RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND
DETEm1INING THAT THE PUBLIC CO~VENIENCE AND NECESSITY REQUIRE
THE AMENDMENT OF BOUNDARIES OF'ASSESSMENT DISTRICT NO. 962 BY
EXPANDING THE BOUNDARIES THEREOF TO INCLUDE ADDITIONAL
TERRITORY IN THE DISTRICT FOR THE /1AINTENANCE OF A SEWER LIFT
STATION IN THE AREA OF PINE AND BELMONT AVENUES; ORDERING THE
AMENDMENT AND EXPANSION OF THE DISTRICT AND THAT THE SPECIAL
ASSESSMENT, INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT
APPLY AND APPROVING AMENDED ASSESSMENT DISTRICT DIAGRAM MAP
NO. 962.
WHEREAS, by Resolution No. 84-523 adopted December 17,
1984, the Mayor and Common Council of the City of San
Bernardino created Assessment District No. 962 for the
maintenance of a sewer lift station in the area of Pine Avenue
and Belmont Avenue; and
WHEREAS, the Mayor and Common Council of the City of
San Bernardino have preliminarily found that the public
interest, convenience and necessity require the amendment of
the boundaries of Assessment District No. 962 by the expansion
thereof to include additional territory; and
WHEREAS, the Mayor and Common Council of the City of
San Bernardino have, on the 11th of May, 1937, passed and
adopted Resolution No. 87-140 entitled:
RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY
DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY
REQUIRE THE &~NDMENT OF BOUNDARIES OF ASSESSMENT DIS-
TRICT NO. 962 BY EXPANDING THE BOUNDARIES THEREOF TO
INCLUDE ADDITIONAL TERRITORY IN THE DISTRICT; DECLARING
ITS INTENTION TO PROCEED TO ORDER THE AMENDMENT AND
EXPANSION OF THE DISTRICT; AND WAIVING NOTICE AND
HEARING.
which said resolution indicated that the City elected to
proceed without Notice and Hearing pursuant to Section
12.90.040C(5) of the Municipal Code as the request to expand

1 the boundaries of the existing District represents 100% of the
2 property owners liable to be assessed for the said maintenance.
3 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
4 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. That the public convenience and necessity
6 require, and the Mayor and Co~~on Council of the City of San
7 Bernardino hereby declares by not less than a 4/5th vote as
8 defined in Section 12.90.040D of the San Bernardino Municipal
9 Code, that the public interest, convenience and necessity
10 requires and hereby orders, the amendment of the boundaries
11 of Assessment District No. 962 by expanding the boundaries
12 thereof to include additional territory in the district; the
13 work described in said Resolution No. 87-140 to be done as
14 provided in said Resolution and that the Special Assessment,
15 Investigation and Limitation Act of 1931 shall not apply.
16 SECTION 2. Reference is hereby made to said Resolution
17 No. 87-140 for a description of the work, the extent of the
18 assessment district, the financing alternatives and for further
19 particular s.
20 SECTION 3. That Amended Assessment District Diagram
21 Map. No. 962 is hereby approved.
