RESOLUTION NO. 86-193
2 RESOLUTION OF THE CITY OF SAN BERNARDINO REVISING THE
BEAUTIFICATION PROGRAM OF THE CITY OF SAN BERNARDINO, AND
3 DESIGNATING THE REDEVELOPMENT AGENCY TO ADMINISTER THE PROGRAM.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

6 SECTION 1. The Beautification Program heretofore
7 established by the City of San Bernardino is hereby revised, and
8 shall from this date be administered in accordance with the
9 procedures established herein.
10 SECTION 2. ADMINISTRATION. The Beautification Program of
11 the City of San Bernardino shall be administered by the
12 Redevelopment Agency of the City of San Bernardino.
13 SECTION 3. FORMS OF ASSISTANCE. The Program shall be a
14 combination of grants and loans, which shall be administered
15 under the following principles:
16 A. Grants. For applications wherein the total project cost
17 is two thousand dollars or less, the Agency may grant fifty
18 percent of the total project cost, not to exceed nine hundred
19 ninety-nine dollars.
20 Grant funds will not be approved for reroofing or for
21 resurfacing of parking lots or driveways, but patching and
22 cutting of parking lots may be considered.
23 B. Loans. For applications wherein the total project cost
24 exceeds two thousand dollars, the Agency will consider granting
25 up to nine hundred ninety-nine dollars, and lending to the
26 applicant any or all of the project cost in excess of nine
27 hundred ninety-nine dollars, with the total amount of any such

loan not to exceed ten thousand dollars.
The interest rate for loans shall be as follows:

7 All loans shall be amortized over a five year period, unless
8 an applicant requests a shorter period. In the event full
9 payment of all amounts due on the loan is made within thirty
10 months from the date of execution, Agency shall grant as a credit
11 against the amount due thereunder fifty percent of the accrued
12 interest on said loan.
13 Loan origination fees shall be charged at the time of
14 origination of the loan in the amount of two percent of the loan
15 amount. These fees shall be paid by the applicant from the loan
16 proceeds and shall be used by the Agency to offset part of the
17 costs of appraisals, credit reports, preliminary title reports
18 and staff administrative time and expenses.
19 All loans shall be secured by a trust deed on the property
20 being improved, or other security instrument approved by Agency
21 Counsel, with the promissory note and trust deed or other
22 approved security instrument to be executed by the property owner
23 prior to the release of any loan funds by the Agency. The
24 promissory note and deed of trust or other approved security
25 instrument shall be in form approved by Agency Counsel.
26 Loan funds will not be approved for reroofing or resurfacing
27 of parking lots or driveways, although patching and cutting of

1 parking lots may be considered as appropriate uses of loan funds.
2 SECTION 4. APPLICATION PROCESS. All requests for
3 allocation of Beautification funds, either loans, grants, or any
4 combination thereof, shall be submitted on an application form
5 available from the Agency: the completed application shall
6 include a complete description of the work to be performed, an
7 itemized cost estimate of each element of the work to be
8 performed, and, if applicable, a copy of any notice or citation
9 from the More Attractive Community (MAC) Committee, or any
10 building or zoning inspector. Applications shall be processed
11 and action taken thereon in the order in which complete
12 applications are received.
13 SECTION 5. APPROVAL PROCESS.
14 A. Grants. The Executive Director of the Redevelopment
15 Agency is authorized to administratively approve all grants of
16 nine hundred ninety-nine dollars or less. An information
17 memorandum shall be transmitted to each member of the Common
18 Council on each grant which the Executive Director intends to
19 approve. If no objection is received by the Executive Director
20 from any member of the Common Council within seven days, the
21 grant shall be deemed approved and the Executive Director shall
22 proceed to make the grant. If any objection is expressed by any
23 member of the Common Council, the application shall be submitted
24 first to the Redevelopment Committee for review, and then to the
25 entire Common Council for final action.
26 B. Loans. The Executive Director of the Redevelopment
27 Agency is authorized to approve all loans for five thousand

