Authorization to Proceed for establishment of Landscaping
Maintenance, Mill & Macy Area.
Recommended motion:
That the City Engineer and City Clerk are authorized to expand the Scope
of Assessment District No. 989 (Mill and Macy Area Landscape Maintenance
District) under the provisions of Chapter 12.90.060 of the San Bernardino
Municipal Code to include the maintenance of a sewer lift station and to
change the name of the district to Mill and Macy Area Landscape and Sewer
Lift Station Maintenance District.

On November 22, 1988, this office received a petition from the Developer of
Tentative Tract No. 13457 to form an assessment district for the maintenance of
landscaping along the-South side of Mill Street generally between Macy Street
and a point approximately 985 Westerly thereof. This petition was the result of
a requirement by the City to establish the district.
SUbsequently and due to the necessity of installing a sewer lift station at the
South end of the Tract, the owner has requested that the maintenance of the lift
station be accomplishesLthrough an assessment district. Since the City would
otherwise .have to maintain the lift station and since it will be the cost of
maintaining the lift station and not constructing same, it is the recommendation
of this Department that we include such maintenance with the maintenance of
landscaping together in one district. The maintenance of the lift station was
not a condition of the approval of the Tract and this will afford the City the
opportunity to spread the cost of maintenance to those property owners who will
benefit thereby.
The signatures affixed to the referenced petition have been checked and found to
represent the owners of 100 percent of the area of the property lyi ng wi thi n
the proposed area liable to be assessed for the proposed maintenance.
The developer wi 11 be requi red to up-front the cost of the proceedi ngs for the
establishment of the district which will now include the maintenance of the
sewer 1 ift sta ti on.
