts, errors, or omissions and
for any costs or expenses incurred by the SUBSCRIBER-CONTROLLER on account of any claim
therefore, except where such indemnification is prohibited by law.
XIV.
The San Bernardino County Sheriff or his authorized designee shall have the authority to
exercise the SUBSCRIBER-CONTROLLER's rights under this contract including termination of the
contract on behalf of the SUBSCRIBER-CONTROLLER at his sole discretion.
XV.
FULL UNDERSTANDING. This contract represents the full and complete understanding of the
parties with respect to the subject matter hereto, this contract supersedes all prior oral and written
agreements or understanding between the parties with respect to the subject matter hereto. This contract
shall be governed by the laws of the State of California. Venue for any lawsuit pertaining to this contract
shall be Superior Court of California, County of San Bernardino, San Bernardino Division. Any
amendment to this contract shall be in writing signed by both parties.

the County of San Bernardino to provide equipment and user access into the National Law
Enforcement Telecommunications System (NLETS), The California Law Enforcement
Telecommunications System (CLETS), and the Sheriff's Central Name Index (CNI).
Enclosed are ten (10) original agreements (five for CNI Access, FY 02/03 - FY 04/05, and five
for CLETS access and maintenance). Upon approval by the County Board of Supervisors, please

BACKGROUND INFORMATION: By State mandate, the Sheriff's Department oversees the local switching
center that allows access to CLETS by local law enforcement agencies. In turn the Department contracts
with these agencies to spread the cost of the system among the agencies using the system.
The rates for CLETS service are established based upon the actual cost charged to the Sheriff's
Department by third parties, either County ISD or outside vendors, for this service. One component of the
rates is a fee for each transaction. The number of transactions used as a basis for the current rate is based
upon the actual number of transactions for the prior fiscal year. These contracts, in the amount of
$20,574.24, are for the period of July 1, 2002 through June 30, 2005. These contracts will be amended
annually to revise the fee schedule to ensure proper remuneration to the County. Changes from last year's
contract amounts are detailed in the table below. These contracts were received from the various agencies
on June 24,2002 and thereafter and July 16, 2002 is the first available Board date for approval.
