BERNARDINO~UTaoRIZING THE REpEVELOJ!>~ AG~CY OF THE THE SALE OF SURPLUS CITY BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of the City an Agreement with the Redevelopment Agency of the City of San Bernardino relating to the sale of surplus City property, a copy of which is attached, IIIllrked Exhibit uA". The parties agree as follows: 1. Reci tal s . (a) Health and Safety Code Section 33220 au~orizes a city to transfer property, located within a redevelopment project area, to a redevelopment agency, to aid the redevelopment project. (b) City owns certain real property, located in the C.entral City East Redevelopment Project Area, which is surplus to the city's needs. (c) City desires to transfer the surplus property to Agency, in order that Agency may prepare, market and resell the pro~erty for development in accordance with the redevelopment plan. 2. Conveyance. City agrees to convey to Agency, and Agency agrees to purchase from City,.pursuant to the terms and conditions of this agreement, in its present condition, the real property, referred to. in this agreement as "the premises", more particularly described in the document marked Exhibit "I", .attached to this agreement. 3. Consideration. I I I , promptly I after I ! i I (b) After Agency resells the property, Agency shall pay to City the net proceeds of its sale of the property, deducting all expenses incurred by Agency in connection with preparing the property for sale and in selling the property. 4. Agency Obligations. It is understood and agreed that Agency will use its best efforts to resell the premises for development, such development to be consistent with the Redevelopment Plan for the Central City East Redevelopment Project Area. All necessary work in connection with marketing and reselling the premises, including but not limited to preparation and filing of parcel maps and any required earth filling, excavation, or other work on the premises shall be the responsibility of Agency. Agency shall obtain an independent appraisal of the property from a qualified real estate appraiser. Agency shall not sell the property for less than its appraised value.. If Agency has not sold the property within one year after the date of this agreement, Agency shall reconvey the property to City upon demand from City.
