RESOLUTION NO. 89-218
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
3 TO' ORDER THE VACATION OF A PORTION OF THAT CERTAIN UNNAMED EAST/WEST STREET
LOCATED SOUTH OF HIGHLAND AVENUE AND EAST OF ELMWOOD ROAD AND RESERVING AN
4 EASEMENT FOR WATER LINES AND PUBLIC UTILITIES THEREIN .

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
6 BERNARDINO AS FOLLOWS:

SECTION 1.
That the Mayor and Common Council of the City of San
8 Bernardino hereby declares it's intention to order the vacation of a

portion of that certain unnamed EastfWest Street located south of Highland
Avenue and east of Elmwood Road , described as follows:
That portion of that certain unnamed EastfWest Street
shown on the map of Tract No. 3879, Highland Park, as per
map recorded in Book 50 of Maps, page 50, in the office
of the County Recorder of the County of San Bernardino,
State of California, described as follows:
Beginning at the Northwest corner of Lot 2 of said tract;
thence East, along the North lines of Lots 2, 3, 4, 5, 6
and 7 of said tract, to the Northeast corner of said Lot
7; thence North, along the Northerly prolongation of the
east line of said Lot 7, a distance of 40 feet more or
less, to the South line of Highland Avenue, as shown said
map; thence West, along said South line, to it's
intersection with the Northerly prolongation of the West
line of said Lot 2; thence South, along said
prolongation, a distance of 40 feet, more or less, to the
Point of beginning.
SECTION 2.
That the Mayor and Common Council of the City of San
Bernardino,
in vacating the above described portion of said street ,elects
to proceed under and in accordance with the provisions of the "Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
the Streets and Highways Code of the State of California.
SECTION 3.
That the hour of 10:00 A.M. on the July 17, 1989,
in the Council Chamber of the City Hall, San Bernardino, California,
be,
and the same hereby is fixed as the time and place when and where

persons interested in or objecting to the proposed vacation may appear
2 before the said Mayor and Common Council and offer evidence in
3 relation thereto.
For further particulars as to the proposed vacation of
4 the hereinbefore described portion of said street, reference is made to that
5 map marked "Plan No. 7604" approved on October 24, 1988, on file in the
6 office of the City Clerk of said City.

SECTION 4. Nothing in this Resolution shall in any way affect
8 or disturb any existing easements for public utility purposes belonging
9 either to the City of San Bernardino or to any public utility and there
10 is hereby reserved an easement for future utility purposes for this City and
II for public utility purposes, more particularly and easement for water lines
12 and appurtenant facilities to East Valley Water District over the entire
13 portion of the real property hereinabove described, and for Southern
]4 California Gas Company Company, an easement and right at any time, or from
15 time to time to construct, maintain. operate, replace and renew
16 appurtenances thereto for the transportation of natural gas, in, over, under
17 and across the Southerly 20 feet of the real property hereinabove
18 described.
19 SECTION 5. That the City Engineer of the City of San Bernardino
20 hereby is directed to cause Notices of Street Vacation to be posted as
21 required by the Public Streets, Highways and Services Vacation Law.
22 SECTION 6. That the City Clerk shall certify to the adoption of

this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper published and
circulated in the City of San Bernardino. prior to the date of the above
public hearing.
