II I I i RESOLUTION NO. 84-484 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING THE FACT THAT THE OWNER OF ALL THE LAND IN CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN HAS REQOESTEO ANNEXAIION 10 IHE CITY OF SAN BERNARDINO IN ACCORDANCE WITH THE PROVISIONS OF THE MUNICIPAL ORGANIZATION ACT OF 1977, AND APPROVING THE ANNEXATION OF DISTRICT NO. 337 (LAFC 2300). WHEREAS, the Mayor and Common Council of the City of San Bernardino duly received a request from the owner of all the land within certain unin- habited territory contiguous to said City, as shown on the records of the San Bernardino County Assessor, to annex said territory to the City of San Bernardino under the provisions of the Municipal Organization Act of 1977 (Gov. Code Section 35000, et seq.) because said territory will benefit from City services which will become available upon annexation to said City; and WHEREAS, a Negative Declaration was issued by the City of San Bernardino Environmental Review Committee in connection with said uninhabited territory and said information is on file in the office of the Clerk of the Board of Supervisors of the County of San Bernardino; and WHEREAS, at its meeting of October 17, 1984, the Local Agency Formation Commission of the County of San Bernardino duly adopted its Resolution No.1949 granting approval to proceed without notice, hearing or election, with 100% consent of the property owners; establishing the City of San Bernardino as the conducting authority and setting forth that the distinctive short form designation to be used throughout this proceeding shall be: lAFC 2300; and WHEREAS, it appears to the Common Council of the City of San Bernardino that the aforesaid annexation proceedings have been completed and everything performed at this time in accordance with said Government Code, conditions of lAFC Resolution No. 1949 and any and all other laws in any way connected with the said annexation procedure, NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 1 SECTION 1: That said uninhabited territory herein described as 2 Annexation District No. 337 (LAFC 2300) is hereby annexed and incorporated 3 in and made a part of tne City of San Bernardino. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 2] 22 23 24 25 26 27 28 SECTION 2: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows, to-wit: Commencing at the intersection of the Southwesterly right of way line of Cajon Boulevard and the Easterly line of Devore Tract as per plat recorded in Book 17 of Maps, Pages 78 - 80, records of said County and as shown on the Map recorded in Book 43, Records of Surveys, Pages 17 and 18; thence South 470 07' 38" East along said Southwesterly right of way of Cajon Boulevard, a distance of 5,491.02 feet to the intersection with the Easterly Hne of Parcel "0" of the Meyer Barclay Subdivision as per plat recorded in Book of Maps, Page 18, records of said County; thence South 430 15' 52" West, a distance of 227.20 feet (Recorded South 420 52' 22" West 227.51 feet) to the True Point of Beginning; thence South 460 46' 01" East, a distance of 629.86 feet; thence South 870 06' 30" East, a distance of 118.44 feet; thence North 020 53' 30" East, a distance of 126.45 feet to said Southwesterly line of Cajon Boulevard; thence Southerly along said Southwesterly line, a distance of 766.62 feet to the most Easterly corner of that certain parcel delineated on the Map recorded in Book 44, Records of Surveys, Page 28, records of said County; thence South 430 14' 00" West, a distance of 123.11 feet to the Northerly line of the AT&SF right of way as delineated on said last mentioned Map of Record of Surveys; thence Westerly along said Northerly line, a distance of 280.21 feet to an angle point therein; thence North 020 53' 30" East, a di stance of 51. 84 feet to an angl e point in said railroad right of way; thence Westerly along said railroad right of way, 686.8B feet; thence North 060 46' 20" East, a distance of 801.83 feet, thence South 47" 11' 53" East, a distance of 25.00 feet to the Point of Beginning. NOTE: Said property is also delineated on the Map of said Record of Survey recorded in Book 44, Page 28, Record of Surveys, records of said County. (Approximately 11.5 acres.) SECTION 3: The property herein annexed is declared to be a part of Ward 5 and the boundaries of Ward 5 are hereby altered to include said annexed territory, with zoning of MC: SECTION 5: That the area included in the above annexation is hereby detached from County Service Area 38, Improvement Zone G of CSA 38, County Service Area 70, and Improvement Zone A of CSA 70.
