2 I RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING
THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF A TRAFFIC
3 i SIGNAL ASSESSMENT DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER
WORK WITHIN THE DISTRICT, TO BE KNOWN AS THE "STATE COLLEGE PARKWAY SIGNAL-
4 IZATION DISTRICT", AND SETTING AND DIRECTING PUBLICATION OF NOTICE OF A
TIME AND DATE OF A PUBLIC HEARING.

WHEREAS, the City of San Bernardino (hereafter called "City")
6
as an exercise of its municipal affairs powers has enacted an Assessment
7
District Ordinance (Ordinance No. 3963) to provide for the procedure
8
for the formation of assessment districts within the City; and
9
WHEREAS, it has now become necessary to consider the formation of
10
a traffic signal assessment district within the City, to be known as
it
"State College Parkway Signalization District"; and
12 WHEREAS, as a further exercise of the powers vested in the City
13
by virtue of Section 19, Article XVI, California Constitution, the
14 City intends to conduct a hearing and hear protest, if any, as to
15 why the district should not be formed and the acquisitions and improve-
16 ments completed, without compliance with the Special Assessment Investi-
17
gation, Limitation and Majority Protest Act of 1931;
i8 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
19 THE CITY OF SAN BERNARDINO THAT:
20 SECTION 1. Pursuant to Ordinance No. 3963, the Mayor and Common
21 Council of said City, hereby preliminarily find and determine that the
22 public convenience and necessity require and it is the intention of the
23 Mayor and Common Council to form the State College Parkway Signalization
24 District, generally bounded as follows:
25 ~ On the South by U.S. Interstate 15E; On the West by the
San Bernardino County Flood Control District's Devils Canyon
26 Diversion Channel; On the North generally by Kendall Drive;
And on the East generally by Brookfield Drive.

1 Reference is hereby made to the Engineer's Report entitled State
2 College Parkway Signalization District, on file in the office of the
3 City Clerk of said City for a map of the boundaries of said district,
4 a description of the type of improvement, an estimated cost of the
5 improvement, and a first year's proposed assessment roll.
6 SECTION 2. It is the intention of said Mayor and Common Council
7 to order improvements within the district, which improvements consist
g of, but are not limited to, the installation of traffic signals and
q lighting, all appurtenances and related construction at the intersection
10 ~ of State College Parkway and College Avenue; regrading and installation
it of left hand turn lanes between Kendall Drive and U.S. Interstate Highway
12 15E; the addition of a third traffic lane on each side of State College
13 Parkway between Kendall Drive and U.S. Interstate Highway 15E; and
14 regrading for future traffic signals at the intersection of State College
15 Parkway and the Southerly terminus of State Street.
16 The estimated cost of said improvements and construction, including
5 year term incidental costs is $545,500.
18 SECTION 3. Said contemplated work and improvement is of more
19 than local or ordinary public benefit, and said Mayor and Common Council
20 do hereby make the expense of such work and improvement chargeable upon
21 the district, which district is hereby declared to be the district benefited
22 by said proposed work and improvement, and to be assessed to pay the cost
and expense thereof. All public streets or alleys, or portions thereof,
23
24 all governmentally owned properties, all school district and utility owned
25 properties are hereby excepted from the assessment.
SECTION 4. The assessment benefit procedure to be followed and the
26
amount to be assessed against each particular parcel will be a proportion
27
of the total sum of the cost of the improvements and incidentals within
28
the area of the total district in relation to the following formula;

