Staff Report
Subiect:
Resolution authorizing the Mayor of the City of San Bernardino or her designee to execute an
agreement with UJIMAlCal Works relating to providing training site at City Parks, Recreation
and Community Services Department Locations.
Backl!round:
The UJlMA/Cal Works Program will provide community service program volunteer participants
to the Parks, Recreation and Community Services Department to serve in positions such as:
clerical assistants, recreation aides, cooks, kitchen helpers, and park maintenance workers.
There will be no cost to the City. These community service program clients are referred to
UJIMA by the San Bernardino Jobs and Employment Services Department (JESD). UJIMAlCal
Works then interview participants prior to referring them to our City department. JESD will pay
for participant fingerprinting. JESD/UJIMAlCal Works will provide workers compensation
benefits through the California Department of Social Service under contract with the State
Compensation Insurance Fund (SCIF). UJIMAlCal Works will also monitor participants and our
training sites for compliance with JESD guidelines and provide technical assistance to this City
department as a host site. The Parks, Recreation and Community Services Department will have
the option of accepting or not accepting clients on a client by client basis. The City will provide
training sites system wide and job site supervision at all times for the clients assigned.
Clients referred to this City department will be 18 years of age or older, English speaking and be
able to read and write English. Job site availability will be initiated upon Mayor/Council
approval of this agreement. This agreement allows for on-going training site/client referrals.
Training will be conducted on-the-job and supervised by City staff. There are no requirements
upon the City to employ UJIMAlCal Works clients. Clients shall be allotted up to six (6) month
training commitment with this City department. These types of on-the-job training program have
assisted this department and the City of San Bernardino for over thirty (30) years emanating with
the California Employment and Training Act (C.E.T.A.). The benefits to the City are substantial.
First and foremost the additional no-cost labor allows for expanded productions above and
beyond the budgeted expectation. Secondly, the on-the-job training by City staff allows for a
more qualified labor pool when job openings do occur. And last, the City in partnership with a
private non-profit, the county, and state governments demonstrates its commitment to full
employment/welfare reform as a proven method of improving the quality of life for citizens in
our community.
Financial Imuact:
There will be no cost to the city for these services.

SECTION 1. The Mayor of the City of San Bernardino or her designee is hereby
authorized and directed to execute on behalf of the City an agreement with UJIMA/CalWorks
relating to training related work sites for UJIMA/Cal Works participants, a copy of which is
hereto marked as Exhibit n A, n and incorporated herein by reference as fully as though set forth
at length,
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the City
Clerk within 60 days following the effective date of the Resolution,

COOPERATIVE WORKSITE AGREEMENT BETWEEN
UJIMAlCal Works
AND
CITY OF SAN BERNARDINO PARKS, RECREATION & COMMUNITY SERVICES
I. PARTIES INVOLVED
This Agreement is between the City of San Bernardino Parks, Recreation and Community
Services Department and UJIMAlCal Works.
It is agreed and understood by both parties that the City of San Bernardino Parks, Recreation and
Community Services Department will provide work sites for the participants in the UJIMAlCal
Works Program.
The number of participants and work period will be determined by agreement of the Parks,
Recreation and Community Services Department and the UJIMAlCal Works.
II. FURTHER AGREED
That the Parks, Recreation and Community Services Department will provide useful, work site
training experiences consistent with the participants' capabilities.
The Parks, Recreation and Community Services Department will provide supervision and
direction to the participating youth.
There shall be no reimbursement or compensation on the part of the Parks, Recreation and
Community Services' Department, either in wages or benefits of any kind. Workers
Compensation payments shall be the responsibility of the UJIMAlCal Works through the State
Compensation Insurance Fund (SCIF). The City shall not assume any administrative cost of
program sponsorship except those incurred by itself in providing for planning, monitoring or
superVISiOn.
III. PROGRAM COMPONENTS
Accurate time and attendance records will be kept in conjunction with the supervising staff
provided by the UJIMAlCal Works. The work areas for each participant will be selected by the
Parks, Recreation and Community' Services Department upon the contingent agreement of the
UJIMA/Cal Works.
Should a UJIMAlCal Works participant display inappropriate behavior or fail to perform in a
satisfactory manner. the site supervisor or manager may excuse the participants from the
program. All participants must wear official recreation staff uniforms.

