HomeMy WebLinkAbout1989-225 , 1 RESOLUTION NO. 89-225 2 RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND DETERMINING THE FEES AND CHARGES TO BE CHARGED FOR THE COLLECTION AND DISPOSAL OF REFUSE, AND 3 REPEALING RESOLUTION NO. 88-308 AND AMENDMENTS THERETO, AND PROVISIONS FOR AUTOMATED RESIDENTIAL REFUSE COLLECTION. 4 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. The fees and charges set forth herein shall apply to refuse 8 collection services provided by the City. 9 SECTION 2. A minimum twenty-five dollar ($25.00) deposit shall be 10 required for each new commercial refuse account. Said deposit must be paid 11 prior to the City commencing refuse collection service. This deposit shall be 12 retained by the City commencing refuse collection service. This deposit shall 13 be retained by City and applied to any closing bill upon termination of 14 service. Any excess amount shall be refunded. 15 SECTION 3. Collection and Disposal of Refuse - Single Family residences. 16 For collection and disposal of refuse, the owner or authorized agent, of any 17 single-family residential premises, or portions, thereof, located within the 18 territorial limits of the City of San Bernardino, shall pay the following fee: 19 $9.50 per month for regular curbside or alley service. 20 $9.50 per month for two (2) times perweek automated refuse service plus 21 $7.00 per month for each additional ninety (90) gallon automated container 22 requested. City is to provide each residence with one (1) ninety (90) gallon 23 container for automated collection only. Request(s) for additional 24 container (s) must have approval of property owner. Service is to be 25 implemented for approximately 8,000 single-family dwellings and will be in 26 five (5) sections throughout the territorial limits of the City of San 27 Bernardino which are on file in the Department of Public Services. 28 SECTION 4. Collection and Disposal of Refuse - Multiple Dwellings, 9 10 11 - Apartments, Etc. For collection and disposal of refuse, the owner, or 2 authorized agent, of any apartment house, court, mobile home park, trailer 3 court, 4 fees: 5 6 7 8 duplex or other multiple dwelling unit complex shall pay the following NUMBER OF UNITS AND TOTAL FEE PER roNTH 2 Units $11. 75 3 Units $17.15 4 Units $22.35 5 Units $27.25 More than 5 units: $27.25 plus $4.75 for each unit over 5. 12 It shall be the duty of the Director of Public Services to determine the 13 number of units actually used, or capable of being used, for housekeeping 14 purposes and to adjust the assessment for each use accordingly. 15 SECTION 5. Collection and Disposal of Refuse - Hotels, Offices, Etc. 16 (a) For collection of refuse the owner, or authorized agent of any 17 hotel, office building, restaurant, shop, store, hospital, auto court, motel 18 or other similar place shall pay the following fees, based on the placement 19 for collection of not more than two (2) thirty-two (32) gallon containers per 20 collection: 21 22 23 24 25 26 27 TIMES PER WEEK FEE PER MONTH 1 $ 8.15 $ 9.50 $14.60 $24.10 $36.95 2 3 4 5 SECTION 6. Collection and Disposal of Refuse utilizing bins and 28 automatic loading equipment. (a) When the refuse collection is performed by means of bins and City -2- 1 automatic loading equipment the roonthly fee shall be as follows for each 2 collection per week. Yd. $96.65 $112.65 $16.00 11 *Includes roonthly Bin Rental Fee. 12 (b) All fees pursuant to this Section shall be reviewed periodically and, 13 on the basis of findings, monthly fees shall be adjusted to maintain 14 conformance with the fee schedule set forth in Subsection (a) above, except 15 that roonthly fees shall not be adjusted in relation to temporary variations of 16 refuse due to seasonal factors, where such variations from the average do not 17 extend beyond a three-roonth period. 18 (c) When a City-owned bin is requested for use on a temporary basis, a 19 special delivery charge of thirteen dollars and fifty cents ($13.50) shall be 20 made for each such bin, in addition to the regular roonthly bin rental fee; said 21 roonthly rental fee shall be prorated for the period of such use, in increments 22 of not less than one (1) week. A service fee equal to twenty-five percent 23 (25%) of the regular roonthly collection and disposal fee for the size of bins 24 so-utilized shall be charged for each time the bin is serviced. 25 SECTION 7. Collection and Disposal of Refuse utilizing compaction-type 26 containers with a capacity 3 - 8 cubic yards. 27 When the service performed by the City is the collection and disposal of refuse 28 placed for collection in City-approved compaction type containers -3- 1 having a capacity from three (3) to eight (8) cubic yards, the monthly fee, for 2 one time per week collection, shall be as follows: 3 4 5 6 7 8 CONTAINER CAPACITY FEE PER MONTH 3 Cu. Collection and Disposal of refuse utilizing compaction-type 10 containers and commercial drop-bodies. 11 (a) When the service performed by the City is the collection and disposal 12 of refuse placed for collection in City-approved compaction-type containers or 13 commercial drop-bodies, having a capacity of 10, 15, 20, 30, or 40 cubic yards, 14 the fee for each time of collection shall be as listed below. A monthly rental 15 fee shall be charged for the use of City-owned containers and shall be in 16 addition to the collection and disposal fee. 17 TIPPING SERVICE FEE PER CONTAINER CAPACITY CHARGE FEE* PICK UP 18 10 Cu. MONTHLY RENTAL FEE $40.00 $55.00 $70.00 24 (b) In the event the City is required to pay a tipping charge for weight 25 in excess of the above tonnage schedule, that charge shall be a debt of the 26 customer based on a tipping fee at the rate of eighteen dollars and fifty cents 27 ($18.50) per ton and shall be added to the base fee due the City. 28 (c) Removal of tires shall be at the rate of fifty-one dollars ($51.00) -4- 1 per ton Disposal Fee plus forty dollars ($40.00) Service Charge. 2 SECTION 9. The Director of Public Services, upon request, may provide for 3 the special collection and removal of refuse from any place or permises at any 4 time, in addition to or beyond the regular collection service schedule, or in a 5 manner different from normal collection practice and procedures. The rate for 6 any such special service shall be fifty dollars ($50.00) per hour with a 7 minimum charge of twelve dollars and fifty cents ($12.50). 8 SECTION 10. All fees and charges set forth in this resolution shall be 9 collected monthly. 10 SECTION 11. Any service for the collection and disposal of refuse as set 11 forth in this resolution may be discontinued by the Director of Public Services 12 if any fees or cahrges, as levied herein, are not paid within ninety (90) days 13 from the date said assessment is billed. 14 SECTION 12. The Mayor and Common Council may exempt from the fee 15 provisions and charges of this resolution certain nonprofit events in the 16 public interest. The exemption shall be subject to any conditions imposed by 17 the Director of Public Services. 18 SECTION 13. The Director of Public Services may provide collection and 19 disposal service without charge in emergency situations and when, in the 20 opinion of the Director, such action is necessary to correct fire hazards, or 21 other conditions which present an imminent threat to health and safety. 22 SECTION 14.