1 One Basic Assessment Unit will be applied per residential unit.
2 Undeveloped acreage property will be divided into 7200 square foot
3 arbitrary units which will also be assessed one Basic Assessment Unit
4 per arbitrary unit. Upon development of the areas the following will
5 apply:
6 A. Property lying within any R-1 zone will be assessed with
7 one Basic Assessment Unit per residential unit.
8 B. Property lying within any R-3 zone or PRD zone will be assessed
9 by applying one Basic Assessment Unit per residential unit.
10 C. Property lying within any C-2 zone will be assessed by applying
it three Basic Assessment Units per 7200 square foot arbitrary
12 it units due to traffic generated by commercial use.
13 ~ The exception to the above will be for the churches that are within
14 the district which will carry two Basic Assessment Units per church, due
15 to infrequent but concentrated use.
16 Reference is hereby made to said Engineer's Report on file in
17 the office of the City Clerk for a detailed estimated individual
18 assessment for the first year.
19 SECTION 5. The assessment financing alternative to be followed shall
20 be as follows, to wit:
21 The costs shall be pre-funded by the City and the assessment levied,
22 collected, and enforced in the same manner, at the same time, and with
23 the same penalties and interest as in the case of taxes levied for the
24 City for the repayment to the City of said prefunding. The assessment
25 for said district shall be levied and collected for five (5) fiscal
26 years, including the cost of ongoing required administration.
SECTION 6. Notice is hereby given that on October 5, 1981, at the
27
hour of 2:30 P.M. in the Council Chamber, in the City Hall of said City,
28
there shall be a public hearing before said Mayor and Common Council for the

1 purpose of determining whether the public convenience and necessity
2 require the formation of the proposed district without compliance with
3 the Special Assessment Investigation, Limitation and Majority Protest
4 Act of 1931 and whether the Mayor and Common Council should proceed
g with ordering the above described improvement.
6 At said hearing, any and all persons interested may appear and
7 show cause, if any they have, why the Mayor and Common Council should
g not find and determine that the public convenience and necessity require
q the formation of the proposed district without compliance with the
10 Special Assessment Investigation, Limitation and Majority Protest Act
11 of 1931; on the question of estimated cost, and the intention of the
12 Mayor and Common Council to proceed to order work within the district.
13 SECTION 7. At said public hearing, all persons will be heard.
14 Any holder of title to taxable real property within the boundaries of
15 the proposed district may file a protest in writing with the City Clerk
16 containing therein a description of the property in which the signer
17 thereof is interested sufficient to identify the same and, if the signers
18 are not shown on the last equalized assessment roll as the owners of such
19 Property, must contain or be accompanied by written evidence that such
signers are the owners of such property. The basis for determining the
20
existence of a majority protest shall be based on the formula as mentioned
21
in Section 4 herein in relation to the total number of Basic Assessment
22
units within the entire district.

SECTION 8. The City Clerk is authorized and directed to cause a
24
copy of this resolution to be published in a newspaper of general cir-
25
culation published in the City, and that said Clerk shall cause a notice
26
of the adoption of this resolution to be posted and mailed as required
27
by Section 5(b) of Ordinance No. 3963.

i SECTION 9. A copy of this resolution and a map showing the exterior
2 boundaries of the proposed district with relation to the territory
3 immediately contiguous thereto will be on file with the City Clerk and
4 will be available for inspection by any person or persons interested.
5 This map shall govern for all details as to the extent of the proposed
6 improvement district.
7 I HEREBY CERTIFY that the foregoing resolution was duly adopted
g by the Mayor and Common Council of the City of San Bernardino at a n
9 Adiourned Regular meeting thereof, held on the 17th day of
10 August 1981, by the following vote, to wit:

Regarding the improvements of the State College Parkway area by the -
construction of traffic signals and lighting, all appurtenances and
related construction at the intersection of State College Parkway .
and College Avenue; regrading and installation of left hand turn lanes
between Kendall Drive and U.S. Interstate Highway 15E; the addition .

traffic signals at the intersection of State College Parkway and the
Southerly terminus of State Street, the costs are estimated as follows:
Total cost of construction: $540,500
5 year estimate of administrative cost: 5,000
~- Estimated Total to be assessed: $545,500 •
-This information together with the attached ASSESSMENT DISTRICT MAP
and PROPOSED ASSESSMENT. ROLL is being filed in your office pursuant
to the.City's Assessment District Ordinance relative to the forthcoming'
Resolution of Intention for the establishment of an assessment district
in the State College.Parkway area. -
