RESOLUTION NO. 86-1S8 1 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND 2 DIRECTING EXECUTION OF THREE AGREEMENTS BETWEEN REDEVELOPMENT 3 AGENCY AND THE CITY OF SAN BERNARDINO CONCERNING CONTRACTING FOR HOUSING, BEAUTIFICATION AND GRANT WRITING SERVICES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 5 OF SAN BERNARDINO AS FOLLOWS: 4 SECTION 1. Agency agrees to retain, and City 20 agrees to provide, the services of the Community Development 21 Commission of the City Administrator's Office to perform or have 22 performed all necessary services in connection with projects 23 undertaken by Agency, or being considered by Agency, in 24 connection with the beautification program. City shall render in 25 a satisfactory manner all such services necessary and desired, 26 and shall confer when necessary with the Agency. The services to 27 be included are those set forth in Exhibit "1" attached hereto 28 and incorporated herein by reference. A G R E E MEN T (Beautification Program Services) 1 1 (b) Comoensation. Agency will pay to City the sum 2 of $3,796.00 for completion of the presently funded 3 Beautification Program, for the services rendered and to be 4 rendered in connection herewith. If additional funds are made 5 available for Beautification, terms shall be negotiated. 6 (c) Termination. Recitals. (a) Agency has for some time performed grant 12 writing services as part of its regular activities, and desires 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 that these services be provided for the Agency by the City as contractual services. (b) City, through its Community Development Division of the City Administrator's Office, is willing and able to provide those services for the Agency. 2. Implementation. (a) Services. Agency agrees to retain, and City agrees to provide, the services of the Community Development Commission of the City Administrator's Office to perform or have performed all necessary services in connection with projects undertaken by Agency, or being considered by Agency, in connection with grant writing. City shall render in a satisfactory manner all such services necessary and desired, and shall confer when necessary with the Agency. The services to be included are those set forth in Exhibit "I" attached hereto and incorporated herein by reference. 1 1 (b) Comoensation. When and as services are desired 2 by Agency, the Executive Director shall issue a purchase order 3 for grant writing services if the expected cost is within her 4 contracting authority, or an agreement shall be negotiated on a 5 case-by-case basis for services expected to cost more than 6 $3,500.00. City shall provide such services on a basis to assure 7 full reimbursement of all costs incurred, including reasonable 8 overhead. 9 (c) Termination. The serv~ces to be 27 included are those set forth in Exhibit "1" attached hereto and 28 incorporated herein by reference. A G R E E MEN T (Housing Services) 1 1 (b) Compensation. Agency will pay to City the sum 2 of $84,000.00 annually, payable in monthly installments, for the 3 services rendered and to be rendered in connection herewith. In 4 addition, to provide funding for creation and establishment of an 5 ongoing housing program by City, Agency shall make available to 6 City the 20% housing set aside funds from the Tri-City 7 Redevelopment Project area, to be expended by City to meet the 8 requirements of state law for housing programs, which funds shall 9 be utilized to increase and improve the supply of low and 10 moderate income housing within the City of San Bernardino. Such 11 funds shall be transferred by Agency to City as soon as 12 practicable after receipt of tax increment funds by Agency from 13 the County of San Bernardino. 14 (c) Termination. (6) Coordinate with Planning Department in determining number of single and multi-family housing starts in City. (7) Implementation of various California Housing Finance Agency (CHFA) and State Housing and Community Development .Department programs, including, but not limited to, the Rental Housing Construction Program (RHCP), The Multi-Family Infill New Construction Program, the self-help program and the Rehabilitation Deferred Program. (8) Maintain all appropriate records with respect to the single and multi-family bond programs, single and multi-family housing starts within the corporate boundaries of the City, and CHFA and HCD-sponsored programs. Budget of $84,000 payable in twelve (12) equal installments of $7,000 per month. In addition, the Agency will pass through to Community Development Division of City that portion of the twenty-percent 4