1 dollars or less. Upon a determination that a loan should be
2 made. an information memorandum shall be transmitted to each
3 member of the Commission as to any loan recommended for approval
4 by the Executive Director. If no objection is received by the
5 Executive Director from any member of the Common Council within
6 seven days. the loan shall be considered approved. and the
7 Executive Director shall proceed to complete the loan. If any
8 objection is expressed by any member of the Common Council. the
9 application shall be submitted first to the Redevelopment
10 Committee for review. and then to the entire Common Council for
11 final action. For any loan exceeding five thousand dollars which
12 is recommended for approval. the application shall be submitted
13 to the Redevelopment Committee for recommendation. The
14 Redevelopment Committee shall submit its recommendation to the
15 full Common Council for appropriate action. Loans in excess of
16 five thousand dollars shall be made only upon approval of the
17 entire Council.
18 SECTION 6. DISTRIBUTION OF PROCEEDS.
19 A. Grants. Grant funds shall be disbursed only after the
20 work covered by the proposed grant has been completed. inspected
21 by Agency staff. and approved by the Executive Director. If the
22 applicant has paid for the work in full. and presents evidence of
23 such payment satisfactory to the Executive Director. the Agency
24 shall issue its check made payable to the applicant. If the
25 applicant fails to submit satisfactory proofs or has paid only
26 that portion to be paid directly by applicant. and the Agency's
27 share has not yet been paid. the Agency's check shall be made

1 payable to the applicant and to any contractor or supplier of
2 labor, materials or equipment who remains unpaid.
3 B. Loans. Loan funds shall be disbursed only after the
4 work has been completed, inspected by Agency staff, and approved
5 by the Executive Director. If the applicant has paid for the
6 work in full, and presents evidence satisfactory to the Executive
7 Director of that fact, the Agency's check shall be made payable
8 to the applicant. If the applicant fails to submit satisfactory
9 evidence of payment, or in the event that one or more contractors
10 or suppliers of material, equipment or labor remains unpaid, the
11 Agency's check shall be made payable to applicant and to any
12 contractor or supplier of labor, materials or equipment who
13 remains unpaid.
14 C. For any loan or grant funds paid directly to the
15 applicant, the applicant shall execute a document covenanting
16 that all suppliers of labor, materials or equipment have been
17 paid in full and agreeing to hold the Agency harmless from any
18 claims of suppliers of labor, materials or equipment arising from
19 the beautification project.
20 SECTION 7. ADMINISTRATION OF PROGRAM. In administering the
21 Beautification Program, staff shall be authorized to expend, in
22 accordance with the procedures specified herein, such funds as
23 are designated by the City or the Community Development
24 Commission of the City of San Bernardino for such purpose. For
25 purposes of this resolution, the twenty-six thousand seven
26 hundred ten dollars remaining in the current budget which has
27 been set aside for projects outside of Redevelopment Project

1 areas shall be available for use by Agency as grants and/or loans
2 for Beautification projects as to property outside Redevelopment
3 Project areas. Any additional funds which may hereafter be
4 budgeted by the Mayor and Common Council for Beautification
5 purposes shall likewise be administered by the Agency in
6 accordance with the procedures specified herein. All funds
7 realized from repayments of loans shall be deposited into the
8 Agency's Beautification Program budget, and shall be used for the
9 grant program.
10 SECTION 8. BOUNDARIES. The boundaries of the
11 Beautification Program shall be the major and secondary streets
12 throughout the City as itemized on Exhibit I attached hereto, and
13 the area designated by the More Attractive Community (MAC)
14 Committee, and the Enterprise Zone.
15 SECTION 9. CURRENT APPLICATIONS IN FILE. Agency shall
16 evaluate those pending applications which have previously been
17 filed but not yet approved, in light of the criteria established
18 herein. Priorities shall be given to projects in the More
19 Attractive Community (MAC) Committee's targeted areas, as
20 specified herein, but, if an application lies within the
21 boundaries established hereby, but is not within such targeted
22 area, the Executive Director shall determine whether other
23 factors exist justifying immediate or eventual approval of a
24 grant or loan for such business. The Executive Director shall
25 consider all relevant factors, including whether the building or
26 property is currently in violation of building codes or other
27 provisions of the San Bernardino Municipal Code, and such other
28

1 factors which may be appropriate. The applicant who submitted
2 any pending application falling within the boundaries as
3 designated herein may be invited to submit a new application
4 under this revised policy. All applications for grants or loans
5 lying outside the boundary areas shall be returned to the
6 applicant, and the applicant shall be advised that this policy
7 makes a grant or loan hereunder impossible at this time.