UllMA/Cal Works agrees to be responsible for the financial reimbursement of the participants on
a BI-monthly basis included processing of time sheets and paychecks.
UllMAlCal Works agrees to respond as needed to emergencies or site meetings as requested by the
Parks, Recreation and Community Services Department.
IV. HOLD HARMLESS

UJIMA Cal/Works shall defend, indemnify and hold City, its officers, officials, attorneys, agents
and employees harmless from and against any and all liability, loss, expense (including reasonable
attorney fees) or claims for injury or damages arising out ofthe performance of this agreement but
only in proportion to and to the extent such liability, loss, expense, attorney's fees or claims for
injury or damages were caused by or resulted from the negligence or intentional acts or omissions
ofUJIMA/Cal Works, its officials, agents or employees, The costs, salary and expenses of the City
Attorney and members of his office in enforcing this Agreement on behalf of the City shall be
considered as "attorney's fees" for the purposes of this paragraph.

claims for injury or damages arising out of the performance of this agreement but only in proportion
to and to the extent such liability, loss, expense, attorney's fees or claims for injury or damages
caused by or resulted from the negligence or intentional acts or omissions of City, its officers, agents
or employees.
V. INSURANCE
UJIMA/Cal Works shall take out and maintain during the life of this Agreement such public liability
insurance as shall insure City, its elective and appointive boards, commissions, officers, officials,
attorneys, agents and employees, performing acts covered by this Agreement from claims for
damages for personal injury which may arise from UJIMA/Cal Works' officials, agents or
employees' operations hereunder. The amount and conditions of such insurance shall be as follows:
(a) Public Liability Insurance. In an amount not less than $1,000,000 for injuries, including, but
not limited to, death, to anyone person, in an amount not less than $100,000 on account of anyone
occurrence. The City its elective and appointive boards, commissions, officers, officials, attorneys,
agents and employees shall be named as additional insured. The Certificate of Insurance furnished
to the City shall require the insurer to notify the City in writing 10 days in advance of any change
or termination in the policy.

VI. TERMINATION CONDITIONS
Whenever it shalI be necessary for either party to give notice to the other, such notices shalI be sent
to the Director of Parks, Recreation and Community Services Department at the following address:
547 North Sierra Way, San Bernardino, CA 92410, and to UJIMAlCal Works at the following
address: P,O. Box 1434, San Bernardino, CA 92401, and such notices shalI be deemed to be received
five (5) days after.
This Agreement may be terminated at any time by either party giving fifteen (IS) days written notice
of such action to the other party.
VII. WITNESS WHEREOF, the said parties hereunto set their hands and seal this day and year.

serving meals; cleans serving area and utensils used in food service; accomplishes housekeeping
procedures; follows accepted safety practices; and maintains sanitary working conditions.

MINIMUM OUALIFICATIONS
Demonstrate the ability to follow oral and written jOb-related
instructions; have ability and willingness to perform heavy manual
labor; and, be in good physical condition.
Possession of a valid Class "c" California Drivers' License is
required. For out of state applicants, a valid driver's license is
required. A valid Class "C" California Driver's License must be
obtained within (10) days of appointment (CA Vehicle Code 12405c).
GENERAL OUALIFICATIONS

The methods, materials and equipment used in custodial work; (.
Basic methods, materials and equipment used in landscaping.
Abilitv to:
See in the normal visual range with or without correction;
Hear in the normal audio range with or without correction;
Exhibit normal range of body motion;
Transport materials and supplies weighing up to 100 pounds;
Work indoors and out in a variety of environmental conditions
including hot, cold or damp weather with exposure to
noises, vibrations, odors or dust;
Establish and maintain effective relationships with those
contacted in the course of work;
Operate and maintain mechanical and power custodial equipment,
such as floor buffers, vacuum cleaners, power mowers,
edgers and other light motorized equipment;
Accomplish minor repairs to public park buildings and
facilities;
Clean and care for buildings and equipment;
Learn other cleaning operations required in custodial work;
Maintain schedules in accomplishing assigned tasks;
Communicate effectively both orally and in writing;
Observe safety rules and regulations;
Accomplish routine custodial duties without close supervision.
