HomeMy WebLinkAbout1982-1811 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 82-181 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SALE OF TWO PARCELS OF REAL PROPERTY LOCATED WITHIN THE CENTRAL CITY NORTH EXPANSION PROJECT AREA TO EUNICE RAINBOLT BY THE REDEVELOP- MENT AGENCY OF THE CITY OF SAN BERNARDINO AT LESS THAN THE FULL MARKET VALUE TO EFFECT THE PURPOSES OF THE PLAN (HEALTH AND SAFETY CODE SECTION 33433). BE IT RESOLVED BY THE MAYOR AND COYMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. (a) The Redevelopment Agency of the City of San Bernardino (Agency) proposes to sell to Eunice Rainbolt (Developer) two parce of real property located within the Central City North Expansion Project Area, described in Exhibit "A" attached hereto and incor- porated herein by reference as though set forth in full, for the sum of $120,000.00 which will be paid by the Developer in cash. (b) Public hearing was held in this matter on April 5, 1982, notice of which had been given as required by law. (c) Agency has made available for public inspection and copying a summary of financial aspects of the proposed sale (d) The Redevelopment Agency of the City of San Bernardino represents that it has made diligent effort to sell this property at full market value, and has been unsuccessful in obtaining appraised value therefor, and that the best offer it has been able to receive is $120,000.00. (e) All hearings have been held as required by Health and Safety Code Section 33433. (f) Comparable sales information has been developed by Robert O. Self, Operations Coordinator of the Redevelopment Agency of the City of San Bernardino, establishing that three parcels of land in the general area of such property, bearing similar LS 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 zoning category, have been sold in the recent past, for prices substantially comparable to that proposed in this instance, as set forth in the memorandum from Robert O. Self to Glenda Saul, April 14, 1982, a copy of which is annexed hereto and incorpora herein by reference as Exhibit "B". (g) Although two prior offers in excess of the present offer have previously been received by the Redevelopment Agency, and have been accepted, both such offers have failed to be carried out, and no offer in excess of $120,000.00 is available at this time. The proposed sale has been publicly advertised. (h) The exact market value of the property is unknown; an earlier appraisal establishing the property to be valued at $202,000.00 is of questionable validity at this time, and the study of comparable sales establishes that the market value may not be substantially greater than $120,000.00. (i) This property was originally obtained by the Agency as part of a transaction necessary to assure that a major public service agency, the Social Security Administration's main public office, would relocate within the project area, and there render invaluable service to the elderly and disabled citizens of the City, and increase the number of persons doing business in the project area. (j) As part of the undertakings of that transaction, City has made certain commitments and assurances to the Downtown Park, District that funds advanced by that District would be paid by City to the District upon sale of this subject property. (k) Sale of this property will enable City to keep its -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 commitments and assurances to said District, and better enable said District to provide the parking necessary for the success of the general plan for the Central City North Expansion Project I Area. (1) Immediate sale of the property is necessary to enable the Downtown Parking District to provide the additional parking facilities needed to assure success of said project plan. SECTION 2. Determination. Based upon the representations of Agency, and on the factors set forth above, it is found and declared that the consideration for the real property described in Exhibit "A", in accordance with covenants and conditions govern• ing the sale, though slightly less than the fair market value, is the best price obtainable at the present time, and that sale for that price is necessary to effectuate the purposes of the Central City North Expansion Project Area Plan. SECTION 3. Approval. The Mayor and Common Council of the City of San Bernardino hereby approve the sale of said property on the terms and conditions set forth in this resolution and the summary of financial aspects.
