HomeMy WebLinkAbout1984-559 RESOLUTION NO. 84-559 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, APPROVING THE ISSUANCE BY THE CITY OF ITS "CITY OF SAN BERNARDINO, INDUSTRIAL DEVELOPMENT REVENUE BONDS, SERIES 1984A (ANDRESON BUILDING PROJECT)", APPLYING AND MAKING CERTAIN DETERMINATIONS RELATING THERETO (TEFRA) WHEREAS, pursuant to Ordinance No. 3815 (the "Law") the City of San Bernardino (the "City") intends to finance the acquisition, construction and refurbishment of an office building of approximately 58,000 square feet, including, without limitation, equipment and other off-site and on-site facilities and improvements, located at 320 East "E" Street, in San Bernardino, California (the "Project"); and WHEREAS, the City has taken proceedings leading toward the issuance and sale of its "City of San Bernardino, Industrial Development Revenue Bonds, Series 1984A (Andreson Building Project)" (the "Bonds"), to obtain moneys to lend to the Developer of the Project to aid in the financing of the Project, all under and in accordance with the Law and the Constitution and laws of the State of California; and " San Bernardino 54333-000-2 WHEREAS, pursuant to the Tax Equity and Fiscal Responsibility Act of 1982, the issuance of the Bonds must be approved by an elected representative of the City after a public hearing; and WHEREAS, the City Clerk has caused notice of such public hearing to be published once (giving at least four- teen days' notice) in The Sun and has reported to the Mayor and Common Council that such notice has been duly and regu- larly given; and WHEREAS, the subject matter of the Hearing was the propo~ed financing by the City of the Project in an amount not to exceed $10,000,000; and WHEREAS, the financing of the Project was presented at the Hearing, and any and all persons who so desired appeared and were heard, and the Mayor and Common Council of the City of San Bernardino is fully informed in the premises. 2 26-C2-JWB-355.l8 12-19-84 (br) . San Bernardino 54333-000-2 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The above recitals are true and. cor- rect in all respects, and all actions heretofore taken by or at the direction of the City and its officers directed toward the sale and issuance of the Bonds therefor are hereby approved and ratified. Section 2. The issuance by the City of the Bonds in an amount not to exceed $10,000,000 is hereby approved, an4 the Mayor is hereby authorized and directed to execute this Resolution pursuant to said Tax Equity and Fiscal Responsibility Act of 1982. 3 26-C2-JWB-355.l8 12-19-84 (br) Section 3. Effective date. This resolution shall take effect upon adoption.
