2 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING MAY
3, 1982, at 7:00 A.M. AS THE TIME AT WHICH THE VACATING OF FOURTH
3 STREET BETWEEN ARROWHEAD AVENUE AND SIERRA WAY, MOUNTAIN VIEW
AVENUE BETWEEN THIRD STREET AND FIFTH STREET, AND THAT CERTAIN
4 UNNAMED ALLEY LYING SOUTH OF FIFTH STREET AND EAST OF MOUNTAIN
VIEW AVENUE, BECOMES EFFECTIVE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 II SECTION 1. The Mayor and Common Council of the City of San
8 I Bernardino have heretofore established by Resolution No. 82-118
9 that Fourth Street between Arrowhead Avenue and Sierra Way,
10 11Mountain View Avenue between Third Street and Fifth Street, and
11 11that certain unnamed alley lying south of Fifth Street and east
12
of Mountain
View Avenue, are no longer
needed for present
or
13
prospective
public street purposes, and
should be vacated;
and
14
have ordered
that such streets shall be
vacated subject to
the
15 II submission of written assurances from all involved utilities to
16 11relocate all utilities at no cost to the City, and other
17
assurances from
the County of
San Bernardino.

SECTION 2.
The County
of San Bernardino has offered
19 satisfactory assurances, and has provided written assurances
20 from all involved utilities, except the Board of Water Commis -
21 11sioners of the City of San Beranrdino, that all utilities will be
22 relocated at no cost to the City. The Board of Water Commis -

sioners of the

will consider
this matter

( at its meeting
on April
20,
1982, and
no objection
by that Board
25 is anticipated.
26 SECTION 3. The Mayor and Common Council of said City do
27 hereby declare that Fourth Street between Arrowhead Avenue and
28 Sierra Way, Mountain View Avenue between Third Street and Fifth

Street, and that certain unnamed alley lying south of Fifth
Street and east of Mountain View Avenue, will be vacated effective
May 3, 1982, at 7:00 a.m., provided that the Mayor signs this
resolution. The Mayor is authorized to sign this resolution only
upon receipt from the County of evidence that the Board of Water
Commissioners has no objection to the vacating of the streets, and
upon receipt from the County of written assurances that continued
pedestrian and motor vehicle traffic for access to and from the
Central Fire Station and Central Library will be permitted.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a regular meeting thereof, held
on the 19th day of April 1982, by the following

RE: Property Street Vacations
4th Street between Arrowhead
and Sierra Way
Mt. View between 3rd & 5th St.
Please be advised that the Water Department has existing facilities within the
referenced public rights of way that would be affected by the proposed vacations.
Contact has been made by the San Bernardino County representatives regarding
the overall development of the County's proposed County Center Complex. These
contacts have resulted in assurances that the County will acknowledge and honor
our existing rights, will define any necessary facility changes due to the pro-
posed construction and will grant appropriate Easements to this Department for
any alignment changes or existing alignments that will remain.
It is our desire that you may proceed with the total vacation of the referenced
streets retaining no utility reservations on behalf of this Department.
