HomeMy WebLinkAbout1986-200 1 RESOLUTION NO. 86 700 2 RESOLUTION EXECUTION OF AN 3 MITTEE RELATING OF THE CITY OF SAN AGREEMENT WITH SAN TO CO-SPONSORING A BERNARDINO AUTHORIZING THE BERNARDINO CITY WIDE UNITY COM~ UNITY CONCERT ON JUNE 7, 1986. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The Mayor of the City of San Bernardino is 7 hereby authorized and directed to execute on behalf of said City 8 an agreement with San Bernardino City Wide unity Committee 9 relating to co-sponsoring a unity concert on June 7, 1986, a copy 10 of which is attached hereto, marked Exhibit "A" and incorporated 11 herein by reference as fully as though set forth at length. 12 I HEREBY CERTIFY that the foregoing resolution was duly 13 adopted by the Mayor and Common Council of the City of San 14 Bernardino at a reaular 15 held on the 2nd day of Jnne 16 vote, to wit: meeting thereof, , 1986, by the following 17 18 19 20 21 22 23 24 25 26 Council Members AYES: R~rrnnn RAilly Hj::l.rn~nn~'7 . City and Organization agree as fellows: 1. Recitals. A. City and Organization desire to co-sponsor a unity concert to promote civic participation and culture within the City of San Bernardino, provide youth with an opportunity to display their talents in a wholesome setting, and develop awareness on the part of the citizens of the need to stand , together in support of law enforcement officers and city officials. B. It is the desire of City and Organization that a unity concert will provide a stimulus on the part of youth and adults to care for private property, stem the tide of drug traffic, and renew appreciation of the benefits of San Bernardino as a city having a favorable family environment. 2. Event and Facility. City and Organization shall co- sponser a unity concert on June 7, 1986, from 2:00 p.m. to 8:00 24 p.m. which shall be held at Roosevelt Bowl in Perris Hill Park. 25 3. Responsibilities of Organization. Organization shall: 26 A. Provide the necessary manpower for the setup and 27 breakdown of its own equipment. 28 B. Provide day time and overnight security as 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 necessary. C. Provide continuous cleanup during the activities and leave area in a neat and clean condition. D. Provide personnel to empty trash receptacles into trash bins provided by City. 4. Responsibilities of City. City shall: A. Permit the use of Roosevelt Bowl in Perris Hill Park at no cost to Organization. B. Provide one part-time employee from 2:00 p.m. to 8:00 p.m. on June 7, 1986, at no cost to Organization. C. Furnish sound system equipment and piano at no cost to Organization. 5. Hold Harmless. Organization shall indemnify, defend and hold City and its officers, employees and agents harmless from a~y claim, loss, cost, damage, demand, expense or liability, including reasonable attorney's fees, to the extent resulting from any intentional or negligent act or omission of Organization, relating to this agreement. This indemnity shall apply to a claim, suit or action against the City of San Bernardino based on alleged infringement of the proprietary rights of a third party. City shall indemnify, defend and hold Organization harmless from any claim, loss, cost, damage, demand, expense and liability, including reasonable attorney's fees, to the extent resulting from any intentional or negligent act or omission of the City of San Bernardino, its officers, agents or employees relating to this agreement. 6. Notices.
