2 I RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
[EXECUTION OF A FIRST AMENDMENT TO AGREEMENT WITH JOHN TERRANCE
3 ITUCKER RELATING TO USE OF THE RESIDENCE ON PATTON PROPERTY, AND
,SETTING FORTH THAT THE RESPONSIBILITY FOR ANY TAXES IMPOSED ON THE
4 USE OF THE PROPERTY SHALL BE BORNE BY PERMITTEE.
S BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 USAN BERNARDINO AS FOLLOWS:
7 SECTION 1. The Mayor of the City of San Bernardino is hereby
8 authorized and directed to execute on behalf of said City a First
9 Amendment to Agreement with John Terrance Tucker relating to use o±
10 the residence on Patton Property, and setting forth that the
11 responsibility for any taxes imposed on the use of the property
12 shall be borne by Permittee, a copy of which is attached hereto,
13 marked Exhibit "A" and incorporated herein by reference as fully
14 as though set forth at length.
15 I HEREBY CERTIFY that the foregoing resolution was duly
16 adopted by the Mayor and Common Council of the City of San
17 Bernardino at a regular meeting thereof, held
18 on the 2nd day of August 1982, by the following
19 vote, to wit:
20 AYES: Council Members Castaneda, Reilly, Hernandez,
21 Quiel, Hobbs, Strickler

FIRST AMENDMENT TO AGREEMENT
(Use of Residence on Patton Property)
THIS FIRST AMENDMENT TO AGREEMENT is entered into between the
CITY OF SAN BERNARDINO, a municipal corporation, referred to as
"City", and JOHN TERRANCE TUCKER, an individual, referred to as
"Permittee".
Citv and Permittee agree as follows:
1. Recitals.
(a) City and Permittee entered into an agreement on
November 15, 1979 (the "agreement"), relating to use of a
residence on Patton Property by Permittee, whereby Permittee shall
act as a watchman and conservator of the property.
(b) The parties now desire to amend the agreement to
provide that Permittee shall be responsible for any taxes imposed
on his use of the property, past, present or future.
2. Amendment. The agreement is amended by adding Paragraph
to read as follows:
"15. Possessory Interest Taxes. Permittee covenants during
e term of this agreement to pay all past, present, and future
xes and assessments that may be assessed or imposed upon the
rmittee's possessory interest in and to the premises and on
rsonal property that is located on the premises. Permittee
rees to indemnify and hold City harmless from, and to pay all
ms due hereunder forthwith upon demand therefor by City."
3. Other Provisions. All other terms, conditions and
venants of the agreement shall remain the same and be in full
rce and effect.
