This office was requested to acquire additional right-of-way at the Northwest corner
of Tippecanoe Avenue and 2nd Street and at the Northwest corner of Tippecanoe Avenue
and Rialto Avenue, as part of the Tippecanoe improvement project.
Prior to making a firm purchase offer of just compensation to the owner of the land,
it is necessary that a determination of fair market value be made. After reviewing
recent market data available. staff has estimated the market value of the parcels to
be $795 for the Northwest corner of Tippecanoe Avenue and 2nd Street and $250 for the
Northwest corner of Tippecanoe Avenue and Rialto Avenue.
Since this project is being funded primarily by Federal funds, the Code of Federal
Regulations for right of way acquisition applies. The code states that an appraisal is
not required if the acquiring agency estimates the market value to be less than
$2,500.
Since neither of these proposed acquisitions exceed the $2,500 limit. and appraisal is
not necessary.

RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE FAIR MARKET
VALUE OF STREET AND HIGHWAY EASEMENTS AT THE NORTHWEST CORNER OF TIPPECANOE
AVENUE AND 2ND STREET AND THE NORTHWEST CORNER OF TIPPECANOE AVENUE AND
RIALTO AVENL~ AKD DETERMINING THAT AN APPRAISAL IS NOT NECESSARY.
wlffiREAS, the City of San Bernardino is contemplating the acquisition of
a Street and Highway easement at Northwest corner of Tippecanoe Avenue and
2nd Street, hereinafter referred to as "Parcel One" and the Northwest
corner of Tippecanoe Avenue and Rialto Avenue, hereinafter referred to as
"Parcel Two", in the City of San Bernardino; and
WHEREAS, Gordon E. Kammeyer and Rose J. Kammeyer are the owners of
Parcel One, and Edmond M. Perron and Bertha N. Perron are the owners of
Parcel Two; and
WHEREAS, the City desires to now acquire the said Street and Highway
easements across said lots and parcels; and
WHEREAS, City staff have estimated the fair market value of said
parcels to be less than $2,500; and
WHEREAS, Section 24.102(c) of the Code of Federal Regulations state
than an appraisal is not necessary if the estimated value of the proposed
acquisition is less then $2,500.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That said Street and Highway easements across said Parcel
One and said Parcel Two are described fully in Exhibit "A" and Exhibit "B",
attached hereto and incorporated by reference as fully as though set forth
in length herein.
SECTION 2. That the fair market value of said Parcel One is hereby
determined to be SEVEN HUNDRED NINETY-FIVE DOLLARS ($795.00) and the fair
market value of said Parcel Two is hereby determined to be TWO HUNDRED FIFTY
DOLLARS ($250.00) and authorizing payment thereof.

that the fair market value of said proposed acquisitions is less than S2,SOO
