HomeMy WebLinkAbout1986-066 1 RESOLUTION NO. 86-6fl RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE 2 EXECUTION OF A STANDARD CONTRACT WITH THE COUNTY OF SAN 3 BERNARDINO RELATING TO REHABILITATION OF FORTIETH STREET, FROM KENDALL DRIVE TO ELECTRIC AVENUE. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute, on behalf of said City, 7 A Standard Contract with the County of San Bernardino relating to 8 rehabilitation of Fortieth Street, from Kendall Drive to Electric 9 Avenue, which contract is attached hereto, marked Exhibit "A" and 10 incorporated herein by reference as fully as though set forth at 11 length. 12 13 SECTION 2. The agreement shall not take effect until fully signed and executed by both parties. WALKER, Director Transportation/Flood Control/Airports SUBJECT: COUNTY/CITY OF SAN BERNARDINO COOPERATIVE AGREEMENT - FORTIETH STREET RECOMMENDATION: Approve cooperative agreement between the County and the City of San Bernardino for the rehabilitation of Fortieth Street between Kendall Drive and Electric Avenue. BACKGROUND INFORMATION: The County and City have agreed that this road is in need of rehabilitation. The project is partly within each agency's jurisdiction. The City will be the lead agency. REVIEW BY OTHER DEPARTMENTS: On April 4, 1986, the agreement was reviewed by Deputy County Counsel Ed Robinson as to legal form. On April 1, 1986, the agreement was reviewed by the Department Affirmative Action Representative as to contract compliance. FINANCIAL DATA: The total cost of the proposed rehabilitation is estimated to be $320,200. The County's share of the cost is estimated to be $93,500 (29.2%) and will be funded from the County Road Fund under the SB 300 special road repair and rehabilitation program approved by the Board of Supervisors on November 25, 1985. WHEREAS, COUNTY and CITY desire to cooperate and jointly participate in a project for the rehabilitation of Fortieth Street from Kendall Drive to Electric Avenue hereinafter referred to as PROJECT; and WHEREAS, PROJECT is partially in the unincorporated area of the COUNTY and partially within the incorporated area of the CITY, and will be of mutual benefit to the COUNTY and CITY; and WHEREAS, COUNTY and CITY desire to set forth the responsibilities and obligations of each agency in relation to the performance of the proposed rehabilitation. CITY SHALL: NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: 1. Act as the Lead Agency in the design and construction of the PROJECT. 2. Arrange for relocation and/or protection of all utilities that may be affected by the PROJECT. 3. Bear responsibility for the cost of the portions of the PROJECT lying within the incorporated area of CITY. Said cost is currently estimated to be $226,700. 4. Provide preliminary and final plans, speCifications and estimates to County and obtain a no-cost permit from County prior to advertising for bids. 5. Require its contractors to maintain Worker's Compensation Insurance on all employees and a Public and Property Liability Insurance Policy of not less than $1,000,000 combined single limit liability coverage for bodily injury and/or property damage which shall name the County and the City of San Bernardino as additional insured parties. EXHI8IT "A" Po..L 0'...2... ., , . , 6. Award and administer a contract for rehabilitation of Fortieth Street between Kendall Drive and Electric Avenue (approx. one mile) 7. Upon completion of PROJECT, provide a cost analysis showing a breakdown of the PROJECT costs in the incorporated area of the CITY and in the unincorporated area of the COUNTY. COUNTY SHALL: 1. Bear responsibility for the cost of the portions of the PROJECT within the unincorporated area of the COUNTY. Said cost is currently estimated to be $93,500 and shall not exceed $105,000 unless approved by the COUNTY in writing. Payment of 90~ of the COUNTY share of the contract costs as indicated by the Engineer's Estimate shall be deposited with the CITY prior to award of the contract. Payment of the remainder of COUNTY'S share of the costs shall be due 30 days after submittal of the cost analysis and billing by the CITY. IT IS MUTUALLY AGREED AS FOLLOWS: 1. Neither party to this Agreement nor officers nor employees thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by the other party to the Agreement under or in connection with any work, authority or jurisdiction not delegated to the parties under this Agreement. It is also agreed that, pursuant to Government Code Section 895.4, each party shall fully indemnify and hold the other party harmless from any liability imposed for injury (as defined by Government Code Section 810.8) occurring by reason of anything done or omitted to be done under or in connection with any work authority of jurisdiction under this Agreement 2. Upon completion of the PROJECT, the CITY and COUNTY will maintain the portions of the work under their respective areas of jurisdiction. 3. PROJECT costs shall include contract payments, any utility relocation costs which are the responsibility of the agency and preliminary and construction engineering costs which shall be prorated between the CITY and COUNTY based on each agencies share of the total contract costs.
